Existing Article X. Off-Street and On-Street Parking and Loading Regulations.Section 73-691 provides for "parking
space having minimum dimensions of nine feet in widih by 18 feet in length for the parking of each motor
vehicle".
On October 10, 2013, Village Council approved to modify parking spaces from nine feet to ten feet width (First
Reading of Ordinance 38-�3). This initiative will have impacts on existing properties and new developments. The
impacts on existins multifamilv residential and commercial develoqments are as follows;
1. Existing commercial plazas, m��ltifamily residential and public building's parking spaces will become non-
conformities under the new code if it is approved on second reading. For example, the Village Hall's
parking area has a nine feet width parking space; under the new code the parking lot will become a non
conforming area.
Once property owners would like to increase the footprint of their building, they would need to provide
�dditional parking spaces and bring the parking area into compliance with the new code. In many
instances,existing sites will not be able to comply with this requirement.
2. '�here is a trend to upgrade parking ai-eas-multifamily residential and cornmercial prop2rties-to comply
with current ADA standards which trigger new parking lot restriping. Iri this cases, the future applicant
wou!d need to bring their development into compliance with the new code. Businesses located on
Cypress Urive arad rnUlti amily buildinas an Beach Road have limited space_and will be di icult to complv
witl� this new ccde provision.
Also, Divisian 4, Landscaping. requires one interior landscape island for every ten parl<ing spaces. In order
to comply with the new code, property owners will lose one sp�ce which will impact overall number of
parking spaces provided.
3. The above scenarios will create the need to apply for parking variances that will in�pact the multifamily
residential and business community. Variance applications are costly,tirrie cc�nsuming and applicants are
required to �emonstrate hardship.
In terms of new �evelopment, a ten feet in width will increase impervious a�ea impacting the permitted size of
the building square footage since ihe applicant still has to comply with percentage of open space.
The above analysis is respectfully submitted for your and Village Council ronsiderati��n. Leaving the parking space
width at 9 feet will contribute to both a business friendly environment and a customer satisfaction experience. As
a reference, please see enclosed�arking regulations from Town of Jupiter and Juno Beuch.

Mayor Brennan,
This is a follow up to our last week meeting (1.3.14) regarding parking space width. Today, I measured the width of
the following commercial plazas:
- COUNTY LINE PLAZA: parking space width : 9 Ft.
- TEQUESTA SHOPPES: parking space width : 9 Ft.
- VILLAGE SQUARE: parking space width : 9 Ft. (standard by Village Code) and 8 Ft. (compact by Village Code).
- CYPRESS PLAZA: parking space width : 9 Ft.
The current Village Code standard parking dimension is 9 Ft x 18 Ft. Per Village Code, 25°/a of required parking spaces
can be met by providing"compact car parking dimensions" (8 Ft. x16 Ft.)

AN ORDINANCE OF THE VII..LAGE COUNCIL OF THE VII.LAGE OF
TEQUESTA, FLORIDA, AMENDING CHAPTER 78. ZONING. ART. X.
OFF-STREET AND ON-STREET PARIflNG AND LOADING
REGULATIONS. BY PROVIDING NEW PARI�NNG REGULATIONS FOR
VETERINARY OFFICE USES, BY ADDING ItEGULATIONS
REGARDING PARKING LOT TRAFFIC CALMING DEVICES AND
INTERNAL SIGNAGE, AND REGARDING OFF-STREET YARD AREA
PARI�NG SPACES; FURTHER REVISING CERTAIN PARI�NG
SPACE, LOA.DING AREA AND DRIVE AISLE PARKING
REQUIREMENTS, AND BY PROVIDING FOR INTERNAL
CONSISTENCY .AND UPDATED GRAPHICS; FURTHER AMENDING
CHAPTER 78. ZONING. BY REPEALING ARTICLE IX.
SUPPLEMENTAL REGULATIONS, DIVISION 11, PARI�TG OF

