HomeMy WebLinkAboutResolution_17-14_06/12/2014 RESOLUTION NO 17 -14 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, DECLARING CERTAIN PROPERTY TO BE SURPLUS AND DIRECTING THE VILLAGE MANAGER TO DISPOSE OF SURPLUS PROPERTY IN ACCORDANCE WITH THE VILLAGE'S ADOPTED PROCEDURES; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the Village Council of the Village of Tequesta, Florida, established procedures for disposing of surplus Village property; and WHEREAS, the Village of Tequesta owns a property as described in Exhibit "A" attached hereto; and the property is no longer in use; WHEREAS, the Village Council declares the property as described in Exhibit "A" to be surplus property and directs the Village Manager to dispose of the surplus property in accordance with the Village's adopted procedures; and WHEREAS, the Village finds that this Resolution will promote the health, safety and welfare of the Village NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1: The Village Council of the Village of Tequesta, Florida, hereby declares the property attached in Exhibit "A ", to be surplus and directs the Village Manager to dispose of the surplus property as described in Exhibits "A" in a manner consistent with the Village's adopted procedures. Section 2: All resolutions or parts of resolutions in conflict herewith shall be and hereby are repealed. Section 3: This Resolution shall take effect immediately upon passage. The foregoing Resolution was offered by Council Member D'Ambra who moved its adoption. PURPOSE The purpose of these Administrative Policies and Procedures ("APP'� is to establish an effecctivve Vllage surplus property disposal program. This program is established in the interest of efficiency and economy. These Administrative Pollcles and Procedures are promulgated under the authority of the Village Charter, SecUon 3.03. 2. AUTHORITY As established in the vllage Charter Sedion 3.03 (8), the vllage Manager shall conduct all sales of personal properly whlch the Council may authorize to be sold as having become unnecessary or unfit for vllage use. All purchases and sales ahall �nform to such regulations as the Vllage Council may from time to time prescribe. 3. DEFINITION OF SURPLUS PROPERTY A. Personal properly not needed for V Ilage service or not ffi for Its Intended purpose. B. Useble material, equipment, or parts, including capitelized equipment, that exceed the normal malntenance, repair, and operating requiremerrts of a deperhnenUdivision. C. Obsolete material and equipment that cannot be used In the service for whlch it was purchased and cannot be utllized safely or economically for any other purpose. D. Scrap metel and weste material such as paper, rags, rubber, and wood. E. Property recovered, found, and unclaimed by the Vllage Police Departrnerrt in complian� with Florida Statutes. 4. METHODS A. Trer�sfer to Another Departrnent • Only property, which is in workable, safe, and satisfactory condltion, may be transferred to another departrnent B. Trade-in • Surplus, property may be exchanged as trade-in value on the acquisition of new properly. C. Retum to the Manufacturer • Surplus items may be retumed to the manufacturer for buy-back or crediL D. Audions • Vllage surplus property may be sotd at aucdon. E. Competidve Sealed BidslProposals • Per Vfllage current sealed bid procedures. F. Sell Tor Scrap • Scrap sales shall be made by the most efficient and economic means available. G. Dispose as Junk • When Vllage surplus property is damaged or unsafe, and/or when the cost af locating a buyer is estimeted to exceed the projected revenue of the item, the properly may be destroyed or disposed of as junk. H. Gift . Vllage surplus property may be given away to any organizadon in compliance with Florlda Statutes and locel ethics rules. I. Negotiated Sale • Surplus property may be negotiated and sold outright if no more than one buyer is available and/or if negotlated sale is in the best interest of the vllage. 5. "As Is" Surplus property shall be sold "as is" and 'where is." The Village does not make any warranty, guarantee, or representation of any kind, expressed or imptied, as to the condition, utility, or usability of the properly offered for sale. 6. REVENUES FROM THE SALE OF SURPLUS PROPERTY Revenue from the sale of surplus property will be returned to the appropriate revenue fund. 7. PROCEDURES FOR DISPOSING OF SURPLUS PROPERTY Once a determination is made by a deparlment head/director to purge surplus property, a"Request to TransfeNRetire Surplus Properiy' fortn is to be compteted and forwarded to the finance department The finance departrnent will prepere a resolution requ�ting the vllage Council to approve the surplus of properiy. After approval of the vllage Council, the surplus property will be disposed of by the vllage Manager in accordance with the above procedures. 8.EMPLOYEES PARTICIPATING IN THE PURCHASE OF SURPLUS PROPERTY The vllage Manager, vllage Attamey, and members of the Village Council shall not participate in the purchase of Village surplus property. Vllage employees may purchase surplus property either through auction or by submittal of sealed bids only if they were not involved in declaring such property surplus or in decisions regarding such property being declared surplus.
