The hearing was called to order at 10:02 A.M. A. Code Enforcement Special Master Torcivia approved the minutes of the August 24, 2000 hearing as submitted. B. Fine Imposition Hearings: Case No. 0013547 1Mlliam Richard Powers (5/1'i/64) 125 4th Street, #2 Jupiter, Florida 33458 FL DL P-620-963-64-171-0 SS #174-54-4699 Nature of Violation: Violation of Code of Ordinances of The Village of Tequesta, Florida. Chapter 9, Section 9-55. Schedule of User Fees, Page No. 539. The Respondent, W'illiam Richard Powers, was present at the hearing, and requested a fee payment plan be accepted by the Fire Department. Special Master Paul�tte Torcivia stayed the fine of five hundred five dollars ($505.00). Mr. Poweu will pay the original amount of three hundred thirty four dollars f$334.00) by October2�, 2000. Uponfull compliance, i.e., total payment of the amount owed to the Emergency Medical Transportation, Mr. Powers may request a reduction of fine. Conclusion of law was that Respondent remains in violation of Chapter 9, Section 9-55 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, William Richard Powers, shall reimburse the Village of Tequesta in the amount of three hundred thirtyfourdoiiars ($334.OEYjbythe dayofiOctober, 2000. Respondent'sfine of five hundred five dollars ($505.00) shall be stayed. If Respondent fails to comply within the time specifted�, the fine of twenty five dotta�s. ($25.00) per day shall continue for each day the violation exists. If Respo�dent fails to comply fully by October 25, 2000, the tv�nty five doliars ($25.0@� per day fine and the original fine of five hundred five dollars ($505.00) shall be reinstated. The Special Master found that Mr. and Mrs. French were not properly served with the Orders dated August 24, 2000 and that these Orders shall be sent certified mail to the correct address. Conclusion of law was that Respondents are in violation of Chapter 9, Section 9-55 of the Code of Ordinances of the Village of Tequesta. 2 Sp�ial Master Paulette Torcivia ordered that Respondents, Don and Stacey French, shall each reimburse the Village of Tequesta in the amount of One Hundred Thirty One Dollars and Tweniy Cents ($131.20) by the 6th day of October, 2000. Chapter 9, Section 9-55. Schedule of User Fees, Page No. 539. The Respondent, Stacey French, was not present at the hearing; however, there was a finding of proper notice. Tequesta Code Enforcement Officer Sgt. Irovando testified to the violation. Sgt. Irovando introduced as witnesses Elaine C. Hines of the Medical Claims Processors Group, Inc., and Alex fVathanson of the Tequesta Fire Rescue Department. Findings of fact were that the date of the medical transportation was November 2, 1997, and that the amount owed to the Village of Tequesta by Respondent is $65.60. Conclusion of law was that Respondent is in violation of Chapter 9, Section 9- 55 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Stacey French, shal{ reimburse the Village of Tequesta in the amount of sixty five do{lars and sixty 3 cents ($65.60) by the 8th day of September, 2000. If Respondent does not comply within the time specified, a fine of twenty five dollars ($25.00) per day shatf be assessed fior each day the violation continues to exist. Appendix A- Zoning, Section X, Suppiemental Regulations Applying to a Specific, to several or to all districts, (L) (2} Commercial Vehicles on Private Lots, Pages 1184, 1185. The Respondent, Wayne Shindoll, was present at the hearing. Tequesta Code Er�forcement Officer Davis testified to the violation. Conclusion of law was that Respondents are in violation of AppendixA, Section X(L)(2) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Leisa D. and Wayne Shindoll, shall comply with Appendix A, Section (X)(L)(2) of the Code of Ordinances of the Village of Tequesta by the 30th day of September, 2000. If Respondents do not comply within the time specified, a fine of fifty dollars ($50.0) per day shall be assessed for each day the violation continues to exist. Case No. 9924767 Sharon K. The Respondent, Sharon K. Kachur, was present at the hearing. Tequesta Code Enforcement Officer Davis testified to the violation. Prohibited, Page No. 259. 13 The Respondent, Bruce H. Berman, was present at the hearing and introduced documents showing the steps he is taking to contain the dogs on his property. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondent is in violation of Chapter 4, Article II, Section 4- 13, of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Bruce H. Berman, shall comply with Chapter 4, Article II, Sec. 4- 13, of the Code of Ordinances of the Viliage of Tequesta by September 30, 2000. If Respondent does not comply within the time specified, a fine fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist.
