VARiANCE REOUEST
A request comes before the Village Council to redwce the parking requirement from ninety-two (92)
spaces to fifly (51) spaces. Code Reference: Section VIII, (I�(19), page 1142.
Staff camments: The parking reduction would not adversely affect the site. Staff would not recommend
auy further reduction in the parking.
Note: Please be aware that there may be some future variances that may be required. These items would
include the front monument sign (location in relation ta right of way setback) and the training tower
(construction details and height of tower).

➢ Trai.ning tower (no details on constcuction or height of tawer). The tower will be wnsidered at
another time.
➢ Fmnt monument sign encroaches into the Tequesta Drive right of way. Code requires a ten (10)
foot s�tback from right af way line. The sign location is currently under redesign and may be
before council for variance at a later date.
� ➢ R,ear properly line will require a wall and landscaping to separate the Public Safety Facility from
the dayc�re center lacated on the north boundary of the properiy.
➢ Off-Street parking did not meet fhe Code requirement (section viii (I�(19), p.1142). Parking
requirement is (1) space per (200) square feet of gross floor area. The Public Safety Building
will require (92) spaces to meet code.

STATEMENT OF INTENDED USE
The intended use of the subject property is to construct a new one-story public safety facility for
The Village of Tequesta's fire and police services. The site location for the new building is the
existing site of the Viliage �-Talt on Tequesta Drive, which has been demolished to ailow for the
construction of the new facility.
The subject property has a zoning designation of C 1— Neighborhood Commercial with a land
us� desigr�axion o� Commerciai. The puhlic sa�'ety facility is a permitted use within the C1
district as a Special Exception.
" The property to the north of the subject site is zoned Single Family Dwelling and as set forth in
the Viltage Comprehensive Zonin� Ordinance for the landscaping of property abutting
residential areas, the rec�uired landscaping and buf�ering will be provided. The praperties to the
south across Tequesta Drive as well as the properties to the east and west are aoned CI, which is
the same as the subject property.
This pro,ject complies with a!I the requirements set forth in the Comprehensive Zoning

(6) Limitations on the filing of a special egcepti�on.
'(a) Whenever village council has denied an application for a
special exception, the �illage s�all not thereafter consider
any further �pplication for specisl exception on any part of
or all. of the same property for a period of twelve (12)
months fro�n the date of such action.

tate the proper development of the village.
(7) Time limits for special exceptions. A special exception shall
commence within twelve (12) months from the d�te of grar►t of
the special exception unless extended by action of village council.
(a) Commencement of a special exception occwts upan the f 1-
ing of an� application for a buildi�ig � permit, preluninary
. plat or site plan, or upon the initiation of significant action
to eatisfy reqµirements for improvements conta;ned in a
deveiopment order or other regulatory documents relating
� to said special exception. '
(b) Only one (13� extension shall be perrnitted and shall nat
exceed six (6) months. •
(c) Special exceptions granted to any governmental unit sha11
be exempt fron�► the prnvi�ions of this subsection (7), unless
a tune limitation.is made a spec�c condition of the special
� �gcep�ion. -
(8) Special exception application process.

(a) A written petition for special exception shall be submitted
by naon on the 15th of the month or previous regular
business day indicating the section of these zoaing regula-
tions under which the special exception is sought and stat- �
� ing the grounds on which it is requested, with particular
re�erenee to the � written findings in subsection �(3) above
" and other specific conditian(s) if applicable which the vil-
lage counciI shall address. The petition shall include all
material necessary to meet the requiremen�s of the devel-
opment concept plan listed below and any additional in-
formation that will demonstrate that t,�ie grant of special �
exception will be �n harmony with general intent and pur-
pose of these zoning regulativns.
(b) A petitione� seeking special ezception approval shall sub-
mit a development conc�ept plan on one (1) or mare sheets
of paper measuring not more than twenty by thirty-
six (24 x 36) inches and drawn to a scale not smaller than
one hundred (100) feet to the inch. The follawing shall be
provided on the development concept plan.

STATEMENT OF INTENDED USE
The intended use of the subject property is to construct a new one-story public safety facility for
The Village of Tequesta's fire and police services. The site location for the new building is the
existing site of the Village Ha11 on Tequesta Drive, which has been demolished to a11ow for the
construction of the new facility.
T'he subject property has a zoning designation of C 1— Neighborhood Commercial with a land
use designation of Commercial. The public safety facility is a permitted use within the C 1
district as a Special Exception.
- The property to the north of the subject site is zoned Single Family Dwelling and as set forth in
the Village Comprehensive Zoning Ordinance for the landscaping of property abutting

Preliminary Environmental Assessment
July 2, 2001
A preliminary environmental assessment was conducted on June 29, 2001, for the 3.61 acre
project site. The project site is located on Tequesta Drive east of Seabrook Road. The project
site is bordered to the west by a shopping center, to the north by cotnmercial facilities, and to the
east by residential development. There is an existing village park which is adjacent to Tequesta
Drive, but it is not part of the proposed project. There is an existing fire station and living
quarters on the project site. The area immediately surrounding the fire station consists of the
following:
1. Driveways and parking areas
2. Scattered native trees (oaks)
3. Landscaped azeas around the back of the facility and the living quarters
4. Grassed areas/maintained areas
Land to the east of the fire station and maintained azeas consists of the following vegetation:
� 1. Open disturbed areas vegetated by numerous weedy species such as spanish tick, Bidens
�.; ragweed, Ambrosia sn .; wedelia, Wedelia sp .; morning glory, I omea , evine, �� �

Vitis sn.; Aster, Heterotheca sv.; and periwinkle, Catharanthus roseus.
2. Scattered native trees such as sand pines, Pinus Clausa and cabbage pa1m, Saba1 palmetto
3. Dense stands of the exotic Brazilian pepper along the northwest, east, and southern (next
to the park) perimeters.
4. Scattered ornamental sheffelaza trees.
5. Stand of mature sand pines with an understory of saw palmetto, and scrub oaks.
6. Pockets of Boston fem
7. Sand pine overgrown with gra.pevine and catbriar observed adjacent to east fenceline.
8. Weedy species within the sand pine zone.
9. Scattered spot locations of saw palmetto.
10. Scattered utility buildings and the concrete base for the water tower which is no longer
present.
During the preliminary review, no known endangered or threatened species were observed. Due
to the disturbed character of the sand pine area, it is unlikely significant habita.t is provided. No
wetlands were observed on site.
The attached exhibit provides a survey which has been revised on a preliminary and approximate
basis to show the approximate areas where na,tive trees may be removed. The size of the trees
most likely have changed since the original survey appears to have been done in 1997.
