ORDINANCE NO. 5-14 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE CHARTER OF THE VILLAGE OF TEQUESTA AT APPENDIX A. "VILLAGE OF TEQUESTA LEGAL DESCRIPTION". BY REDEFINING THE TERRITORIAL BOUNDARIES OF THE CORPORATE LIMITS OF THE VILLAGE OF TEQUESTA SUBSEQUENT TO THE ANNEXATION OF 0.7278 ± ACRES, MORE OR LESS, OF REAL PROPERTY LOCATED ON US HIGHWAY 1 WHICH PROPERTY IS MORE PARTICULARLY DESCRIBED IN ANNEXATION ORDINANCE NO. 15 -12; WHICH REAL PROPERTY WAS ANNEXED INTO THE VILLAGE OF TEQUESTA BY THE VILLAGE COUNCIL PURSUANT TO PETITIONS FOR VOLUNTARY ANNEXATION; AND SUBSEQUENT TO THE ANNEXATION OF 1.463 f ACRES, MORE OR LESS, OF REAL PROPERTY CONSTITUTING AN ENCLAVE AND LOCATED ON COUNTY LINE ROAD WHICH REAL PROPERTY WAS ANNEXED INTO THE VILLAGE OF TEQUESTA BY THE VILLAGE COUNCIL PURSUANT TO INTERLOCAL AGREEMENT WITH PALM BEACH COUNTY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the Village Council of the Village of Tequesta, Florida has annexed 1.463± acres of real property, more or less, constituting an enclave and located on County Line Road into the Village of Tequesta pursuant to interlocal agreement with Palm Beach County; and has also adopted Ordinance No. 15-12 annexing a total of 0.7287 f acres of real property, more or less, located on US Highway 1 into the Village of Tequesta, and has redefined the boundaries of the Village of Tequesta thereby; and WHEREAS, in order that the Charter of the Village of Tequesta correctly reflects the Village's territorial boundaries, it is necessary to amend the Village Charter to redefine same. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, THAT: Section 1 : Appendix A. "Village of Tequesta Legal Description" of the Village of Tequesta Charter is hereby amended to reflect the newly annexed property which was annexed into the Village of Tequesta by interlocal agreement with Palm Beach County, and by the adoption of Ordinance No 15 -12. Section 2 : The correct territorial limits of the municipality known as the Village of Tequesta is attached hereto as Exhibit A and made a part hereof. Section 3 : Each and every other provision and section of the Charter of the Village of Tequesta shall remain in full force and effect as previously enacted. Section 4 : All Ordinances of parts of Ordinances in conflict herewith are hereby repealed. Section 5 : Should any Section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part thereof other than the part to be declared invalid. Section 6 : Specific authority is hereby given to codify this Ordinance.
