The Special Master appointed by the Village of Tequesta to hear code enforcement
cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard
testimony at the Code Enforcement Hearing held on the 28th day of October, 1999, and based on the
evidence and testimony presented, the following FINDINGS OF FACT, CONCLUSIONS OF LAW,
and ORDER are hereby entered:
FINDINGS OF FACT
1. A representative of the Respondent, K-Mart Corporation, was present at the
hearing and testified that they were having difficulty in gaining access to the water and electricity to
repair the sprinkler system.
2. Sgt. Irovando testified that a representative of the property owner, Tamwest
Realty, Inc., would be at the hearing but a representative was not present.
3. The Tequesta Code Enforcement Officer testified to and produced
photographs of the violation.

CONCLUSIONS OF LAW
Respondents are in violation of App. A, Sec. X(H)(15) of the Code of Ordinances
of the Village of Tequesta.
ORDER
It is the Order of the Code Enforcement Special Master that Respondents, K-Mart
Corporation and Tamwest Realty, Inc., shall comply with App. A, Sec. X(H)(15) of the Code of
Ordinances of the Village of Tequesta by the l Oth day of November, 1999.
The Village of Tequesta shall send a notice and a copy of this Order to request the
property owner to attend the next hearing.
If Respondents do not comply within the time specified, a fine of up to two hundred
fifty dollars ($250.00) per day; five hundred ($500.00) per day for repeat violators, may be assessed
for each day the violation continues to e�st.
A Status and Fine Assessment Hearing will be held before the Speciai Master on the
18th day ofNovember, 1999, at 10:00 a.m., at the Tequesta Village Council Chambers, 357 Tequesta
Drive, Tequesta, Florida 33469.
Should a dispute arise concerning compliance, either party may request a hearing
before the Special Master on the issue of compliance only.
Upon complying, it is the responsibility of the Respondents to notify the Village of
Tequesta Code Enforcement Clerk at (561) 575-6213 to request a reinspection of the property.
DONE AND ORDERED this 28th day of October, 1999.
