SUBJECT: Code Enforcement Board Recommendations Reqardinq Certain
�Code Enforcement Matters.
At the Auqust 3. 1993 Code Enforcement Board meetinq, under any
other matters, the Board entered into a discussion with the Villaqe
Attorney, the Code Enforcement Off icer and the Clerk of the Board
reqardinq what, if anythinq, could be done to enhance the Villaqe•s
code enforcement procedures, especially concerninq the abatement
procedures when a property owners lawn is continually in violation
of the maximum allowed heiqht requirement.
The Board also discussed the inordinate amount of time that it takes
to properly fallaw the Villaqe's abatement procedures. Followinq �
the discussion of these issues, the Board moved to recommend that
the Villaqe Covncil give consideration to vther abatement procedures
which are available, specificallp, Section 10-19 of the Villaqe Code
of Ordinances, as an alternative to coming bef ore the Code
Fnforcement Board and that the Board further requests that the
Villaqe Council look into =educing the time frames involved with
Section 10-19 <currently at 15 days).

RE: Code Enforcement Board; Eahanceaaent of Procedures
Dear Paul:
We are most appreciative of you taking time from your busy schedule
to meet with Councilmember Capretta and I last week to discuss code
enforcement procedures and ways and means to maximize the
effectiveness of existing ordinances for the betterment of this ,
community. As you know, we talked about three (3) basic actions
which, if undertaken, are perceived as enhancements to effective
code enforcement.
The actions that we discussed"were as follows:
1) Periodically, after trends are established in the minds of the
Code Enforcement Board Members relative to inadequacies, if
any, in existing Tequesta Ordinances pertaining to .code
enforcement, the Chairman of the Code Enforcement Board should
give a report to the Village Council, probably the Public
Safety Committee, reportinq oa noted shortcomings in Tequesta
ordinances, with any noted changes which may be felt to
increase enforcement effectiveness.
2) It is felt that the Code Enforcement Hoard should initiate
formalized follow-up procedures to keep itself apprised of the
status of outstanding cases. If the Board's agenda is used to
formalize status reports from Village staff as to the status
of previous cases having come before the Board, the Board will
have more information available to them regarding
effectiveness of actions taken.
3) For those tough cases where citations and fines seem to have
no bearing on the violator, the Board should consider
initiating a formal recommendation from the Board to the
Village Council recommending that.the Village avail itself of
its authority as outlined in Section 10-19 of the Code of
Ordinances to abate the problem and lien the property
accordingly.

colleagues at an upcoming Code Enforcement Board Meeting. �
Councilmember Capretta continues to review code en.forcement .
procedures of Tequesta and may shortly�convene a meeting of the

additio�al thoughts relative to the process, we would appreciate

SUBJECT: Code Enforcement Status Report
In response to the request of the Village Council at your Meeting
on May 27, 1993, attached hereto, please find the requested Report
indicating Code Enforcement Board activities which provides an
indication of the number of citations issued, the fines issued by
the Code Enforcement Board and the fines collected by the Village.
It appears that the Village Council wanted this subject to be
reviewed by the Public Safety Committee so that actions in this
regard could be recommended upon review, if needed. Additionally,
my notes indicated that Councilmember Capretta, in addition to
other outlined steps, wished to interview the Code Enforcement
Officer .
Accordingly, I will place this item on the agenda of the next
Public Safety Committee Meeting and request that the Code
Enforcement Officer be present to review this subject matter and
answer any questions that the Committee Members may have.
Additionally, by copy of this memorandum to Joann Manganiello,
. Village Clerk, she is requested to review the cases indicated
herein and compare the same to the official Sanitary Lien Book for
accuracy. Any discrepancies noted should be recorded and reported
to me forthwith.

Subject: Status Report on Code Enforcement Hoard Activities. '
Pursuant to your request reqardinq the subject matter and the
Village Managers memo of May 28, 1993, I offer the following:
I use the term "citation" to mean a written vfolation notice issued
� th=ough certified mail or hand delivery and only after at least one
verbal warning is ignored by a' violator. A verbal warniaq is
complied with an average of 9 out of 10 times and within a
reasonable period of time. It is the 1 out of 10 violator to whom
a citation is issued.
Since the creation of the Code Enforcement Hoard, 150 citations
have been issued. Of these, 69 have been placed on a CEB agenda
for hearings, 23 of them were heard while the remaining 46 cases
were dismissed mostly as all complied prior.to the hearinq date.
I have attached the CEH case log which I began to maintain in
January of 1991 as a reference to this memo. It qives an
abbreviated description of each case placed on an agenda and its
final results. For the year 1990, I have attached a log I
maintained only for cases the board issued orders on. Case numbers
are in order beginning with the year•in which they taok place. A�
separate listing of cases in which fines were imposed is also
included by case numb�r qivinq the current status of aIl fines
imposed and the collection status.
Finally, as it is my-impress3.on that the purpose of my providing
this �information is to help in ultimately improving Code
Enforceraent within the Villaqe, I am including a memo I distributed
in 1•991 advocating the adoption of the "Part Two" section of the
State Statutes. It is still my position that this woulc3 be the
most effective and effic3ent improvement we could make in this
area. � .

SUBJECT: Code Enforcement Infozmation requested by Mayor Capretta.
Attached, please find the data requested by the Mayor.
The information is formatted identifying the quantity of common
incidents handled by Violation Type. A quick review of the data
reveals the Building Department achieved compliance in 331 of 342
incidents without action by the Code Enforcement Board. The Board
had the opportunity to act on 1.0 of these cases durinq 1990. In
all, compliance was achieved in 341 of 342 cases. �
In answer to the Mayors question regarding the
enforceability of the codes, I can only offer , that I do not see
major problems with any of them and that the fact that we have
achieved compliance on nearly every case indicates to me.that the
codes are generally enforceable. I believe the problem does not
lie in the codes, but rather in the time it takes to achieve
compliance in certain cases. �
As you know, the problem of expediting compliance can be
soived by simply adoptinq Part II of the State Statutes relatinq to
Code Enforcement. This would allow for the issuance of citations
with established fines which would encouraqe viol�ators to more
� quickly comply.

DEFINITIONS AND BREAKDOWN
Below is a general description of the code sections cited as
violations for cases brought before the Code Enforcement Board
proceeded by the ma7or code heading, the numeric code chapter/section
and the number of cases for each type since January 1991.
HEALTH AND SANITATION
Chapter 10, Sections 10-17 and 10-18. Twenty-two (22) cases.
These are primarily cases involving vacant or improved lots having
. ground cover (weeds and or grass) exceeding 12" in height. A few
cases addressed the requirement to remove dead trees.
LICENSES
Chapter 11, Section Z5. Ten (10) cases. �
These cases simply address individuals operating businesses without an
occupational license.
ZONING "
Appendix A. Ten (10) cases.
These are various violations, the prirnary ane being the use of outdoor
displays by businesses�and about one ea�ch of the followinq:
o Parking a commercial vehicle in a residential district.
o Erecting a satellite dish without site plan approval.
o Maintaining a swimming pool without a required fence/barrier.
o� Failure to maintain landscaping pursuant to site plan approval.
o Operating a business from a residential district.
