The owner appeared before the Specia! Master for a fine reduction hearing and has paid the reduced fine ordered at that hearing. The final step in resolving this case is the release of lien, which, according to Mr. Randolph, needs Council approval. (See attached "Reiease of Lien" form prepared by Mr. Randolph.) . RESOLUTION NO. 40-00/O1 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING THE RELEASE OF LIEN ON THE PROPERTY LOCATED AT 372 COUNTRY CLUB DRIVE, TEQUESTA, FLORIDA IN RETURN FOR THE PAYMENT OF $686.30 IN FINES AND AUTHORIZING THE VILLAGE MANAGER TO EXECUTE THE RELEASE OF LIEN ON BEHALF OF THE VILLAGE. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section l. The release of Lien attached hereto as Exhibit "A" and incorporated by reference as a part of this Resolution, is hereby approved and the Village Manager of the Village of Tequesta is authorized to execute the same on behalf of the Village of Tequesta. On October 12, 2000, I observed the property of 372 Country Club Drive, Tequesta, Florida, 33469 to be in vioiation of village ordinance in that grass, weeds, and undergrowth had been allowed to grow to a height of more than 12 inches from ground level. In conducting my investigation I learned that the owner of the property was one Luis M. Blanco and that he and his wife had apparently separated and had abandoned the property. I prepared and issued a Notice of Violation for the above- described violation, which was sent via registered mail and signed for by Mrs. Blanco. On November 11, 2000, a Speciai Master Hearing was conducted due to the fact that the violation had not been corrected as required. At that hearing the Special Master found that Mr. Blanco was in fact in violation and ordered him to correct the violati�n by December 5, 2000 or a fine of $25.00 per day would be imposed. On January 25, 2001, at the Special Master Hearin� conducted that day, I showed evidence that the violation had not been correct and as a result an order was issued by the Special Master imposing a fine of $1350.00. Mr. John Randolph, �Ilage Attomey, as a lien against the property properly recorded this order in the Public Records of Palm Beach County. During the end of December 2000, I noticed that the abandoned property had been cleaned up and did locate one John Keays, 176 Golfview Drive, Tequesta, Florida, 33469 on the property. Mr. Keays informed me that Mr. Blanco had signed a • Page 1 quick claim deed over to Mrs. Carolyn Magnor who was the 2"� mortgage holder on the property. Mr. Keays informed me that he was a former owner of 372 Country Club Drive and was attempting to clear up all the liens against the property so that he could repurchase it from Mrs. Magnor. He informed me that Mrs. Magnor and himself would request a fine reduction hearing in ftont of the Special Master concerning the lien recorded against the property. On March 29, 2001, a Fine Reduction Hearing was conducted and after providing testimony and meeting all�the requirements of village ordinance the Special Master issued a Fine Reducing Order reducing the fine to $686.30. On April 5, 2001, Mr. Keays did come to the Tequesta Police Department and did issue a check making full payment in the amount of $686.30. At my request, I had Mr. Randolph prepare a Release of Lien Form with respect to this matter. I have been advised by Mr. Randolph that the Village Council should be the final authority to determine whether the lien will be released and that this matter should be pla�Pd ,.on the aaPrcfa for the next Villaqe Council meeting.
