Public Notice is hereby given that the Village Council of the Village of Tequesta, Florida,
will hold a Puhlic Hearing during the Village Council meeting Thursdap, June 14, 2001,
beginning at 7:00 P.M., in the Village Recreation Center, 399 Seabrook Road, Florida, to
consider the following application:
An application from Lloyd Familp Marine, owner of the Jib Yacht Club Marina,
located at 46 Beach Road, Tequesta., for an amendment to a Special Fxception,
marina facilities, in the R-3 Multi.ple Familp Dwelling District, as provided by Section
X(J�, Special Exception Uses, of the Village of Tequesta Zoning Ordinance No. 355,
as amended, to allow for the construction of an accessory srructure pavilion with
.ADA compliant restroom facilities
At such time and place, the Village Council will hear all evidence in support of or in

(i) �me. A building�pern4it must be applied for within one (1)
year of the date of tbe $ite plan appmval or said approval
sha�ll be nullified. In the case of a site plan which provides
for development phases over a period of years, the village
council shall set forth tirne vvithin wliich application for
building permit on �ach phase shall be filed. In the event
that building perna►its are not filed within the times, the
approval shall terminate and be deemed null and void
unless such ti;ne period is extended for on+e (1) rnore year
only by the village council upon written request of the
aPPlicant. .
� (j) Application fee.
1. Administrative costs. Zb cover all administrative eosts -
incurred by the village in the site plan review process,
the applicant shall come upon submittal of the appli-
cation for site plan review, pay a fee in an amount as
establis�ied in Chapter 16 of the Village of Zlequesta
Code of Ordinances.
2. Additional costs. Zb cover all additional administrative
costs, actual or anticipated, including, but not limited
to, �ngirieering fees, consultant fees and special stud-
ies, the appl�cant shall compensate the� village for all
such costs prior to the processing of the application,
not later tl�an tlurty (30) days after final application
approv�l, whichever is determined as appropriate by
�he building official. Additional costs may also apply to
the expedited site plan review process.

(1) Marina facilities shall include facilities for wet storage and
the docking af pleasure crafts associated. with the residential
i district in which it is located. Marina facilities may include a

marina, boat dock and� yacht club. The yacht club may prnvide a
restaurant, lvunge, ships chandler and other club facilities ss �tn
accessory use to the marina, boat dock ar yacht club facility,
which shall be� r.estricted to social and recreational activities and
facilities with eatYag and driaking es�ablishments. Marina facili-
ties are allowed only as special exceptions in R-2 and R 3 Multiple-
family Dwelling Districts, for properties within said zones which
are contiguous to the intracoastal waterway, subjeet to the regu-
lations and restriction$ of the zc�ning �iist�icts and the requir�-
men�s for special exceptio;►s. � _
�(2) . Docking of plessure crafts is limited to not more than forty -
(44) boats At no time may mor� than t�venty-five (25) percent of
the slips in tl�e facility .be used for re�idential purposes. Any cra�t
docked at the facility used for temporary residential purposes
shall be allawed to serv� as a re�idence fo,r not� mo�e than a total
of eig�t (8) paonths during any one (I) year. There must be at
least four (4) months, intervening no�residency between ea�ch
eight-�nonth period of residency.

