SUBJECT: Fo=eclosure of Laduca � Walters Properties.
Attached, please find excerpts from the Village Code and from the
April 12, 1994 meeting of the Code Enforcement Board.
Additionally, you will find copies of the recorded orders for the
subject cases. A review of this material should indicate to you
that the Village is soon to be in the position to begin
foreclosure proceedings against both properties.
I believe that it would be in the best interest of the Village to
continue to deal with these properties with diligence as I have.
Mr. Randolph has suggested to me that the Village Council should
consider this matter to give final approval to go forward with
foreclosure action. With this in mind, I believe that it would be
appropriate to place this subject on the September 22, 1994
Village Council Agenda

� b. Any actions taken by the violator to correct the viola-
tions; and
c. Any previous violations committed by the violator.
(2) The code enforcement board may reduce a fine imposed
pursuant to this section. _ _ _ ._ _____ _
(c) A certified copy of an order imposing a fuae may be recorded
in the public records and thereafter shall constitute a lien against
the land on which the violation exists and upon any other real or
personz.t property owned by the violator. Upon petition to the
circuit court, such order may be enforced in the same manner as
a court jud�nent by the sheriffs of this state, includi.ng levy � 1TSt
� the personal property, but such order shall not be deemed to be a
court judgment ezcept for enforcement purposes. A fine ungosed
� pursuant to this section shall continue to accrue until the violator
comes into compliance or until judgment is rendered in a suit to
foreclose on a lien filed pursuant to this section, whichever oceurs
first. After three (3) months from the fil'ing of any such lien which
remains unpaid, the code enforcement board may authorize the
local governi.ng body attorney to foreclose on the lien. No lien
created pursuant to the provisions of this part may be foreclosed
on real propexty which is a homestead under Section 4, Article X,
of the Sta.te Constitution.
(d) No lien provided under this section shall continue for a
period longer than twenty (20) years after the certified copy of an
order imposing a fine has been recorded, unle.ss within that time
an action to foreclose on the lien is commenced in a court of
competent jurisdiction. In an action to foreclose on a lien, the
prevailing party is entitled to recover all costs, including a rea-
sonable attorney's fee, that it incurs in the foreclosure. The con-
tinuation of the lien effected by the commencement of the action
shall not be good against creditors or subsequent purchasers or
valuable consideration without notice, waless a notice of lis pen-
dens is recorded.

Boardmember Vorpagel moved to adopt the following motion
with the figures as read into the record by Code
Enforcement Officer Kennedy:
Based upon the recommendation of staff I move to adopt the
same language as in Motion number one for Case No. 93-01,
for Case No. 93-3.0: in violation for 140 days, rate at
which fine �as imposed �as $250.00 per day, and the total
fine was $35,000.00. Vice Chairman Treacy seconded the
motion. The vote on the motion was:

the motion was therefore passed and adopted.
Boardmember Michelle Delany-Tumlin moved to adopt the
following motion:
I move that with respect to Case N���*� 93-01, 93-04, and
93-i1 and the property affected thereby which is located
at 50 Golfview Drive, Tequesta, and with respect to Case
Nt�m�r!� 93-09 and 93-10 and the property affected thereby
which is located at 370 l�iaple Avenue, Tequesta, that
foreclosure proceedinqs be ;n�tituted at the appropriate
time in accordance with stautes. Motion was seconded by
Vice Chairman Treacy. Attorney Scott Hawkins advised the
'Board that there would be a three-month waiting period.
�Boardmember Vorpagel questioned Attorney Hawkins as to
whether the violators would be notified that the Board had
moved to institute foreclosure proceedinq. Attorney
Hawkins responded that under the recordinq law once a
� document had been recorded you were deemed.to have
knowledqe of it, and that if any mortqaqes exist on these
properties that this foreclosure action would be inferior
to the mortgages. The vote on the motion was:
