November 21, 2013 CALL TO ORDER AND ROLL CAL� The Village of Tequesta Planning & Zoning Advisory Board sitting as the Local Planning Agency held a regularly scheduled meeting at the Tequesta Village Hall, 345 Tequesta Drive, Tequesta, Florida, on Thursday, November 21, 2013. The meeting was called to order at 5:44 p.m. A roll call was taken by Joanne Burnsed, Planning and Zoning Department, who noted the following were present: Chair James Hackett, Vice Chair Michael Schmidt, Board Member Janet Strand, Alternate Sebastian Loaiza, and Alternate Ashley Warren. Also present were Planning Zoning Director Nilsa Zacarias, and Village Attorney Keith Davis. APPROVAL CaF' AGENDA MOTION Vice Chair Schmidt moved to approve the agenda as submitted. Board Member Loaiza seconded the motion, which carried by unanimous 5-0 vote. 1. APPROVAL OF PREVIOUS 1�61EETING MINUTES MOTION Vice Chair Schmidt moved to approve the minutes of the September 99, 2013 meeting as submitted. Board Member Warren seconded the motion, which carried by unanimous 5-0 vote. 2. ORDINANCE NO. 46-13 An Ordinance of the Village Council of the Village of Tequesta, Florida, amending Chapter 78, Zoning at Article VI, Schedule of District Regulations, Division 2. Schedule of Use Regulations, Section 78-180. Mixed Use District, by reducing the maximum permitted building height from six stories/84 feet to four stories/50 feet; further amending Art. VII. Planned Residential Developments, Section 78-225. General Requirements and Special Regulations, by reducing the maximum permitted building height from six stories/84 feet to the maximum height permitted in the C-2 Zoning District, and also amending at Art. VIII Planned Commercial Developments, Section 78-255. General Requirements and special Regulations, by reducing the Maximum permitted building height from six stories/84 feet to four stories/50 feet in the MU Zoning District; providing that each and every other section and subsection of Chapter 78 Zoning shall remain in full force and effect as previously adopted, providing a conflicts clause, a severability clause, and authority to codify; providing an effective date; and for other purposes. The Village Attorney introduced Ordinance No. 46-13 into the record, and described the proposec� changes. MOTION �oard Member Schauer moved to recommend approval to Village Council ot' Ordinance No. 46-13 as submitted. Board Member Warren seconded the motion, which carried by urtanirnous 5-0 vote. ORDINANCE NO. 47-13 An Ordinance of the Village Coun�cil of the Village of Tequesta, Florida, amending Chapter 78, Zoning, by amending Sec. 78-177. C-2 Community Commercial District, to include retail package liquors as a permitted use in that zoning district, providing conditions for said use in the C-2 District, providing that each and every other section and sub-section of Chapter 78, Zoning, shall remain in full forc�e and effect as previously adopted, providing a conflicts clause, a severability clause, and authority to codify; providing an effective date; and for other purposes. The Village Attorney described proposed changes in Ordinance 47-13, and answered questions from the Board. MOTION Board Member Strand moved to re�ommend approval to Village Council of Ordinance No. 47-13. Board Member Loaiza seconded the motion, which carried by unanimous 5-0 vote. 4. PUBLIC COMMENT - None 5. BOARD COMMENT Chair Hackett expressed concern regarding who was initiating use and zoning code changes. Discussion ensued.
