Said. easement is for the following sole Yurposes: � -� �
1. Over the westerly 20' of the above-described easement;�� �'
for the purpose of construction, operation and maintenance of °-
water transmission facilities, including valves and appurtenances;
provided, however, that no facility shall be installed above
finish.ed grade.
2. Over the easterly 10' of the above-described easemen.t, for
the purpose of ingress and egress for vehicular traffic, to the
area generally known as Well Field No. l; further, Grantors shall
not place any abstructions on the property so as to prevent Grantee`s
rights af ingress and egress as so provided herein. If Grantors do
not pave the portion of the easement for purpose of ingress and
egress,as stated herein, Grantee may pave that portion ot the ease-
ment.
The easemen� for ingress and egress granted herein �hall not
be �xclusive.
�his easement shall not restrict Grantors, their successors and
assians to pave entire easement with asphalt or other material. and
cause cars to be parl�ed on the westerly 20' of the abOve-described
easement.
It shall be lawful for the Grantee to have access ta constr.uct,
, - operate, maintain and repair the said water transmission facili.ties
� as there shall be occasion, but Grantee shall cause. any dan�age to the
surface of said easement to be restored to the condition it existed
prior to any such construction, repair or maintenance.

DiVosta relative to the above mattex.
They have had further cor_ferences with the administration
in Teguesta aftex pxeparing plans for their new building.
As a result of these conferences � have re-pxepared the
easement deed.
The enclosec� easement incxeases the easement axea �rom 25 to
30 �eet. The westerly 20 feet of the easement are for the
water transmissian facilities and the easterly 10 feet are
for inc�ress and egress. My clients plan to pave the entire
easement and wi11 keep the 1Q feet open for their purposes and
your purposes �or vehicular traffic.
T understand that you will be out of your office until
August 28 and I would appreciate you letting me know whether
the enclosure is acceptable as soon as possible. My clients
are arranging to appear on the Tequesta agenda on Tuesday

l. Over the westerly 20' of the above-described easement,
for the purpose of construction, operation and maintenance of
water transmission facilities, including valves and appurtenances;
provided, however, that no facility shall be installed above
finished grade.
2. Over the easterly 10' bf the above-described easement, for
the purpose of ingress and egress for vehicular traffic, to the
area generally known as Well Field No. l; further, Grantors shall
not place any obstructions on the property so as to prevent Grantee's
rights of ingress and egress as so provided herein. If Grantors do
not pave the portion of the easement for purpose of ingress and
egress,as stated herein, Grantee may pave that portion of the ease-
ment.
The easement for ingress and egress granted herein shall not
be exclusive.
This easement shall not restrict Grantors, their successors and
assigns to pave entire easement with asphalt or other material and
cause cars to be parked on the westerly 20' of the above-described
easement.
It shall be lawful for the Grantee to have access to construct,
operate, maintain and repair the said water transmission facilities
as there shall be occasion, but Grantee shall cause any damage to the

surface of said easement to be restored to the condition it existed
prior to any such construction, repair or maintenance.

spaces to be ten (1.0) foot wide by twenty (20}foot long and therefore

to present th� proposed solution to the easement prob],ems on the west
side o£ the property. -
�he green shaded area would provide fo� a twenty (20) foot
cai.de piping easement along the entire c�estern edge of the propex�ty which
would also be used for parking spaces as noted.
The red shaded area would.provide for a ten (10) foot wide
access easement parallel to the east line of the piping easement for the
fuli depth of the property.
. $o�h of these easements appear,to conform to Mr. Syc�ow's
- desires expressed in his September 29, I977 letter in this regard (copy
enclosed).
Mr: B�tterfield and myself have discussed the possibility that,
due to the configuration of the parking spaces and vehicl,es not completely
pulled forward into the parking spaces �ioht force larger pieces of

equ�pment, tractor trailer trucks making deliveries, etc. to encroach
' oTi. the driveway of the shopp�.ng plaza to the east of the comb�ned
easements and perhaps, the access easement should be fifteen (15) foot
wi�1e instead of ten (10) for a total ease�ent width of thirty-five (35)
feet instead of thirty (30) feet,, to assure adequate clearance for
Village vehicles at all times.

� I have reviewed the Quit Claim and Easement Deeds prepared
and submitted by Jim Weber on behalf of Otto B. DiVosta.
By striking from the Quit Claim Deed the language which I
had inserted which reserved to the Village an easement which
it now has or might have over the said property for public
utility purposes and by excluding from the Easement Deed any
language relating to vehicular access over and across said
easement, the instruments effectively preempt the Village
having any access to Wellfield No. 1.
This matter can be remedied in one of two ways. First, we
can simply add language to the Easement Deed which would
specify that the grantee shall have vehicular access over
and across said easement at all times for purposes of having
access to Wellfield No. 1 or we can eliminate the Easement
Deed altQgether and replace it with a Quit Claim Deed. As
you know, it has always been my opinion that if we are going
to trade properties, that we trade them on an equal basis and
that we trade Quit Claim for Quit Claim. In talking with Bill
Sydow, I find that he is of the same opinion as he is concerned
that we may have problems with this access over the Easement
� Deed, especially in the event that the property is transferred
at a later date from DiVosta to another party. If you are of
the impression that the Council, in light of the above, still
wishes to trade a Quit Claim Deed for an Easement Deed, I think
we can protect the Village by inserting language in the Easement

Re: Easement for Water Line DiVosta Property
Dear Bob:
Before transferring any property belonging to the Village o£
Tequesta and exchanging for property which we suppose to be the
private property of Otto DiVosta and Rudy Steinhauser, it would
be prudent to have a title chain run on the property to make
sure that an easement was not granted to the Village of Tequesta
or to anyone else for that matter, to the west 25 feet of DiVosta's
property. It may well be that even if there is not a recorded
easement that the Village may have a prescriptive easement in that
property by virtue of the £act tha.t it has been using same over
the years without objection from the fee simple property owner.
I certainly do not want to create any problems with this matter,
but neither do I want to give away property of the Village in
exchange for a property right which we may already have. Further,
, it seems to me that if DiVosta wants us to actually deed the
easterly 25 feet over to him that he should deed the westerly 25
feet over to us rather than merely give us an easement. Please
advise if you have any questions in regard to this matter.

Re: Easement to Well Field No. 1
Dear Mr. Harp:
According to the recent information you submitted to me, the
existing ten inch water main extending from Well Fie1d No. 1
to Bridge Road is eight feet inside of the west property
line boundary. The existing easement is 25 feet wide and
located on the east side of the property.
To warrant any possibility of damag� to future buildings in
the event of a pipe line failure and to provide the adequate "
space for any possible repairs or rnaintenance, it is recom-
mended that a easemant of not less. than 2Q feet in width be
obtained on the west side of the property. •