seeking relief by civil action through mandatory injunctive relief
or other relief available through the courts.
(5) Assessment to constitute a lien against the property. The
� bill referenced above ahall be assessed to the owner of the prop-
erty and, if remaining unpaid for a period of sixty (60) days after
issuance, the village manager shail cause a lien to be filed against
the property, to be recorded in the public records of Palm Beach
County.
(6) Performance surety. In the event that the landscaping re-
quirements of this ordinance have not been met at the time that
a certificate of occupancy, or certificate of use is requested, the
village may approve such request provided the village enters into
� an agreement with the owner or his/her agent that the provisions
and requirements of this ordinance will be complied with. The
owner or his/her agent shall post a performance bond or other
approved surety in an axnount equal to one hundred ten (110)
�� percent o� the cost of materials and labor and other attendant
costs incidental to the instaIlation of the required laridscaping.
' This surety shall run to the Village of Tequesta, and ahall be in
a form satisfactory and acceptable to the village, specifying the
time for the completion of the landscape requirements.
(I) Establishments Selling Intoxicating Beveracges.
(1) All places of business' selling intoxicating liquors, wines
and beverages for consumption on the premises shall not be
located within a one-thousand-foot radius of any church, school or
yuuth center. The one thousand (1,000) feet shall be measured in
a straight line from main entrance door to main entrance door.
(� Speciad Exceptiori Zlses.
{1) Statement of Purpose. The development and execution of a
zoning ordinance is based upon the division of the village into
districts, within which the use of land and structures and the
bulk and location of �tructures in relation to the land are sub-

stantially uniform. ,It is recognized, however, that there are cer-
tain uses and features which because of their unique chara�teris-
tics, cannot be distinctly classified or regulated in a particular
dis�rict or districts, without consideration in each case, of the
impact of such uses and fe�tures upon neighboring uses and the
surtounding area, compared with the public need for them at
parti�ular locations. Such uses and features are therefore treated
as special. exceptions. A special exception.is not the automatic
right of any applicant.
(2) Criteria. Special exception uses and their related accessory
uses or any expansion, enlargement, or modification of an exist-
ing special exception use shall be permitted only upon authoriza-
tion of the village. council provided that such uses shall be found
by the village council to comply with the following requirements
and other applicable requirements as set forth in this ordinance.
(a) That the proposed use is a permitted special exception use.
.(b) Tkat the use is so designed, located and proposed to be
,:, f ..operated so that the public health, safety, welfare anc�

(c) � That the use will not cause substantial inyury to the valu�
of other property in the neighborhood where it is� �p b�
located.
(d) That the use will be compatible with adjoining deve�o�
ment and the proposed character. of the .district wher� it ie

(e) That adequate landscaping and screening is provided �
required herein.
.(� That adequate off-street parking and loading is provi�ed
. and ingress and egress is so designed as to cause mininpum.
interference with trat�ic on abutting streets.
(g) That the use conforms with all applicable regulations �v-
erning the district where located, except as may otherv4►i�e
be determined for planned developments.
(3) Findings. Before any special exception is granted, th� vi�-
lage council shall apply the standards set forth herein and s�iall

determine that satisfactory provision and arrangement of t�e
following factors have been met by the petitioner, where applicable.
� (a) Compliance with all element,s of the Village of Tequesta �
Comprehensive Plan; �
fb) Ingress and egress to property and . proposed struCtures'
thereon with particular reference to automotive and pe-
destrian safety and convenience, tr�c flow and control, ,
and access in case of fire or catastrophe; �
(c) Off-atreet parking and loading area where� requi�'ed with
, particular attention to the items in (b) above; .
(dJ Refuse and service areas with particular reference to items
(b) and (c) above; �
(e) Nuisance factors detrimental to adjacent and nearby prop-
erties and the village as a whole, Nuisance factors shall
" include but not necessarily be limited to noise, odor, smoke,
gtare, electrical interference and/or mechanical vibrations;

as it deems appropriate in conformity with �hese zoning regula-
tions for the protection of the surrounding properties and the
neighborhood or general welfare of the public.
(5) Denial. Should the village council deny a special exception,
it- shall � state fully for the record the reasons for doi�ig so. Such
reasons shall take into account the factors under subsec�ion (3)
above and all other conditions and particular regulations relat-
ing to the specific special exception requested. �.. �
(6) Limitations on the filing of a special �xception.
'(a) Whenever village council has denied an application for a
special exception, the village shall not thereafter consider
any further application for special exception on any part of
or all. of the same property for a period of twelve (12)
months fro�n the date of such action.
�(b) The time limits of subsection (a) above may be waived by
' three (3) aff'irmative votes of village couneil when such

