Subrnitted heret��ath is a proposed Compreh.ensive Pian amendment regarding public school concurrency It
is prepared per requirements of the "Palm Beach County Inlerlocal Agreement ��ith Municipatities of Palm
Beach Cowrty and the School District of Palm Beach County to Eslablish Public School Concurrency".
The Village is a signatory to this Interlocal Ageement along with 25 other municipelities, the Palm Seach
County Commission and the Palm Beach Counta School Board. Specifically, the Fublic School Facilities
Element (PSFE) is being amended by updating TABLE PSF-1, STANDARDS FOR TiERED LEVEL OF
SERVICE {LOS) and TABLE PSF-2, I�ti�MUM iTTIidZATION TABLE: Staitdards for Utilization of
Capacity. Atthough this amendment may appear to be minor in scope, it canstituies a Iarge-scale
amendment pursuant to Chapter 163, F.S. (State planning law), and is subject to all proc�edural and
advertising requirements for iarge-scale amendments.
This propased amendment was coardinated w7th the Palm Beach Counry Planning sta�', the Palm Beach
County �chool Board, as well as with the Florida Department of Community Affairs (DCA) who will
review the amendmern. The proposed amendmeM was submittefl to iPARC (Interlocal Planning and
Review Committee) for their review and inforn�ation. No objections or adverse comments were issued
regarding this PSFE amendmern.
Local gacernruents are limited to two (2) large-scale amendments per calendar yeaz. The Village has made
one (1} large-scale amendrnent to its Comp�ehensive Plan in 2tIO2. The Village Council, sitting as the
Loca1 Planning Agency (LPA), held a duiy advertised public �uearing regar+ding this PSFE arnendment on
September 12, 2002. The LPA recon�u�nended approval of the proposed amendment to ihe Village Council.
Fallowing the LPA hearing the Village Council, at its regularly sch�iuled meeting of Segtemi�er 12, 2002,
a�roved the proposed amendment upon first reading of Urdinance Na. 577.
It is recomxnended that the Village Council adopt tlus proposed Public School Facilides Eleraent
(PSFEJComprehensive Plan Amendtnent upon second reading of Ordinance Na 577.

AN ORDINANCE OF THE VII.LAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, FLORIDA,
AMENDING THE ADOPTED VII.LAGE
COMPREHENSIVE PLAN, PURSUANT TO
CHAPTER 163, FLORIDA STATUTES, AND
CHAPTERS 9J-5 AND 9J-11, FLORIDA
ADMINISTRATIVE CODE, AMENDING TEXT
WITHIN THE PUBLIC SCHOOL FACII.ITIES
ELEMENT (PSFE) ACCORDING TO AN
INTEI�LOCAL AGREEMENT BETWEEN THE
VII.LAGE, PALM BEACH COUNTY AND PALM
BEACH COUNTY SCHOOL DISTRICT;
PROVIDING FOR CODIFICATION,
SEVERABILITY, AND EFFECTIVE DATE, AND
FOR OTHER PURPOSES.
WHEREAS, the Village of Tequesta has initiated amendments, according to the
interlocal agreement titled "Interlocal Agreement with Municipalities of Palm Beach
County and The School District of Pa1m Beach County to Establish Public School
Concurrency" in accordance with Chapter 163, Florida Statutes, and the adopted Village
of Tequesta Comprehensive Plan, and such text amendments are attached as Exhibits "A"
and "B" of this Ordinance; and
WHEREAS, the Village Loca1 Planning Agency has reviewed the proposed amendments
to the Comprehensive Plan, and has recommended adoption; and
WHEREAS, the Village Cauncil, at a duly convened public adoption hearing, pursuant
to Chapter 163, Florida Statutes, has recEived the recommendation of the Loca1 Plarining
Agency, reviewed the proposed arnendments, and has found that the amendments further
the public health, safety and welfaxe; are consistent with the requirements of Chapter 163,
Flarida Statutes, and Chapters 9J-5 and 9J-11, Florida Administrative Code; and are
consistent with other elements of the Village Comprehensive Plan.
NOW, THEREFORE, BE IT ORDAINED BY TF� VII,LAGE COUNCII, OF
THE VII,LAGE OF TEQUESTA, FLORIDA AS FOLLOWS:
SECTION 1.: INCORPORATION OF RECITALS
The above recitals are incorporated as though fully set forth herein.
SECTION 2.: FINDINGS
The proposed Comprehensive Plan Amendments as more particularly described in
Exhibits "A" and "B" are determined by the Village Councit to be consistent with the
public health, safety, and welfare, consistent with the requirements of Chapter 163,
Florida Statutes, consistent with the requirements of Chapters 9J-5 and 9J-11, Florida
Administrative Code, and consistent with all elements of the adopted Village
Comprehensive Plan.
5ECTION 3.: AMENDMENT QF COMPREHENSIVE PLAN
The Village Camprehensive Plan is hereby amended to incorporate those
amendments set forth in E�ibit's "A" &"B" atta.ched hereto and incorporated herein by
this reference.
SECTION 4.: SEVEIiABILITY
, If any section, subsection, sentence, clause, ar phrase of this ordinance for any
reason, is held to be unconstitutional, vaid or otherwise invalid, the validity of the
remaining portions of this Ordinance shall not be effected thereby.
SECTION S.: EFFECTIVE DATE
This Ordinance sha11 become effective upon its adoption and passage by the
Village Council.
