JUNE 10, 1994
I. CALL TO ORDLR AND ROLL CALL
� The Equity Study Commission, appointed by the Village
Council to review the �ccupational License Rates of
Tequesta and to make recommendations on those rates,
held its third and final meeting at the�Village Hall, -
357 Tequesta Drive, Tequesta, Florida, on Friday, June
10, 1994. The meeting was called to order at 8:41 A.M.
by Scott D. Ladd, Building Official. A roll call was
taken by Betty Laur, the Recording Secretary.
Commission members present were: John Giba and Mac
Goodner. Commission Chairman Edwin D. Nelson was
absent from the meeting.
II. APPROVAL OF AGSNDA �
Commission member Goodner moved that the Agenda be
approved as submitted. Commission member Giba seconded
the motion. The vote on the motion was:

III. APPROVAL OF PREVIOUS MEETING MINUTES (June 2, 1994)
Minutes of the June 2, 1994 meeting were not yet
available.
IV. NEW BUSINESS
There was no new business to come before the
Commission.
V. UNFINISHED BUSINESS
A. Coatinuation of review of proposed
occupational license fee schedule: Scott
D. Ladd, Building Official, explained that
this would be the last meeting of this
Commission, and a recommendation would
made to the Village Council so that an
Ordinance could be submitted for first and
second readings before renewal occupational
license notices would be sent out. He
reviewed what had been done since the last
meeting, stating that all categories had
been defined and some occupations that were
no longer in existence or that had never
been used had been deleted. He reported
that guidelines had been established for
each category. Commission member Giba had
then critiqued the result, and changes had
been made. Fees were then revisited to be
sure they were still in line.
Commission member Giba complimented Building
Official Ladd and Joanne McCabe of the
Department of CoimaQUnity Development for the
fine job they had done in defining categories
and reclassifying occupations, and stated he
now felt comfortable with the categories and
would be able to justify to anyone why a person
had been placed into one cateqory instead of
another.

occupations classified in the same category had
greater revenue potential than others, for
example a taxidermist and an oral surgeon.
Building Official Ladd explained the first
criteria was whether the test in the definition
of the ordinance was met to consider that
person a professional. Both occupations
require state certification and there is
formal schooling for both.
Commission member Goodner stated the greatest
revenue for the Village would be from
enforcement of occupational licensing, rather
than from the amount of fees set for various
categories. A full-time code enforcement
of f icer who could go into bus ines ses throughout
the Village and sign everyone up for licenses
is needed, and would probably pay for himself.
Commission member Goodner stated his position
that he felt the categories had been done very ------
well, and barring any financial disasters for
the Village, that changing fees for
occupational licenses should not be revisited
for several years.
Commission Member Giba moved that the
Commission accept and approve the revised
classifications and description of occupations
together with the fee schedules thereof, and
further recommend that these data
(descriptions, categorizations, and fee
schedules} be retained until there is
justification for chaaging such by the Village
Couacil. Commissioa Member Goodner seconded
the motion.
The vote on the motion was:

Council to review the Occupational License Rates of Tequesta
and to make recommendations on those rates, held its second

Florida, on Thursday, June 2, 1994. The meeting was called
. to order at 8:30 A.M. by Scott D. Ladd, Building Official.
A roll call was taken by Betty Laur, the Recording
Secreta�y. Commission members present were: - John Giba and --
Mac Goodner. Commission Nelson was absent
from the meeting. Tom Bradford, Village Manager, was also --
in attendance.

V. iJrTF'INISHED BUSINESS
A. Continuation of review of proposed occupational
license fee schedule: Scott D. Ladd, Building
Official, reviewed what had been done up to this
point, stating that after all fees were reviewed at
the first meeting, he had compared those fees
against the $10,613.00 increase cap allowed by the
State, changed those figures which the Commission
had directed him to change, and arrived at a total

meeting, Building Official Ladd had copied only
those sections from the Occupational License Tax
Ordinance and sent to the commission members for
their review.
Commission member Giba stated he had been unable to
find guidelines for the categories, and stated the
importance of being able to support the
differentiation between the categories in order to
have an answer when questioned by a business person
as to why they were placed in one category instead
of another. For purposes of discussion at this
meeting he had prepared a chart showing the
differentiation between categories and guidelines
for each category. Shown on the chart were
suggested criteria which miqht be used to
differentiate between categories: number of
employees; individual or agency; sales/inventory;
square feet of space; and service only or products
also. Commission member Giba suggested categories
start with the first one (A) as simple service by
an individual, no agency, no formal training (non-
professional) and gradually increase requirements