VESICLES ON PRNATE LOTS; PROVIDING THAT EACH AND
EVERY OTHER SECTION AND SUB-SECTION OF CHAPTER 78.
ZONING. SHALL REMAIN IN FULL FORCE AND EFFECT AS
PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A
SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY;
PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, revisions to the Village's parking regularions are required to provide for the
re�cently adopted use of veterinaty office; and
WHEREAS, the Village Council also desires to pmvide regulations regarding the use of
internal parking lot sigaage and traffic calming devices, as well as yazd area pazking spa,ces, and
fiarther desires to revise cerCain parking space, loading area. and drive aisle parldug requirements
and generally update this article with new gaphics and for internal consistency with other recent
revisions to various zoning codes; and
WHEREAS, the Village's code regazding the parking of commercial vehicles, trucks
and recreat�ional vehicles, previously l�ed at Chapter 78 Article IX Division 11, has been
relocated to Chapter 46, requiring the repeal of said Chapter 78 Article IX Division 11; and
R'HEREAS, the Village Council believes the code amendme,nt contained in this
ordinance will be in the best interests of the citizens of the Village of Tequesta.

NOW, THEREFORE, BE TT ORDAINED BY THE VILLAGE COUNCII. OF THE
VII.LAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Sectlon 1: Chapter 78. Zoning, of the Code of Ordinaaces of the Village of Tequesta
is hereby amended at Art. X. Off-Street anfl On-Street Parldng and Loading Regulations, by
providing new regulations for veterinary office uses, by addiag regulations regarding parking lot
ttaffic calming devices and internal signage, and regarding off-str�t yard area, pazking spaces,
further revising certa.in parldng space, loading area and drive aisle garldng requirements and by
providing updated graphics and 'urternal consistency with other recent revisions to the Village's
zoning c�es; providing that Art. X. Off-Street and On-Street Parldng and Loading Regulations

For the purpose of this chapter, an off street parldng space shall consist of a
parking space having minimum dimensions of nine feet in width by 18 feet in length for
the parking of each motor vehicle, exclusive of access drives or aisles thereto. An on-

Minimum width of an acce�s drive shall be ten fe,et for R-1 and R-lA districts.
For a11 other districfs, the minimum width of each aisle designed and intended far the
maneuvering of a motor vekticle urto a parking spa.ce shall be determined by the angle of
parldng as shown in the parking lot dimension table of this division. The parking plan
sha11 be so ananged that each motor velucle may be place,d and removed from the
parking space assigned thereto and taken ta and from the property without necessity of
moving any other motor vehicle to complete the maneuver. Each lot, parcel, or property
subject to a development or redevelopment proposal shall be allowed to design its off-
street parking space areas utiiizing a maximum of 25 percent of the minimum required
parking spaces to be identified as"compact spaces° with minimum dimensions of eight
fe�t in width by 16 feet in length, subject to the review and approval of the village
consulting engineers, the village development review staff and the village council.
Sec. 78-692. Location of parldng areas in r�uired yards.
Required yazds and setbacks may be used for off-street parlcing, provided that
access drives or aisles and turning spaces sha11 be located within the lot lines. In
computing off-staeet r�uirements, street or sidewalk areas sha11 not be used for off-street

Sec. 78-693. Paving of parking spaces; obstractions in parlang area.
Where parking space is provided in open areas adjacent to or beneath any
building, structure or portion thereo� snch Parking spaces shall be paved witti asphalt,

concrete, paver block or similar surface, and it sha(1 be unlawful for the owners or
occupants of such building or structure to place on such parking area any furniture or
other property that will obstruct or hinder the free use of such parking area.
Sec. 78-694. Parking spaces for the handicapped.
For other than single-family uses, duplexes or two-family dwellings, parking
spaces for the handicapped shall be provided in all required parking lots, garages or other
similar facilities, as required by applicable state� cou_n and munici�al han �i�a��
�arkin reQUlations s�at�es.
Sec. 78-695. Location of off-street parking facilities.
All off-street parking facilities shall be located on the same site as or contiguous
to the use for which the parking is provided. Any contiguous site must be maintained
under unity of title to the site on which the primary use is located.