action is deemed necessary to prevent injustice or to facili-
tate the proper development of the village.
(?) Time limits for special exceptions. A special exception shali
commence within twelve (12) months from the d�te of grant of
the sp�cial exception unless extended by action of village council.
(a) Cornmencement af a special exception occurs upon the f�I-
ing of an application for a buildi�ig � permit preliminary
plat or site plan, or upon the initiation of significant action
to satisfy reqµirements for improvements conta}ned in a
development order or other regulatory documents relating
to said special exception. �
(b) Only one (1) extension shall be permitted and shall not
exceed six (6) months. �
(c) Special exceptions granted to any governmental unit shall
be exempt fro� the provisions of this subsection (7), unless
a time limitation.is made a speci�c condition of the special
�xception.
(8) Spe�ial exception application process. �

(a) A written petition for special exception shall be submitted �
by noon on the 15th of the month or previous regular
business day indicating the section of these zoning regula-
tions under which the special exception is sought and stat-
� ing the graunds on which it is requested, with particular
referenee to the written findings in subsection �(3) above
and other specific condition(s) if applicable which the vil-
lage council shall address. The petition shall include all
materiai necessary to meet the requirements of the devel-
opment concept plan listed below and any additional in-
formation that will demonstrate that the grant of special �
exception will be in harmony with general intent and pur-
pose of these zoning regulations.
(b) A petitioner seeking special exception approval shall sub-
mit a development conc�ept plan on one (1) or more sheets
of paper measuring not more than twenty-four by thirty-
six (24 x 36) inches and drawn to a scale not smaller than
one hundred (100) feet to the inch. The following shall be
provided on the development concept plan.

(c) The application shall be reviewed by the land development
staff withih thirty (30) days of the submission deadline.
Upon land development staff review and analysis of all _
submitted materials, the building o�cial shall forward a
recommendation to the village council. ��
(d) A public hearing shall be held by the village council. The
property owner may, appear personally or by agent or attorney.
(e) Notice of public hearing shall be advertised fifteen (15) and
five (5) days in advance of the public hearing in a newspa-
per of general circulation in the area. The own�r of the
property for which special exception is sought or his agent
or attorney designated by him ori the submitted petition
shall be notified by mail. Notice shall be given by mail to
��' � all owners of property within a three hundred (300) foot
radius of the boundary lines of the property for which a
" special exception is requested. The list of property owners
within the stated radius shall be provided by the applicant
from the most recent tax r.oll information as provided by
the Palm Beach County Appraiser's Off'ice. The applicant
must furnish an affidavit signed by the person responsible
for providing the aforementioned list. Notice of the public
hearing shall be prominently posted on the property by the
applicant for which a special exception is sought. Notwith-

shall not. constitute a jurisdictional defect provided that

.(9) Filing fee. Upon filing an application for special exception,
the. applicant shall pay a fee to the village at the time of filing of
�uch application. Said fee shall be in an amount as established in
� Chapter 16 of the Village of Tequesta Code of Ordinances, shall
not be reimbursable and is intended to defray costs of administer-
ing, processing, and reviewing the application.
(K) Trailers or Temporary Structures or Vehicles.
(1) On construction sites, trailers, temporary structures, or vehi-
cles used for coastruction offices on a construction site or in a
subdivision shall be permitted during the period of construction
only after a building permit for the construction job has been
issued.
(a) Such trailers, temporary structures, or vehicles, must be
removed from the building site or subdivision in accord-
. ', ance with tl�e provisions Chapter 5, Section 501 of the
-,� Standard Building Code/1985, and Section 103.6.1 of the
' Palm Beach County Uniform Countywide Amendments to
the Standard Building Code.
(b) Such permitted trailers, structurea, or vehicles, may be
used for sales habitation or promotional purposes, only
upon permission of the village council and shall be per-
mitted only after receiving a permit from the building
official for each such trailer. .
(c) A trailer, or temporary atructure, or vehicle used for a
construction office on a construction site located witlzin a
residentially zoned district of the village shall not have an
interior dimension greater than ninety-six (96) square feet.
The interior dimension restriction shall not apply to trail-
ers, or temporary structures, or vehicles which may be
permitted for subdivision infrastructure construction. Only
one (1) such trailer, or temporary structure, or vehicle used
for a construction office on a construction site shall be
permitted for each ovcmer-builder or prime contractor within

any given subdivision for which the village has previously
accepted the tangible improvements required prior �o the

