Code Enforcement Special Master Torcivia approved the minutes of the September 30, 1999 hearing as submitted. B. Fine Imposation Hearings: None C. Violation Hearings: Case No. 9914175 K-Mart Corporation 3100 West Big Beaver Road Troy, Michigan 48Q84 C/O Facilities Manager 9903 Military Trail Boynton Beach, FL 33436 Nature of VioOation: Violation of Tequesta Code of Ordinances, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several to all SPECIAL MASTER C�DE ENFORCEMENT HEARING MINUTES October 28, 1999 Page 2 Districts (H); Landscaping Generai Requirements (15) Maintenance Required Pages No. 1178.8 A representative of the Respondent, K-Mart Corporation, was present at the he�aring and testified that they were having difficulty in gaining access to the water and electricity to repair the sprinkler system. Sgt. Irovando testified that a representative of the property owner, Tamwest Realty, Inc., would be at the hearing but a representative was not present. The Tequesta Code Enforcement Officer, Sgt. Irovando, testified to and produced photographs of the violation. Conclusion of lawwas that Respondents are in violation of Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several to alf Districts (H); Landscaping General Requirements (15} Maintenance Required Pages No. 1178.8 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, K-Mart Corporation and Tamwest Realty, Inc., shall comply with Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several to all Distriets (H); Landscaping General Requirements (15) Maintenance Required Pages No. 1178.8 of the Code of Ordinances of the Village of Tequesta by the 10th day of November, 1999. If Respondents do not comply within the time specified, a fine of two hundred fifty dollars ($250.00) per day, five hundred ($500.00) dollars per day for repeat violators, may be assessed for each day the violation continues to exist. A Status and Fine Assessment Hearing will be held before the Special Master on the 18th day of November, 1999, at 10:00 a.m. at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Should a dispute arise concerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. The Tequesta Code Enforcement Officer testified to and produced photographs of the violation. Concfusion of law was that Respondent is in violation of Appendix A-Zoning, Section X, (H) of the Code of Ordinances of the Village of Tequesta.. Special Master Paulette Torcivia ordered that Respondent, Jacksonville Tower Associates, LLC/ R/A The Parmenter Company, shall comply with Appendix A- Zoning, Section X, (H) of the Code of Ordinances of the Village of Tequesta by the 21 st day af January, 2000. If Respondent does not comply within the time specified, a Fine Assessment Hearing will be held before the Special Master on the 27th day of January, 2000, at 10:00 a.m., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. King 98000695 366 Elm Avenue Tequesta, Florida 33469 Legal Description JUPITER IN THE PINES SEC B LT Z BLK 25 60-42-40-25-06-025-0020 Nature of Violation: Repeat Violation of Tequesta Code of Ordinances, Appendix A Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several to all Districts (L); Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots (2), Page No. 118�4.1. The Respondents, Robert H. King and Helen V. King, were not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the ongoing violation. The Special Master made a finding that this case was a repeat violation. Conclusion of lawwas that Respondents are in violation of Appendix A-Zoning, Section X, (L)(2) of the Code of Ordinances of the Village of Tequesta.. Special Master Paulette Torcivia ordered that Respondents, Robert H. King and Helen V. King, shall immediately comply with Appendix A-Zoning, Section X, (L)(2) of the Code of Ordinances of the Village of Tequesta. A fine of fifty dollars ($50.00) is hereby assessed for the violation that has existed. Should this violation be repeated, a fine of one hundred dollars ($100.00) per day will be assessed for each day the violation continues to exist. A certified copy of this Order shall be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter ��'���AL MASTER COQE ENFQRCEMEMT �.,, �u. If Respondents do not comply within the time specified, a Fine Assessment Hearing will be held before the Special Master on the 18th day of November, 1999, at 10:00 a.m., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469.
