The hearing was called to order at 10:09 A.PJI.
A. Code Enforcement Special Master Torcivia approved the minutes of the May 31,
2001 hearing as submitted.

The Respondents, Jon R. and Barbara A. Carpenter, were not present at the
hearing, but were represented by their agent. The Tequesta Code Enforcement
Officer testified to the violations.
Conclusion of law was that Respondents are in violation of Article V, Section 6-
81, (302.1 Sanitary Facilities, 305.161.1 Interior Floors, Walls and Ceilings,
Section 304, Minimum Requirements for Electrical Systems, Section 305.10,
Windows to be Openable, Section 305.11, Exterior poors, Section 305.20,
Interior poors, Section 305.2, Exterior Walls, Section 305.3 Roofs), of the Code
of Ordinances of the Village of Tequesta.
Special Master Glen Torcivia ordered that Respondents, Jon R. and Barbara A.
Carpenter, shall comply with Article V, Section 6-81, (302.1 Sanitary Facilities,
305.161.1 Interior Floors, Walls and Ceilings, Section 304, Minimum
Requirements for Electrical Systems, Section 305.10, Windows to be Openable,
Section 305.11, Exterior poors, Section 305.20, Interior poors, Section 305.2,
Exterior Walls, Section 305.3 Roofs), of the Code of Ordinances of the Village of
Tequesta by the 29th day of August, 2001.
If respondents do not comply within the time specified, a Fine Imposition Hearing
will be held before the Special Master on the 30th day of August, 2001, at 10:00
a.m., at the Wachovia Bank Building, 250 Tequesta Drive, Suite 300, Tequesta,
Florida.

The Respondents, Ralph J. and Sarah J. Hayes, were present at the hearing.
The Tequesta Code Enforcement Officer testified to the violation but advised that
they are now in compliance and requested that no fine be implied. The
respondents agreed that there was a violation.
Conclusion of law was that Respondents were in violation of Chapter 13,
Offenses and Miscellaneous Provisions, Section 13-31, Abandoned, wrecked,
etc., vehicles, machines, etc., of the Code of Ordinances of the Village of
Tequesta, said violation has been corrected.
Special Master Glen Torcivia ordered that Respondents, Ralph J. And Sarah
Hayes, are no longer in violation of Chapter 13, Offenses and Miscellaneous
provisions, Section 13-31 Abandoned, wrecked, etc., vehicles, machines, etc.,
of the Code of Ordinances of the Village of Tequesta.

Respondent Gerald R. Herd was represented at the hearing by his son, Benjamin
Herd. Tequesta Code Enforcement Officer Irovando testified to that Respondent
is in full compliance. It was agreed by the parties that future violations would be
considered repeat violations and that Respondents would be fined $5000 per
violation if there was another violation .
Conclusion of law was that Respondent was in violation of Appendix A-Zoning,
Section X, Supplemental Regulations Applying to a Specific, to Several or to All
Districts, (L) Commercial Vehicles on Private Lots (2), of the Code of Ordinances
of the Village of Tequesta; however, the violation has been corrected. It was
further ordered by the Code Enforcement Special Master Glen Torcivia that if
Respondent is found in repeat violation a fine of fifty dollars ($50.00) shall be
assessed for each day the violation continues to exist.

hearing; however, there was a finding of proper notice. Code Enforcement
Officer Sgt. John Irovando of Tequesta testified to the violations.
Conclusion of law was that Respondents are in violation of Chapter 12, Noise,
Sec.12-1, Prohibited. (2) Radios, phonographs, etc., of the Code of Ordinances
of the Village of Tequesta.

Special Master Glen Torcivia ordered that Respondents, Darrell D. and Heide A.
Pastuch, shall comply with Chapter 12, Noise, Sec. 12-1, Prohibited. (2) Radios,
phonographs, etc., ofi the Code of Ordinances of the Village of Tequesta. A fiine
of two hundred fifty dollars ($250.00) was assessed for the violations which shall
be paid by August 15, 2001. If there are any future violations, they will be treated
as repeat violations and fines of up to five hundred dollars ($500.00) per violation
may be assessed.

The Respondent, Kelly A. Tharp, was not present at the hearing, however there
was a finding of proper notice. Code Enforcement Officer Sgt. John Irovando
of Tequesta testified to the violations.
Conclusion of law was that Respondent is in violation of Chapter 12, Noise,
Section 12-1, Prohibited, of the Code of Ordinances of the Village of Tequesta.
Special Master Glen Torcivia ordered that Respondent, Kelly A. Tharp, shall
immediately comply with Chapter 12, Noise, Section 12-1. Prohibited, of the
Code of Ordinances of the Village of Tequesta by the 15th day of August, 2001.
A fine of one hundred dollars ($100.00) is hereby assessed for the violation that
has existed. If Respondent is found in future violation, a fine of two hundred fifty
dollars ($250.00) shall be assessed for each day the violation continues to exist.

Conclusion of law was that Respondent is in violation of Chapter 4, Animals and
Fowl, Article II, Dogs and Cats, Sec. 4-13, of the Code of Ordinances of the
Village of Tequesta.
Special Master Glen Torcivia ordered that Respondent, Bruce H. Berman, shall
immediately comply with Chapter 4, Animals and Fow1, Article II, Dogs and Cats,
Sec. 4-13, of the Code of Ordinances of the Village of Tequesta. A fine of twenty
five dollars ($25.00) is hereby assessed for the violation that has existed. If
Respondent is found in future violation, a fine of one hundred dollars ($100.00)
shall be assessed for each violation.
