John Irovando; Recording Secretary Betty Laur. The hearing was called to order at 10:OQ A.M. A. Code Enforcement Special Master Torcivia approved the minutes of the November 3Q, 2000 hearinq as submitted. B. Fine Imposition Heairings: �lone C. Violation Hearings: Case No. OQ21999 MP & Leona M. The Respondent, Leona M. Efthyvoulou, was present at the hearing and testified to the problem. Police Officer Davis testified to the violation. Conclusion of law was that Respondents are in violation of Chapter 4, Animals and Fowl, Article II, Dogs and Cats, Section 4-13, Running at Large, of the Code of Ordinances aF the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, M. P. and Leona M. Efthyvoulou, shall comply with Chapter 4, Animals and Fowl, Article II, Dogs and Cats, Section 4-13, Running at Large, of the Code of Ordinances of the Village of Tequesta by January 26, 2001. If Respondents do not comply within the time specified, a fine aF fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Case No. 9915118 William Gould 62 Woodland Drive Tequesta, Florida 33469 Legal: TEQUESTA PINES LT 76 6A-42-40-�5-Q00-0760 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Florida, Chapter 12, NOISE, Section 12-1. Prohibited. Pages 713, 714, 715, and 716. The Respondent, William Gould, was present at the hearing and testified to the close proximity of his back yard to a neighbor's bedroom. Ofificer Davis testified to the violation. Conclusion of law was that Respondent is in violation qf Chapter 12, Noise, Se�tion 12-1, of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, William Gould, shall comply with Chapter 12, Noise, Section 12-1, of the Code of Ordinances of the Villa�e of Tequesta by January 26, 2001. If Respondent does not comply within the time specified, a fine of up to fifty dollars ($50.00) per day shall be assessed for each day the v�olation continues to e�ast. 2 Case No. 0016746 Luis M. Blanca 372 Country Club Drive Tequesta, Florida 33469 Legal: TEQUESTA LT 136 60-42-40-26-01-000-1360 Nature of Violation: Violation af Code of Ordinances of the Village of Tequesta, Florida, Chapter 10, Health and Sanitation, Article II, Weeds, Undergrowth and Other Plant Life, Sec. 10-18. Unlawfu{ growth enumerated. (a), pages No. 582, 583. The Respondent, Luis M. Blanco, was not present at the hearing, however, there was a finding of proper notice. Officer Davis testified to the ongoing violation and that the Village had the grass cut at the property and the cost was $75.00. Conclusion of law was that Respondent remains in violation of Chapter 10, Health and Sanitation, Article II, Weeds, Undergrowth and Other Plant Life, Section 10-18, of the Code of Ordinances of the Village of Tequesta. Sp�ial Master Paulette Torcivia ordered that Respondent, Luis M. Blanco, shall comply with Chapter 10, Health and Sanitation, Article II, Weeds, Undergrowth and Other Plant Life, Section 10-18, of the Code of Ordinances of the Vilfage of Tequesta. Afine of Qne thousand three hundred fifty dollars ($1,350.00) was assessed for the violation that has existed. The fine was imposed for the period from D�ember 5, 2000 through January 25, 2001, and will continue to accrue at twenty five dollars ($25.00) per day for each day the violation continues fio exist. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation e�asted and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes, for the original amount. The Respondents, Kevin S. and Patricia L. Kinnebrew, were not present at the hearing; however, there was a finding of proper notice. Police Officer Davis testified to th� violation. Kinnebrew, shall comply with Chapter 4, Animals and Fowt, Article II, Dogs and Cats, Section 4-13, Running at Large, of the Code of Ordinances of the Village of Tequesta by January 26, 2001. If Respondents do not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Case No. 0019568 Kelly A. Tharp 93 Hickory Hill Road Tequesta, Florida 33469 Legal: TEQUESTA PINES LT 97 60-42-40-25-25-000-Q97Q Nature of Violation: Violation of Code of Ordinance� of the Village of Tequesta, Florida, Chapter 12, NOISE, Section 12-1. Prohibited. Pages 713, 714, 715, and 716. The Respondent, KellyA. Tharp, was not present at the hearing ; however, there was a finding of proper notice. OfFicer Davis testified to and produced photographs of the violation. 4 Conclusion of law was that Respondent is in violation ofi Chapter 12, Noise, Section 12-1, of the Code of Ordinances af the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Kelly A. Tharp, shall comply with Chapter 12, Noise, Section 12-1, of the Code aF Ordinances of the Village af Tequesta by January 26, 2001. If Respondent does not comply within the time specified, a fine of one hundred dollars ($100.00) per day shall be assessed for each day the violation eontinues to exist. D. St�tus Hearings: None E. Fine Reduction Hearings: Case No. 0013541 � 0013542 Don � Stacey French 2057 Joy Rena Lane Juno Beach, Florida 33408 Legal : 00-43-42-05-09-000-0030 Nature of Violation: Violation of Code of Qrdinances of the Village of Tequesta, Florida, Chapter 9, Section 9-55, Schedule of User Fees, Page No. 539. The Respondents, Don and Stacey French, were not present at the hearing; however, there was a finding of proper notice. Officer Davis testified that the Respondents are in full compliance. Conclusion of law was that Respondents, Don & Stacey French, are no longer in violation of Chapter 9, Section 9-55, of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that the Respondents' fine shall be reduced to zero from the original amount af two thousand dollars ($2,000.00}. Case No. 0013533 Connie AI-Oiry (4/26/63) 5 1015 Green Pine Blvd, #C2 West Palm Beach, Florida 33409 FL DL A-460-113-63-646-0 SS# 439-33-8511 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Florida, Chapter 9, Section 9-55, Schedule of User Fees, Page No. 539. The Respondent, Connie AI-Oiry, was not present at the hearing; however, there was a findin� of proper notice. Officer Davis testified that the Respondent is in full compliance. Conclusion of lawwas that Respondent, ConnieAl-Oiry, is no longer in violation of Chapter 9, Section 9-55, of the Code af Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that the Respondent's fine shall be reduced to zero from the original amount of five hundred dollars ($500.00). F.
