Bradford, Village Manager � FROM: Scott D. Ladd, Building Official �� DATE: September 15, 1994 SUBJECT: Draft Ordinance am�nding the R-3 Zoning District. Tom, attached are eighteen {18) sets of packets containing a Draft Ordinance and a copy of the existing as-built site conditions in the R-3 District on Beach Road. In preparing the draft ordinance, it became evident that nat all of the non-confarming site requirements at the twelve condaminiums will be removed with the attached draft ordinance. Some of the non-conformities are to severe to be corrected by simply increasing or decreasing the site requirements to be in line with the worst case existing condition. Therefore, I prepared the draft ordinance in a farmat that will remove the majority of the non-conforming conditions. The remaining non-conforming canditions will have ta be delt with in a diferent manner, possibly by taking the remaining non-conformities to the Board -of Adjustment for consideration of the issuance of variances. I received input from the village attorney prior to drafting the ordinance and have faxed him a copy of the draft ordinance for his review. AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING ZONING ORDINANCE NO. 355, AS • AMENDED, BY .AMENDING SECTION IV, DEFINITIONS, BY ADDING A DEFINITION FOR TOWNHOUSES AND REVISING THE DEFINITION FOR MULTIPLE-FAMILY DWELLING; BY AMENDING SECTION VII, SCHEDULE OF REGULATIONS AND .APPLICATION OF REGULATIONS, SUB-SECTION (C), SCHEDULE OF SITE REQUIREMENTS, BY AMENDING THE R-lA, R-1 AND R-2 DISTRICT SITE REQUIREMENTS BY ADDING REQUIREMENTS FOR MINIMUM LA,NI)SCAPED OPEN SPACE AND BY AMENDING THE R-3 DISTRICT SCHEDULE OF SITE REQUIREMENTS IN ITS ENTIRETY; BY AMENDING SECTION VII (D), SCHEDULE OF DISTRICT AND USE REGULATIONS, SUB-SECTION (4), R-3 MULTIPLE- FAMILY DWELLING DISTRICT, PARAGRAPH (a), PURPOSE OF DISTRICT, BY CH�INGING THE MAXIMUM DENSITY FROM TWELVE (12) DWELLING UNITS PER GROSS ACRE TO TWENTY-FOUR (24) DWELLING UNITS PER GROSS ACRE AND BY AMENDING PARAGRAPH (b) PERMITTED USES, BY DELETING SINGLE FAMILY DWELLINGS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, Be it ordained by the Village Council of the Village of Tequesta, Palm Beach County, Florida, as follows: SECTION 1. Section IV of the Official Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as amended, is hereby amended by adding a new definition and revising an existing definition as follows: l. TOWNHOUSE. A single family dwelling constructed in a series or group of attached units with property lines separating each unit. 2. , DT+�ELLING. MULTIPLE. A building or portion thereof used for occupancy by three (3) or more families in separate independent units, providing permanent provisions for living, sleeping, cooking, eating and sanitation. Includes condominiums, apartments, group homes and row houses, but excludes Townhouses. SgCTION 2. Section VII of the Official Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as amended, is hereby amended at sub-section (C), schedule of site requirements, by amending the R-3 district site requirements in its entirety as set forth in exhibit "A" attached hereto. See Exhibit "A", Schedule of Site Requirements, attached hereto. SSCTION 4. Section VII of the Official Zoning Ordinance of the Village of Tequesta, Ordinance No. 355, as amended, is hereby amended at sub-section (D), Schedule of District and Use Regulations, sub- section (4), R-3 multiple-family Dwelling District by amending paragraph (a), purpose of district and paragraph (b), permitted uses to read as follows: (4) R-3 Multiple-Family Dwelling district. {a) Purpose of District: 1. It is the purpose and intent of this district to provide lands within the Village for a higher density range of multiple-family residential uses. In no event shall density exceed twenty-four (24) dwelling units per gross acre. This district is further intended for development of concentrated residential populations and should be applied only within the high density designated areas as depicted by the Comprehensive Development Plan. (b) Permitted Uses: 1. Multi-family dwellings. -2- S$CTION 5. Severability. If any provision of this Ordinance or the applicatio� thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. SECTION 6. Codification. This Ordinance shall be codified and made a part of the Official Code of Ordinances of the Village of Tequesta. SECTION 7. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCS was offered by Councilmember , who moved its adoption.