(2) The intermi�tent ar continual placement or utilization of �
any trailer, temporary structure, or vehicle for the use, such as
but .not limited to, storage, shall be prohibited in all zoning:
districts.
(L) Commercial Vehicles and Trucks, Recreational Vehicles on
Private Lots.
.(1) No commercial vehicles or trucks over three-quarters ( ton �
rated capacity, may be parked on any property or right-of-way
wi�hin a residential area.
(a) Residential areas include all.areas within the village other
than C-1, C-2, C-�3, and R,iOP �
(b) This restriction shall not apply to the temporary parking
of such vehicles on private property in residential districts
whereon construction is underway for which a current a�d
valid building permit has been issued by the Village of � �
Tequesta and said permit is properly displayed pn th� �

(c) This restriction shall not apply to routine deliveries by �
tradesmen or the use of trucks in making service calls,
providing that such time period is actually in the. cvurse of �
business.deliveries or servicing, as the case may be. .
(d) This restriction shall not apply to the parking o� emer-
gency vehicles, provided that the time parked is actually
� necessary for th� emergency. Further, the restriction shall
not apply to volunteer emergency vehicles driven by r�si-
dents of the Village of Tequesta and parked on their property.
(e) This restriction shall not apply to a situation where such
vehicle becomes disabled and, as a result of such emergen-
cy, is required to be parked within a residential district for
longer than the time allowed herein. However, any such
vehicle shall be rerrioved from the residential district within
twenty-four (24) hours by wrecker towing, if necessary,

Jib Yacht Club & Marina
Justification for Variance
1. The existing Rest Room and Shower facility does not meet the mandatory
Americans With Disabilities Act (ADA) handicap accessibiliiy requirements; nor
can these toilet rooms be made to comply with these requirements at their existing
location.
The only open space large enough for new Rest Rooms is in the proposed area
wluch is limited on the north side by the marina seawatl, the west sicle by the
swimming pool, on the east side by parking and on the south side by the property
line.
The proposed reloca.tion incorpora.tes trie Rest Rooms into an existing concrete
deck area on the opposite side of the pool. This deck has a foundation, which a
structural engineer has certified, capable of supporting the proposed Rest Rooms
and proposed extended roof/pavilion areas over the existing deck.
The location of the proposed shucture will continue the basic building
alignmendsightline along the south property line.
With the conshuction of the new Rest Rooms, the existing septic tank will be
abandoned and the new fixtures will be connected to the public sewer; in keeping
with Loxahatchee River Environmental Control District requests.
2. The Americans with Disabilities Act legislation did not exist when the original
Rest Rooms were constructed.
3. This project is the only Mari.na zoning in the Village of Tequesta, so there is not
now, nor will there be under the present Zoning and Land Use designations, any
other similar structures in the Marina zoning district.
4. There are no other similaz building uses zoned in the same azea, and the design of
the structure is such that it will be in keeping with the sun�ounding schema of the
neighborhood.
5. The area that can be footprinted is limited on the north side by the marina seawall,
on the west side by the swimming pool, on the east side by parking and on the
south side by the property line. The restrooms must be a certain minimum size to
conform with certain minixnum dimensions.
6. Proposed building structure abuts a public access road, not a residence, and thus
does not have direct impact on any residence. The proposed new Restroom
structure likewise is designed to be residential in character, to be in keeping with
the surrounding the community.
