SUBJECT: Annexation by Interlocal Agreement. ✓�^'
Attached, please find 10 copies of proposed Resolution Number 12-
93/94 and support documents required to achieve the subject
purpose. Please place the same on the February 8, 1994 Finance
and Administration Comtnittee meetinq agenda. If approved by the
committee, the matter could be heard by the Village Council on
February 24, 1994 and if appzoved, heard by the Palm Beach County
Board of County Commissioners on April 5, 1994. The identified
parcels would become incorporated into the Village upon execution
of the interlocal agreement by both parties.
Florida Statute 171.046 allows for annexation by interlocal
aqreement provided the parcels to�be annexed comply with certain
criteria such as strictly meetinq the definition of "enclave."
Additionally, the lands being considered must be developed oz
developable and less than ten acres in total area. Villaqe Staff
has zeviewed all the existinq adjacent enclaves and alonq with the
Palm Beach County Planninq Department Staff, determined three
qualifying areas. These areas are identified in attachment "A"
of the interlocal agreeme'nt. Further, the Village Attorney and
the County Attorney have independently reviewed and approved the
applicable documents.
Staff strongly recommends expeditious consideration of this
matter by the Village Council as the proposed annexation will be
in keeping with current policy and will allow for a more efficient
delivery of governmental services to the affected lands.
Additionally, the proposal will be beneficial to the Village as
the nine individual singie family residential properties
identified have a cumulative taxable value of 52,446,787.00. This
will result in additional revenues of 514,970.30, based on the
current millage rate of 5.9i40.

TEOUESTA. PALM BEACH COUNTY. FLdRIDA. AUTHORIZING THE
EXECUTION OF AN INTERLOCAL AGREEMENT WITH PALM BEACH
COUNTY PROVIDING FOR THE ANNEXATI4N OF ENCLAVES
I PURSUANT TO FLORIDA STATUTE 171.046.
WH£REAS. Flor ida Statute, Sect ion 163. O1 C 1991), knoxn
as the "Florida Inte=local Cooperation Act of 1969," authorizes
local covernments to make the most efficient use of their powers
by enablinc them to cooperate with other localities on a basis
� of mutuai advantave and thereby to provide services and,
facilities that w311 harmonize qeocraphic, economic, population
and other factors influencinc the nesds and developments of
local communities; and
AHEREAS, the Florida Interlocal Cooperation A�ct of 19b9�
� permits public acencies, as defined therein, to enter into�
interlocal acreements with each otber to iointly exercise anp

common and which each might exercise separatelp; and �
NHEREAS. Section 18 of Chapter 93-206, Laws of Florida,
created Florida Statute. Section 171.046, providinc for.the
annexation of enclaves pursuant to interlocal acreements between
municipalities and the countq which have iurisdiction over such:
enclaves; and

parcels to be annexed via this interlocal aareement meet the �

completely surrounded by the Villace or are surrovnded�by the � �

NOW, THEREFORE. BE IT ORDAINED HY THE VILLA�GE COONCIL �
OF THE YILLAGF OF TEQOF�TA. FLORIDA, as follows: �

authorized and directed to execute an interlocal acreement

An Interlocal Aoreement between Palm Beach Countv, a
political subdivisian oi the State of Florida, and the Villaae of
Tequesta, providinq for the annexation of enclaves pursuant to
Section 171.046. Florida Statutes.
This Interlocal Acreement is made the __._. daY
of . 1994, between the Village of Tequesta, a
municipality located in Palm Beach Caunty, Florida, hereinafter
referred to as °Villace", and �PALM BEACH COONTY, a political
subdivision of the State of Florida. hereinafter referred to as
^CODNTY", each one constitutinc a public aqency, as defined in
Part 1 of Chapter 163. Florida Statutes.
WHEREAS, Section 163.01. Florida Statutes < 1991>, known
as the ^Florida Interlocal Cooperation Act of 1969," suthorizes
local vovernments to make the most efficient use of their powers
bp enabling them to cooperate with other localities on a basis of
mutual advantage and, therebp, to provide services and facilities
that will harmonize geographic, economic, population and other
factors influencinc the needs and development of local
communities; and
WHEREAS. The Florida Interlocal Cooperation Act of 1959

way: that the lots have previously been cleared: and that the
lots have been subdivided in recarded or unrecorded plats; and
WHEREAS, it has been determined bv the villace and bv the
Count.y that the parcels to be annexed via this Interlocal
Ac7reement meet the requirements set out in Sect ion 171. 031< 13)< a)
�nd tb) and 171.04b, Florida Statutes, as such enclaves are
developed or are improved, are ten (103 acres or less in size.
and are completelp surrounded by the Villace or are surrounded by
the Villave and a natvral or manmade obstacle that allows passaoe
of vehicular traffic to the enclaves only throuch the Villave;

