site located at � 1 U. S.Hi�way 4ne North, Tequesta, FL 33�69. Thc properiy was voluntarily annexcd
into thc Village. The site contains several lots that havc been developed as one overall site. The si�e has
been used as a restaurant with the parcel fronting an U.S.Highway One (containing Lats 1 ihrougi� ?)
having a current CAUnty land use designation of. PBC, Corn�nercial High (PBC. CH-5), and the rcar t.wo (2)
parcels (containing Lots 13 and 25) iiaving a P.BC land use designation of Medium Residentia2 (f'BC, MR-
5). The "Commercial" latut use being requcsicd pursuani lo thc Futare L,and Use elemeni af the Village of
Tec{ucsta Comprehensive Alan is consistent with the currcnt use of the properly, and it r•vill be of a sirnilar
land usc and irriensiry as those adjacent uses an U.S.F-Iighway CMe. The future land use rcqucst will requirc
a ch�rige to thc Future l.and Use (C'LU) Map. Because this properly was annex�i into the Village, lhe FLU
Map will bave to be arnended to reflect the new "Cornmcrcial" desi�,nation.
The proposed Futurc Land Use amendmcnt request is consistent with the Goals, �iectives and Policies of
the Villa�;e ot'Tcqucsta Compr�hensive Plan. The FLUlCompreheasive Plan amendrnent is a"small-scate"
ame��dment., lt u�ill be submitted to the State I7�p�u�nent of Coiuniunity Affairs (DCA) and other
appropriatc ageiicies for informatianal putposes, if approved.
Tlie Village Council, sitting as the Local Planning Agency (LPA}, held a duly advertised public hearing
regarding this proposed Future land Use{Comprehensive P1an anienci�ncnt on September 12, 2002. Thc
I.PA recommended approval of this Yxoposed amendment to the Village Council. Following the L,PA
hcarin�, the Village Council, at its regu]arl� scheduled meeting of September I2, 2t)()2, approved the
praposcd amendrnent upon �rst re�ading of Ordinan.ce Na. 575.
It is rccornmcndcd that the V'illage Cauncii. adopt this propasec� Future Land Usc/Caraprehcnsivc Plan
amendment upon second reading of Ordinance lYo. 575.

JUSTIFICATION STATEMENT
The Applicant annexed the subject property into the Village of Tequesta on September
21, 1999. The discussions with the Village leading up to the annexation, the Petition for
Annexation and the Annexation Staff Report all contemplated a Commercial Land Use
Designation as well as a Community Commercial (C-2) Zoning District for the property. The
commercial use is consistent with the property's frontage on U.S. Highway One, the adjacent
commercial uses and the historical commercial use of the property for a restaurant.
Unfortunately, after the property's annexation into the Village, no action was taken to assign a
Commercial Land Use or commercial zoning to the property. At this time the Applicant requests
a Commercial Land Use and rezoning to C-2 as was contemplated at the time of the annexation
and in order to be consistent with surrounding properties. Palm Beach County has assigned a
CH/5-Commercial High with underlying Medium Residential 5 land use and CG-General
Commercial zoning District to Lots 1 through 7 and a Medium Residential 5 land use and RS-
Single Family Residential zoning district to the parcels historically used for paxking for the
commercial use. The request is consistent with the County's assigned land use, the historical use
of the parcels and the Village's Comprehensive Plan and will allow for the appropriate
redevelopment of this parcel considering its location.
