This cause came on to be heard upon the above application and the Tequesta Planning and
Zoning Advisory Board having considered the evidence presented by the applicant and other
interested persons at a hearing called and properly noticed, and the Tequesta Planning and Zoning
Advisory Board being otherwise duly advised,
THEREUPON, THE TEQUESTA PLANNING AND ZONING ADVISORY BOARD
FINDS AS FOLLOWS:
1. The subject property is located in the R -3 Zoning District in the Village of Tequesta.
2. The applicant has submitted all documents required by the Village's Code of
Ordinances for Planning and Zoning Advisory Board review and final action.
3. The application and all supporting documentation and presentation materials as
reviewed by the Tequesta Planning and Zoning Advisory Board at its February 20,
2014 meeting, and as kept on file by the Village, are made a part hereof and are
hereby incorporated by reference.
4. According to Section 22 -53, approval by the Village Planning and Zoning Advisory
Board is required.

5. The applicants have applied for approval of a new paint color not part of a site plan
review application.
6. Under the provisions of the Village Code of Ordinances, the Village Planning and
Zoning Advisory Board has the right, power and authority to act upon the request
herein made.

3. BACKGROUND:
On May 27, 2011, Tequesta Towers filled an application to demolish a 410 Sq. Ft. pool cabana and construct
a new 2,904 Sq. Ft. Pool Cabana/Fitness Building in the R-3 zoning district. On September 1, 2011, the
Planning and Zoning Advisory Board recommended approval of the application. SPR 03-11 was approved by
the Village Council on October 13, 2011.
On December 12, 2013, the Planning and Zoning Advisory Board approved an application from Tequesta
Towers for Site Plan Modification (SPM 02-13) to eliminate the roof terrace and spiral staircase approved
under SPR 03-11. The application was submitted after the Planning and Zoning Department staff became
aware that the building had not been constructed per the reviewed and approved plans.

On January 7, 2014, the Planning and Zoning Department staff was informed that the pool cabana building
had been painted, but the new contractor was unaware of the requirement for specific paint colors.
Tequesta Towers was immediately contacted, and the subject application was filed.
4. STAFF REVIEW
The proposed Site Plan Modification application is to modify a previously approved Site Plan Review (SPR 3-
11) by changing the color of the new pool cabana building and, approval for future painting of the Towers
building (including landscape and retaining walls, and walkways) in 2016. Tequesta Towers is requesting a
modification to the building colors to be consistent with neighboring buildings and with the intention of
painting the Towers building (including landscape and retaining walls, and walkways) in "Clivdan White" in
2016. Please see attached statement provided by the applicant in reference to the subject Site Plan
Modification.

reviewed by the Platwing & Ze�ning Advisary Boazd. The Planning & 7�oning Advisory Board meets the
third Thursday of every month at 5:30 p.m., as needed in the Village Hall Cou.ncil Chambers, 345 Tequesta
Drive. The applicant will be informed by letter of their scheduled meeting rlate.
The Planning anc� Zoning Advisory Board sha11 have general authoritv as �utlined in Sec. 22.53. Powers and
duties. After review and recommendation by the Planning & Zoning Advisory Boarti, applications will be
heard by the Village Council for final approval. After approval by the Village Council, a building permit can
be issued by the Building Department. �

The applicant will submit to the Village of Tequesta Planning and Zoning Department the following
documents for Planning & Zoni.ng Advisory Boazd review, forty-five (4S� days prior to the meeting
date:
1) For ne�v construction or additions, Fifteen (15� sets of professionally prepared site plans showing
a11 existing and proposed structures, setbacks, pazking and loading layout, ingress and egress,
sidewalks and walkways, exterior lighting layout, dimensions of street fronta.ges and property
lines and a11 signage.
2) Fifteen (1S� sets of Landscaping Plans in accordance with Village of Tequesta Code of
Ordinances, Division IV, Landscaping.
3) Fifteen (1� sets of multi-dimensional color renderings andlor photographs are to be provided.
The Planning & Zoning Advisory Boazd needs to see an exact rendering of what is to be placed
on the site. Color photographs or prints as close to the actual colors to be used must be supplied.
Since color printers often do not display the correct color, it is recommended tha.t samples of the
paint chips, as well as a sample of the support materials (i.e., canvas, wood, metal, etc.) be
provided.

Ladies and Gentlemen:
We at Tequesta Towers apologize for our oversight concerning the change af the color on
our new 2 story fitness center.
The truth is that we lost our original General Contractor in a tragic death. This has
caused our lack of communication between us and the Building Deparrinent and left us in
a place that we did not know what Pariseleti had communicated to the Building
Department. We have been planning and budgeting to paint our high rise towers
consistent with our neighbor buildings. The Claridge, Carlyle, Cliveden, Ocean Sound,
100 Building are all white. Therefore, that is why we are painting our fitness center
white and plan to paint our high rise in 2416 in the same matching white color.
Once again, we apologize for this misunderstanding and appreciate your help.