WHEREAS, the County and the Yillace aoree that the
parcels to be annexed via this Interlocal Aqreement are sub7ect
to the Land Use Atlas of the Palm Beach Countq Comprehensive Plan
and County zoninq and subdivision reculations until the Villaqe
adopts a Camprehensive Plan amendment to include the parcels to
be annexed in the Comprehensive Plan.
NOW THEREFORE, in consideration of the mutual
representations terms, and covenants hereinafter set forth, the
part ies hereby aqree as f ollows:
Section I. Purpose. �
The purpose of this Acreement is to allow annexation by
the 9illage of certain unincorporated enclaves which are
ident if ied in Exhibit "A" which is attached hereto and made a
part hereof.
Sect ion 2. Def init ions. ,
The fol iowina def initions shal l apply to this Agreement:
1. The term "enclave" shal l be def ined as set forth in
Seat ion 17 l. 031t 13> ( a> and C b> . Fl or ida Statures as
adopted by the Legislature in Chapter 93-205, Section 25.
Laws of Florida.
2. " Act" means Part 1 of Chapter 163. Florida Statutes.
3. "Agreement^ means this Interlocal Agreement.
including any amendments or supplements hereto. executed
and delivered in accordance with the terms hereof.
Sec 3 . Annexation.

Upon execution bp both parties, a copy of this Acreement
shall be filed with the Clerk of the Circuit Court in and for
Palm Beach County.
Se ion 6. Not if icat ion.
The Village hereby acknowledces that it has provided
written notice to all owners •of real property located in the
enclaves identified in Exhibit " A" whose names and addresses are
known by reference to the latest published ad valorem tax records
of the Palm Beach Countv Property Appraiser. The written notice
s hall describe the purpose of the Interlocal A�ereement and shall
state the date, time and place of the meetina of the Vi2lace
Council of the 9illaoe of Tequesta where this Interlocal
Avreement shall be coasidered for adoption. The written notice
shall also indicate the name and telephone nvmber of a Palm Beach
Countv staff person to contact recardinc the date, time and place
when the Palm Beach Countp Board of County Commissioners shall
cons ider the adopt ion of •this Interlocal Acreement.
Sect ion 7. Capt ions.
The captions and section designations herein set forth
are for convenience onlp and shall have no substantive meaninc.
� Sect ion 8. Severabil itq.
In the event that ang section, paragraph, sentence.
clause, or provision hereof be held by a court of competent
iurisdiction to be invalid, such shall not affect the remaining
portions of this Acreement and the same shall remain in full
f orce and ef f ect .
Sect ion 9. Entiretv of As�reement.
This Acreement represents the entire understandinc
between the parties, and supersedes all other negotiations.

on February 24th, 1999, at 7:00 P.M. the Village Council of the
Village of Tequesta, pursuant to Florida Statute Section 171.046,
will meet to consider the adoption of Resolution number 12-93/94
for the purpose of entering into an interlocal agreement with
Palm Beach County allowinq for the annexation of certain.enclaves �
suzrounded by the Village, including your property. The meeting
will take place in the Village Council Chambers, Village Hall, 357
Tequesta Drive, Tequesta Florida.
A copy of the proposed agreement is on file.with the Village of
Tequesta Department of Community Development located at 357
Tequesta Drive, Tequesta Florida. You may review the document or
obtain a copy during zeqular business honrs of 8:30 A.M. to 5:00
P.M. Monday through Friday. Should you have any questions
zegarding its contents, you may contact Steven Kennedy, Deputy
Building Official at (407) 575-6223.
In the event the resolutian is adopted by the Village, it will
then be forwarded to the Palm Beach County Board of County
Commissioners for consideration by the Board at a future County
Commission meetinq. Should it be necessary, you may contact John
Pancoast, of the. Palm Beach County Planning Division, at
(407� 233-5328 to determine the scheduled date an� tiiae of the
County Commission meeting. You or your zepresentative may attend
either or both of these meetinqs to comment on the proposed
� inte�local agreement and annexation of the sub�ect property.

NOTICE OF ANNEXATION
The Village of Tequesta, Flozida, proposes to annex certain parcels
of land to the territorial limits of the Villaqe of Tequesta as
desczibed in proposed Resolution No. 12 The Resolution,
upon adoption, will authorize and direct the Villaqe Council to
execute an interlocal agreement with Palm Beach County for this
specific purpose.
General locations of the areas pzoposed to be annexed are shown on
the map below. Legal descriptions of the areas proposed to be
annexed and copies of the proposed Resolution can be obtained from
the Office of the Village Clerk, 357 Tequesta Drive, Tequesta,
Florida, Monday through Friday, between the hours of 8:30 P.M. and
5:00 P.�M.
� Consideration� of the proposed Resolution will Be held at 7:00 P.M.
on February Z4, 1994, in the Tequesta Villaqe Hall, 357 Tequesta
Drive, Tequesta, FloZida. Interested parties may appear at the
meetinq to be heard with respect to the proposed Resolntion.
PLEASE TAKE NOTICE AND BE ADVI3ED that if any person desires to
appeal any decision made by the Council with respect to any matter
considered at this meetinq, he/she will need a record of the
