The Special Magistrate appointed by the Village Council to hear code compliance cases
for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard
testimony at the Code Compliance Hearing held on the 23rd day of January, 2014, and based on
the evidence and testimony presented, entered an Order Finding Violation. The following
Findings of Fact, Conclusions of Law, and Order are hereby entered:
FINDINGS OF FACT
1. The Respondent is the owner of the property. Neither the Respondent nor the
tenant who is the subject of this case was present at the hearing; there was a
finding of proper notice.
2. Code Enforcement Officer Joe Petrick and Fire Code Inspector Craig
Spiegelhalter provided testimony and evidence of the violation, as contained in
the Village's evidentiary case file which was accepted into evidence. Inspector
Spiegelhalter testified that although Respondent had attempted to comply by
providing documentation regarding application of flame retardant material, the
documentation failed to certify that the person performing the application was
properly certified and licensed to do so, as required by code.
3. As of the hearing on January 23, 2014, based on testimony presented at the
hearing, the property was not in compliance with Chapter 34 Article III Sections
3461 and 34-64 of the Code of Ordinances of the Village of Tequesta.

CONCLUSIONS OF LAW
The above - stated facts constitute a violation of Chapter 34 Article III Sections 34 -61 and
34 -64 of the Code of Ordinances of the Village of Tequesta.
ORDER
The Respondent hereby is ordered to comply with Chapter 34 Article III Sections 34 -61
and 34 -64 of the Code of Ordinances of the Village of Tequesta within one week from the date
of this Order. If the Respondent fail to achieve compliance, a daily fine of Two Hundred Dollars
($200.00) per day may be imposed for each day the violation continues to exist.
Respondent is also assessed $204.44 for administrative costs incurred by the Village
through January 26, 2014.
Please take notice that you must appear at the Fine Assessment Hearing which will be
held on the 27 day of February, 2014 at 10:00 a.m. at Village Hall, Council Chambers, 345
Tequesta Drive, Tequesta, Florida 33469, unless the Code Enforcement Officer certifies that you
have timely brought your property into compliance.
Upon complying in any code compliance matter, it is always the responsibility of
the Respondent to contact the Code Compliance Division at (561) 76 8-0506 to request a
reinspection of the property.
