Public Notice is herebp given that the Viilage Council of the Village of Tequesta, Florida,
will hold a Public Hearing during the Village Council meeting Thursday, June 14, 2001,
beginning at 7:00 P.M., in the Village Recreation Center, 399 Seabrook Road, Florida, to
consider the following application:
An application from Wendp's International, Inc., lessee of the property located at
722 U.S. One North, Tequesta, for a Special F�ception as provided bp Section X(j�},
Special Exception Uses, of the Village of Tequesta Zoning Ordinance No. 355, as
amended, to allow the construction of a fast food restaurant, within the G2,
Community Commercial Zoning District

restaurant for purposes of these regulations. �
(a) Restaacrwtt An establishment whose primary buaiae.ss
is the sale of fovd and beverages to patrons for con-
sumption on the premis�es and whose de�ign and mettwd
of operatio� includes any of the fallowing: �
. 1. Patrons place :their arder at tlieir�table from aa
individual hand-held menu, which displays or de-
scribes the food and beverage available to thern.
2. Preparation, service and consumption of food aad
beveragea takes place within a coa�I�tely enclo�sed
. � building, accommodatiag at least eighty (80) per- �
cent of � the establishment's permitted seating
capacity.
3. Uutside table clining is permitted ia areas perma
nently design�ted for �ch use, and �hall not ex-
eeed twenty (�0) :percent of t�e eata�lishment's
permitted seating capacitq, shall be in $eepi�►g `
w�th the exterior arc�itectural theme of the build
� ing, and in n� � vasy shall permit the consumptioa
of food or beverages within au�omobilea.
4. Food and beverages are regula�rly served to pa-
trons while s�ted at �heir t�ble by an employee
of the establis�ent.

(90) percent of the establishment's permitted seating
capacity .�a.nd whose design, method uf operation or any
portion of whose b�siness includes any of the follow-
ing characteristics:

� directly to the customer in a motor vehicle either
' by a carhop or . by other �means which elimin�te

� kind in cunnection with regular restaurant activities
shatl be deemed a drive-in restaurant for purposes of

td) Carry-out restauran� Any establishment whose prin-
cipal business is the sale of foods, frozen de�serts, or
beverages to the �ustomei� in a ready=to�onsume state,
, and whose design or method of operation includes any
of the following characteristics:
1. � Food and beverages are ordered from a limited
� menu posted in sign form within the primary food
� service building or on the premises.

seeking relief by civil action thrnugh mandatory ir�junctive relief
' or other relief available through the courts.
� (5) Assessment to consEitute a lien against the property. The
� biII referenced above.shall be assessed to the owner of the prnp-
erty and, if remaining unpaid for a period of sixty (60) days after
issuance, the village manager ahall cause a lien to be filed against
the property, to be recorded in the public rec:ords of Palm Beach
County.
(6) Perforinance surety. In the event that the landscapin� re-
quirem.ents of this ordinance have not been met at the time that
a certificate of occupancy, or certificate of use is requested, the
village inay approve such request provided the village entera into
� an agreement with t.he owner or lus/her agent that the prnvisions
and requirements of this ordinance will be oomplied wifih. The
owner or hi�/her agent shall post a pezformance bond o�c other
apprnved surety in an amount equal to one hundred ten (110)
percent o� the cost of materials and labor and ot.her attendant .

a form satisfactory and acceptable to the villag�e, s�pecifying the

(I) Establisla�rtents Setling IntoxicatiRg Beverage�.
(1) All places of busines� selling intoxicating liquors, wines
� and beverages for consumption on the premises shall not be
located within a one-thousand-foot radius of any church, school or
youth center. The one thousand t1,000) feet shall be measured ia
a straight Iine from main enf�rance door to main entrance door.

(1) Statement of Purpose. The development and execution of a
zoning ordinance is based upon the division of the village into
districts, within which the use of Iand and structures and the
bulk and locatioa of �tructures in relation to the land are sub-

stantially uniform. .It is recognized, however, that there are cer-
ts�in uses and features which because of their unique charaGteris-
� tics, cannot be distinctly classified or regulated in a" particular
y dis�rict or districts, without consideration in each case, of the
� impact �uf such uses and fe�atures upon neighb�aring uses and the
� swr�ouadirtg ares, compared with the public need for .them at
- parti�ular locatione. Such uses and features are therefore treated
as special exceptaions. A special exception -is not the automatic

(2) Criteria Special exception uses and t,heir related aocessory
uses or any expansion, enlarg�ement, or modification af an exist-
ing special exceptian use shall be permitted only upon. authoriza-
tion of the village.council prnvided that such uses shall be found
by the vi�lage council to comply with the following requirements
and other applicable requirements as set forth in this ordiaance. :
(a) That the proposed use is a permitted special exception use.

(5) Denial: Should the village council deay a special °egception,.

reasons shall take into account the factors �der subsec�ion (3)
above and aiI othe� eonditions and particular regulations relat-
ing to the speci�ic. special exception requegted. --. �
(6) Limitations on the f Iing of a special exc�ption.
'(a) Whenever village council has denied an application for a
special exception, the village s�all not ther�ai�er consider
any further application for special enception on any pa�ttt of
or all. of the same property for a period of twelve (12)
. months fro�n the date of such action.
�(b) The time limi�s of sub�ection (a) above may be waived by
' three (3) aff'irmative votes of village couneil when such

(?) Time limits for special exceptions. A special exception shali
commence within twelve (12) months from the d��� of grant of
the sp�cial exception unless extended by action of village council.
(a) Commencement of a special exception occurs upon the f�-
ing of an � application for a buildit�g � permit, preliminary
plat or site plan, or upon the initia�ion of significant action
to satisfy reqµirementa for improvements cont�ned in a
deveiopment order or other regulatory documents relating
to said special exception.
(b) Only one (1)� extension shall be perr�itted , and shall nat
exceed six (6) months. -
(c) Special exceptions granted to any governmental unit shaiZ
be exempt frorri the prnvi�ione af this subsection (?), uniess
a time limitation. is made a specif c condition of the special
�xception. _ �
(8) Specisl exceptian application process, �
k
(a) A written petitioxi for speciat exception shall be submitted '�
by noon on the 15th of the manth or previous regutar
busines"s day indicating the section of these zoning regula-
tions under which the special exception is sought and stat-
- ing the grounds on which it is requested, with particular
referenee to the �written findings in subsection •(3) above �
and other specific conditionEs} if applicable which the viI-
lage courtcil shatl �ddress. The petition shall includ+� �all
material necessary to n�eet the requirements of the devel-
opment concept plan listed below and any additional in-
formation that will demonstrate that the grant of special •
exception vvill be in harmony with general intent and pur-
pose of th�se zoning regul�tions. �
(b) A petitione� seeking special exception approvai shall sub-
mit a development conc�pt plan on one (1) or more sheets
of paper measuring not more than twenty-four by thirty-
six (24 x 36) inches and drawn to a scaie not smailer than

Comment 1: Concem for control of construction debris.
Response 1: Plan Sheet C4 added with Silt Fence Detail. Note has been added to C1-4, stating that "Corrtractor shaN
transport all material removed in trudcs with tarpaulin oovers for disposal at approved site'.
Comment 2: One ERC credif is avaifable for Bank. Wend�s will be responsible for any remainder due.
Response 2: ERCs typicatly based on FDEP usage data, however, Public Services may consider actual use data.
Commerrt 3: Query for Landscape bedding material.
Response 3: The Landscape plan has been revised to more dearly sho�nr each material. Where high-density
