John Irovando; Recording Secretary Betty Laur. The hearing was called to order at 10:00 A.M. A. Code Enforcement Special Master Torcivia approved the minutes of the April 26, 2001 hearing as submitted. B. Fine Imposition He�rings: None C. Status Hearings: Case No. 0129114 Andrew Zaino et al 801 U.S. Highway 1 Tequesta, Florida 33469 Legal: 60-43-40-30-02-003-0010 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Florida, Chapter 6, Buildings and Building Regulations, Article II, Buildings, Sec. 6-21, Standard Building Code-Adopted, Page No. 363. (Section 1035 Unsafe Buildings or Systems, Section 103.6 Debris in Yard, Section 104.6.1 Job Site Has Been Abandoned. The Respondent, Mrs. Marilyn Zaino, was present at the hearing and testified that she would be selling the property in sixty (60) days. Mrs. Zaino testified further that she was willing to demolish the old deli building and repair the fence to keep the property in a safe condition. Jeffrey C. Newell, Director of the Department of Community Development for the Village of Tequesta, testified that this plan would be acceptable to the Village. He testified further that he would expedite all the necessary permits so this property could be secured quickly. Conclusion of law was that Respondent is in violation of Chapter 6, Building Regulations, Article II, Buildings, Section 6-21, Standard Building Code Adopted, (Section 103.5), Unsafe Buildings or Systems, Section 103.6, Debris in Yard, Section 104.6.1, Job Site Has Been Abandoned), of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Andrew Zaino et al, shall comply with Chapter 6, Building Regulations, Article II, Buildings, Section 6-21, Standard Building Code Adopted, (Section 103.5), Unsafe Buildings or Systems, Section 103.6, Debris in Yard, Section 104.6.1, Job Site Has Been Abandoned), of the Code of Ordinances of the Village of Tequesta. in the following manner: Mrs. Zaino shall demolish the deli and erect/re-erect a proper surrounding fence by June 15, 2001, or a fine of one hundred dollars ($100.00) per day shall be assessed for each day the violation continues to exist. Mrs. Zaino will not be responsible for a fine if the Village holds up the permitting process. A Status Hearing will be held before the Special Master on the 30th day of August, 2001, at 10:00 a.m. at the Wachovia Bank Building, 250 Tequesta Drive, Suite 300, Tequesta, Florida. It will not be necessary for Mrs. Zaino to appear if she has sold her property and faxed the closing documents to the Village Code Enforcement Department. D. Violation Hearings: Case No. 0132804 Lighthouse Cove Apts LTD (Florida Club) 230 Village Blvd Tequesta, Florida 33469 2 SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTE5 May 31, 2001 Legal : 60-43-40-30-45-000-0000 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Fiorida, Chapter 18, Water, Sec. 18-22. Restriction or curtailment of water usage, Page No. 1054, 1055. The Respondent, Lighthouse Cove Apts., LTD, was represented at the hearing by Margaret Kline, property manager, and Luis Dominguez. Code Enforcement Officer Sgt. John Irovando of Tequesta testified to the violations. Conclusion of law was that Respondent is in violation of Chapter 18, Water, Sec. 18-22, restriction or curtailment of water usage, of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Lighthouse Cove Apts., LTD, shall comply with Chapter 18, Water, Sec. 18-22, restriction or curtailment of water usage, of the Code of Ordinances of the Village of Tequesta by the 1 sth day of June, 2001. If Respondent does not comply within the time specified, a fine of up to two hundred fifty dollars ($250.00) per day, five hundred ($500.00) per day for repeat violations, may be assessed for each day the violation continues to exist. Case No. 01000280 Christopher D. Sharpe Terri A. Sharpe (Owner) 359 Mars Avenue Tequesta, Florida 33469 Legal: JUPITER IN THE PINES SEC D LOT 16 BLK 33 60-43-40-30-04-033-0160 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Florida, Chapter 3 SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES May 31, 2001 12, NOISE, Sec. 12-1. Prohibited, Pages No. 713, 714, 715, 716. The Respondents, Christopher D. and Terri A. Sharpe, were present at the hearing. Code Enforcement Officer Sgt. John Irovando of Tequesta testified to the violations. Conclusion of law was that Respondents are in violation of Chapter 12, Noise, Sec.1201, Prohibited, of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Christopher D. and Terri A. Sharpe, shall immediately comply with Chapter 12, Noise, Sec.1201, Prohibited, of the Code of Ordinances of the Village of Tequesta. Respondents shall be assessed a fine of two hundred and fifty dollars ($250.00) to be paid in full by June 14, 2001, or a fine of one hundred dollars ($100.00) per day shall be assessed for each day the violation continues to exist. Case No. 0132427 Robert M. and Melissa M. Miller 80 Willow Road Tequesta, Florida 33469 Legal: RIDGEWOOD HOMES SEC 2 LT 76 60-43-40-30-06-000-0760 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Florida, Chapter 4, Animals and Fowl, Sec 4-13, Running at large prohibited, Page No. 259. The Respondent, Robert M. Miller, was present at the hearing. Code Enforcement Officer Sgt. John Irovando of Tequesta testified to the violations. Conclusion of law was that Respondent is in violation of Chapter 4, Animals and Fowl, Sec. 4-13, running at large prohibited, of the Code of Ordinances of the Village of Tequesta. 4 SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES May 31, 2001 Special Master Paulette Torcivia ordered that Respondents, Robert M. and Melissa M. Miller, shall immediately comply with Chapter 4, Animals and Fowl, Sec. 4-13, running at large prohibited, of the Code of Ordinances of the Village of Tequesta. If Respondent does not comply within the time specified, a fine of one hundred dollars ($100.00) per day shall be assessed for each day the violation continues to exist. Case No. 0132427 Kelly A. Tharp 93 Hickory Hill Road Tequesta, Florida 33469 Legal: TEQUESTA PINES LOT 97 60-42-40-25-25-000-0970 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Florida, Chapter 4, Animals and Fowl, Sec 4-13, Running at large prohibited, Page No. 259. The Respondent, Kelly A. Tharp, was not present at the hearing, however there was a finding of proper notice. Code Enforcement Officer Sgt. John Irovando of Tequesta testified to the violations. Conclusion of law was that Respondent is in violation of Chapter 4, Animals and Fowl, Sec. 4-13, running at large prohibited, of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Kelly Tharp, shall immediately comply with Chapter 4, Animals and Fowl, Sec. 4-13, running at large prohibited, of the Code of Ordinances of the Village of Tequesta. If Respondent does not comply with9n the time specified, a fine of one hundred dollars ($100.00) per day shall be assessed for each day the violation continues to exist. E.