(b) The loading or unloading spaces required in each instance shall be not less than 12 feet
in width, 4Q �8 feet in length and 14 feet in vertical clearance, and may occupy all or
any part of any required yard except for a required front yard. The loading or unloading
spaces shall be screened from the street or public way and shall be exclusive of all
driveways, aisles, or drives provided for other off-street parking areas.

Sec. 78-697. R�erved parking spaees.
The use of and/or designation of parking spaces as "r�erved" for individual
tenants, business� and/or property owners shall be prohibited. This section sha11 not
apply to those parking spaces designated to meet the requirements of state, county and
municipal handicapped Aa�ing regulaxions.
Sec. 78-698. On-street parking.
On-street parking may, upon review and approval by the village council, be
a11ow� within all zoning districts within the village, and the minimum number of
required parking spaces to be provided may include a combination of on-street and off-
street spaces. When using on-street pazldng to meet a portion of tlie required parking for a
proposed project, only those spaces that lie within the street fronta,ge areas of the property ,
praposed for development or redevelopment may be included in the total calculations for
mee�ing the minimum required parldng requirements. On-street pazking c�n only be
provided on those streets that utilize curb and gutter drainage systems in lieu of swale
systems and where the total right-of-way width is sufficient to provide for approved
paved roadway traffic lanes, on-street parking �d curb and gutter drainage systems.
Sec. 7&699. Screening �� of off-street pari�ng areas.
All off-street parking azeas shall be screened and landsca� in accordance with
article IX, division 4 of tlus chapter.
Sec. 78-70(l. Drainage and maintenance of off-strest parldng are�as.
Off-street pazking facilities sha11 be drained to prevent adverse in.�t� �ege to
abutting properiy and/or public streets and alleys and surfaced with asphalt, concrete,
paver bl�k, or similar surface in accordance with applicable village specific;ations. Uff-
stre.�t pazking azeas shall be maintained in a manner as to not create a h�a�c or pedestrian
haxard or nuisance, as well as in a clean, orderly, and dust-free condition, at the expense
of the owner or lesse,e, and not use,ci for the sa1e, repair, dismantling, or servicing of any
vehicles, equipment, mate,�iaLs, or supplies.
Sec. 78-701. Marldug a� lighting and c�+lmin� of p�rking areas.
(a) Off-street parldng spaces sha11 be mark� by double parallel painted lines, curbs
or other acceptable means to indicate individual spaces. On-street parking spaces
shall be marked by single painted lines or other acceptable meaas, or as may be
requir� by the state department of transportation, to indicate individual spaces.
Compact parking sgaces shall be so identified by painting "Compact Vehicle
Only" on the surface of e�ch space sa designated. Handica�► accessibility parking
spaces shall be ideirtified and mazked per current federal, state and couMy
requirements. Signs, markers and/or direc�tional arrows sha11 be used as necessary
to ensure the efficiea�t and safe operation of the parldng lot or area. Each off-street
patking space sha11 be provided with a permanently a�xed car stop or continuous
raised curb made of concrete or other acceptabie material approved by the
building official.

Sec. 78-704. Control of access to streets.
(a) Intent. It is the intent of this section to provide comrol of access to s�eets in orde� :
to facilitate safe and efficient movemeats of traffic while affording reasanable
access to abutting I�roP�'hes•
(b) Stmzdards for access driveways. Access driveways sha11 be permitted by the ,'
village in accordance with the following guidelines: _
(I} Cor�er lats.
a. Along local streets, access driveways to corner lots shall be loc�t�
a minimum of 35 feet from the intersection of the projection of the
right-of-way lines to t�e centerline of the driveway, except as

Sec. 78-705. Requ4red nnmber of parl�ng spac�.
Certain of these requirements may be in conflict with the special pazking
requirements set forth in the property development standards for use within the MLJ
mixed-use distric�t. �Vhere a conflict exists, the property development standards of the
MU district shall apply. There shall be provided at the time of the erectioa of any main
building or structure, or at ttie time that any main building or structure is enlarged by
more than 25 percent of the squaze footage of the existing building or structure, or
incteased in capacity by adding dwelling units, guestrooms, floor azea or seats, minimum
off-street motor velucle parldng space with adequate provisions for ingress and egress by
a motor vehicle, in accordance with the following:
