REQUEST: Application of DMT Commons to modify the exterior building color. The address of the
proposed application is 385 Tequesta Drive, Tequesta. The building has already been painted

3. BACKGROUND
DMT Commons (the Arcade) is part of Galley Square North. The current owners purchased this property
in 2013. Gallery Square North has three (3) owners: DMT Asset Mgmt. —# 385, Lighthouse Art Center -
#373, and OZ of Tequesta -#361, 363, 367, 377, 379, 381, 387 & 389 (Exhibit A).
In 1999, the Community Appearance Board reviewed an application for exterior modifications to Gallery
Square North submitted by Oz of Tequesta. The application included: repainting the exterior of the Gallery
to Benjamin Moore Champagne #1521 with a trim and accent color of White/Aquatint #844; replacing the
exterior awnings to white awnings with black accent; and changing the uniform sign format to individual
molded plastic letters in Benjamin Moore Black #1603 (Exhibit B). This is the current color palette of the
plaza.
4. STAFF REVIEW
The subject application is requesting approval to modify the exterior color for building #385 only. The
new building colors are: Upper Sign Area — BM Rich Cream #2153-60; Wood Panel Store Front — BM Desert
Tan #2153-50. The building has already been painted in the requested colors. In January 2014, the
applicant was advised by the Code Enforcement Officer that aesthetic modifications to exterior building
color require approval from the P&Z Advisory Board. The subject application was submitted on 2/10/2014.
5. FINAL REMARKS
• This development application met the requirements set on Section 78-334 notice of hearing. The
notice of hearing was advertised on March 9, 2014.

1) For new constru.ction or additions, Fifteen (1S� sets of professionally prepazed site plans showing
a11 existing and proposed structures, setbacks, parking and loadin.g layout, ingress and egress,
sidewalks and walkways, exterior lighting layout, dimensions of street frontages and property
lines and all signage.
2) Fifteen (1� sets of Landscaping Plans in. accordance with Village of Tequesta. Code af
Ordinan.ces, Division IV, Landscapi.n.g.
3) Fifteen (15� sets of multi-dimensional color renderings andlor photographs are to be provided.
The Planni.ng & Zoning Advisory Board needs to see an exact rendering of wha.t is to be placed
on the site. Color photographs or prints as close to the actual colors to be used must be supplied.
Since color printers often do not display the correct color, it is recommended tha.t samples of the
paint chips, as well as a sample of the support materials (i.e., cauvas, wood, metal, etc.) be
provided..
4) One (1) set of Plans 11x17 size and One (1) disk.

First as a bit of background.
Althouah mv wife and I are relatir� new members of Tequesta , having
moved our permanent residence here in .
2008. we �rv much fell in lave writh the commuinity, its people and the � .
overall unique nature of this towm. .
As such. v►►hen the prooertv at 385.Tequesta drive became available we
thouaht it would be a areat idea .
to further our roots in the communitv and made a desciion to see if we
could come to terms on the property.
When we contracted the buildina. we wrere told that the praperty was fully
rented writh lona term tenants w+ha were in
qood standina. and the owner. Mr Duncan , assured us that they all
intented to stav if we wanted them to.
It was onlv in the ele�nth hour of our contract in the course of our due
diliQence did we discover that the so called •
leases where 'aood' will at best and we had to at least have them
farmalized to protect ourself and our tenants. �
Some of the tenants maior concems was if were going to allow them to
remain. �f course. despite the rents beinp
below market. we had no intention of disruptinp the leases of those
tenants who had been there for many years and
wrished to stay. �
After closina on the nrooertv it became aoparent that the majar tenat,
Partners on Desiqn, wihich occu�ied three
bavs ofi ot�r �roqertv. was not in aood standing, and was not paying us our
rent. and in fac#. had not been �avina
Mr Duncan�his rent far the qast six months. This was a clear
misreprentation on the part of the seller. Never the less. • �
we understood Mr. Duncan was of failing health and we decided not to
pursue him leaallv. and in addition, we
told Partners on Desian that we wauld r�rork bvith them in an effort to help
them stav in their saace. Thev assured us
that thev were iust aoina through a'rough patch' and would have
everything in order very soan.
Despite our trvina to accomadate Partners on Design, fihey continued ta �
mis lead us and make emptv �ramises and
eventuallv after 6 months af not paying a dime in� rent we asked them to
kindly vacate the premises. �
After thev left. we had no choice but to clean the place up and get it �
suitable to rent. This included reqaintina fihe
exterior. fixina holes in the wa11s. cieanina the entire property, �
aettina new sianaae, and clearinca the median the
vestibule of the dead plant and debris, and #ixing the plumbing.

We had a number diffeeent tvaes of business that sought to rent fihe ' �
saace, however we were extremelv selecti� �
in chaosina the riaht tvpe of ciient that we felt would comp�iment the .
space as well as the overali ambiance of the .
Gailarv Sauare North com�lex. After se�ral months af sitting with the .
maiaritv of aur sqace unleased we we finaliv
were ab(e fio secure tenants which.�ve fiett would be a good fit, albeifi at
a discounted rate.
At this �oint we�aqplied for sianaae fior the new► fienants, as well as
havinina to realace the existina tenants sian so �
that thev would all conform and look oresentable. We also had to pay out
of pocket for this expense in order to secure
the new tenants.
Needless to sav. it has nat been a smooth transition, but we feel the
tenants in alace currentiv reqresent a aoad
mix of business that wrill add value to the communifiy and be in the
aeneral theme of what we want for the complex. �
An artistic and creative ambiance of good and decent people and business
brands.
We have received nothina but comoliments an bringing this praperiy up to
ifis current standards and are a bit perplexed
at whv we are beina penalized for trvina to do all the right things. In
the end. all we did w►as clean ua the prouertv.
and renaint it with a fresh coat of paint which we believe matched the
previous color.
In lieu of all of the above, wa hope that the Village will re evaluate
their position.

I am checking but I believe that the color on top where the 385 is was the color given to us
by the property managers maintence man but I will confirm that .
