The Village of Tequesta has received a request to abandon a portian of the utility easement in the
reaz of the property located at 110 River Drive, Tequesta. A CBS privacy wall, pool, deck and
screen enclosure vvere constructed thirl,y years ago, wluch encroach into the easement.
Attached are nineteen (T9) sets of packets for the above refereneed subject, which include the
following documents:
1. Written request far abandonrnent from 1�Tan. B. Bolz, Attorney for the owners
2. Application for Abandanment of Dedicated Public Property
3. Executed cc�pies Qf Partiai Vacation and Abandonment of Easement far affected utility
providers.
4. Survey of subject properry, Extiibit "A",
5. Copy of the Notice of Public Heating, which wa.s published in the Courier-Journal on
May 30, �001,
6. Resolution for abandonment to be acted upon by Cauncil and then forwarded to the
Village Attomey for recording.

Dear Russell:
This is to again formally request that the Village of Te uesta abandon that ortion of the
q p
utility easement in the rear of the above-referenced property that is encroached upon by the screen,
pool, deck and privacy wall, all of which were constructed over thirty years ago. Since I have been
unable to reach you by telephone, I am enclosing a form requesting the abandonment that was sent
to me by John Randolph and modified by me. As you know, I first requested this partial
abandonment over a month ago. I am therefore requesting that the Village take whatever actions
are needed to expeditiously grant the request. I have tried unsuccessfully to determine the fee for
this request, if any, the, cost of advertising, if any, the time frame and the process for this request.
Please advise me whe�her you need any additional information or documentation from me. PLEASE
PROCESS THIS `QUEST AS SOON AS POSSIBLE. Thank you for your cooperation.

NOTICE IS HEREBY GIVEN tha.t the Village Council of the Village of Tequesta, Florida,
at a regular meeting �o be held on Thursday, June I4, 2001, beginning at 7:00 p.m., in the Village
Recreation Center, 399 Seabrook Road, Tequesta, Florida, will have on the agenda. the following:
PETITION FOR THE ABANDONMENT OF A UTILITY EASEMENT, FIVE FEET IN

RESOLUTION NO. 44-00/01
A RESOLUTION OF THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH
COUNTY, FLORIDA, VACATING AND
ABANDONING A FIVE FOOT WIDE UTILITY
EASEMENT LOCATED ON THE NORTHEASTERLY
PORTION OF PROPERTY COMMONLY KNOWN AS
110 RIVER DRIVE, IN THE VILLAGE OF
TEQUESTA.
WHEREAS, a petition has been made to abandon
a utility easement, five feet in width, located
on the northeasterly portion of property commonly
known as 110 River Drive in the Village of
Tequesta, as set forth in the Plat and restated
in the Declaration of Covenants and Restrictions
affecting the property, recorded in Official
Record Book 3761, Page 1562, public records of
Palm Beach County; and
WHEREAS, all utilities using said easernent
have agreed to the abandonment; and
WHEREAS, the Village Council of the Village of
Tequesta does hereby find and determine that the
necessity for the five foot wide utility easement
located on the following described property is no
longer necessary and does not serve any public
purpose, nor is it necessary for public use.
NOW, TF�EREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL.
OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AS FOLLOWS:
Section 1. That certain five foot wide utility
easement located on northeasterly portion of property
commonly known as I10 River Drive, Tequesta, Florida,
more particularly described as follows, to-wit:
Lot 427, Tequesta, according to the Plat thereof
as recorded in Plat Book 25, Page 7, public
records of Palm Beach County, Florida
Be and the same is hereby vacated and abandoned.
Section 2. The Village Clerk is hereby authorized
to record this Resolution pursuant to law.
Section 3. This Resolution shall become effective
immediately upon passage.