for the other categories. He suggested category
(B) might be service by an agency (no training/non-
prof�ssional); category (C) could be service which
requires training (agency/non-professional);
category (D) might be service which requires
� trairaing with a license (professional); category
(E) could be professional service with product; and
category (F) could be miscellaneous services.
Commission member Goodner agreed with Commissioner
Giba's concept, and also stated that no one whose
occupational license fee is increased from $200 to
$350, for example, would understand how�this could
be ornly a 10� increase, and this will be very hard
to justify to irate citizens; and that fees should
reflect the ability to make revenue. Commission
member Goodner also recommended that review of
Occupational License fees should be revisited only
every 6 to 8 years, not every two years as allowed
by State law.
Building Official Scott D. Ladd responded to
Commission member Goodner's concern that
enforcement of the occupational license fees would
increase income over the 10� ailowed by the law by
expl�ining that new licenses would not fall under
the $10,613 amount, and that as much revenue as
could be collected for new licenses would be
allowed.
It was the consensus of the Equity Study Commission
that Building Official Scott D. Ladd define the
categories, and establish graduated criteria
categories incorporating suggestions made by the
commission members. Commission member Giba would
critique the results.
(B) Recommendation fro� Co�mission regardine� proposed
changes to Occupational License Ordinance:
It was the consensus of the Equity Study Commission
to have another meeting to finalize the categories
and fees. The meeting would be held in time for
the Commission's recommendation to be presented to
Village Council for both first and second readings
of the new Occupational License Ordinance before

The Equity Study Commission, appointed by the Village
Council to review the Occupational.License Rates of Tequesta
and to make recommendations on those rates, held its_first __
meeting at the Village Hall, 357 Tequesta Drive, Tequesta,
Florida, on Friday, Apri}. 29, 1994. The meeting was called
to order at 9:04 A.M. by Village Manager Thomas Bradford.

Secretary. Commission members present were: Edwin J.
Nelson, John Giba and Mac Goodner. Tom Bradford, Village
Manager, and Scott D. Ladd, Huilding Official, were also in
attendance.

IV: NEW BUSINESS
(A) 1. Edwin J. Nelson was appointed to the position
of Commission Chair.
(B) 1. Scott D. Ladd, Building Official, reviewed
Florida State statute 205.0315, Occupational
License Tax Ordinance. Mr. Ladd advised the
Commission that the State of Florida had
passed legislation allowing municipalities to
increase up to l0o the sum of the total
revenue generated by the municipality in the
preceding f iscal. _ yea� ._ __ Future rate
increases of up to 5 percent every two years
may be implemented with a majority plus one
affirmative vote by the Village Council.
2. Implementation required the appointment of an
Equity Study Commission to make rate and/or
classification changes.
3. To arrive at the $10,613.00 dollar figure for
the 10% increase allowed the Village of
Tequesta, Mr. Ladd had reviewed each
occupational license category in the Village's
ordinance and checked it against the State law
which allowed different increase percentages
for different categories. He then prepared a
listing of all categories showing the current
fee, total collected during the preceding
fiscal year, the percentage of allowable
increase, current rate plus allowable
increase, recommended increase at
approximately 72�, total number of licenses
issued during the preceding fiscal year, the
total projected revenue from the allowable
increase, and the projected total recommended
revenue. Mr. Ladd had furnished this
information to Commission members along with a
comparison study showing rates charged by
Tequesta and by some of the other
municipalities in Palm Beach County. Mr. Ladd
advised the Commission that their options were
to accept the current Occupational License

Ordinance without making any changes; to
accept Mr. Ladd's recommended increases; or to
raise or lower any of the existing or
recommended fees while keeping within the
allowable caps mandated by the State law.
Mr. Ladd responded to Commission member Giba's
question as to who was required to obtain an
occupational license that anyone doing
business in Tequesta was required to have an
occupational license, no matter where they
reside.
Commission member Goodner stated he had
reviewed Mr. Ladd's comparison study and had
identified those categories in which
Tequesta's rates were higher or lower than
those of any of the other municipalities.
After discussion of each category, it was the
consensus of the Equity Study Commission to
add two subcategories to the Property
Maintenanee one for businesses with ---
1 to 3 employees and the other for those with
3 or more employees. It was also the
consensus of the Equity Study Commission to
change subcategories under RM, Retail
Merchants: RM001 Retail stock to $20,000
changed to Retail stock to $50,000; RM002
Stock $20,000 - $70,000 changed to Stock
$50,000 - $100,000; RM003 Stock over $70,000
changed to Stock $100,000 -$200,000; and to
add a new subcategory RM004 Stock over

the categories of Personal, Professional and
Specialized Services. The Commission directed Mr.
Ladd to use his discretion in the categories of
Property Maintenance, Retail stock to.$50,000, and
Residential Maintenance/Repair if he should need to
adjust figures to stay within the State mandated
• caps in light of changes the Commission had made at
this meeting.
The Commission members agreed with Commission
member Giba's suggestion to include a short notice
with renewal notices for occupational licenses to
the effect that rates had not been increased in the
last 15 years and State law required the rates to
be reviewed, which had been done by a commission of
citizens. -
Suggestions to increase total revenue were to hire
a full-time person to enforce occupational license
requirements or to hire a full time Code
Enforcement Officer who would also handle
occupatianal license enforcement.
C. It was the consensus of the Equity Study Commission
to leave the establishment of their meeting
schedule to Mr. Ladd, whose office will notify
commission members of the time of their next
meeting.

Equity Study Commission member Giba questioned Fire Chief
James Weinand egarding how an application for an
occupational license would trigger a fire inspection of a
building and who would pay the fire inspection fees. Fire
Chief Weinand advised, the owner of a building was
responsible for common areas but tenants were responsible
for the space they occupied, and that a fire inspection was
