MINUTES
August 30, 2001
PRESENT: Special Master Paulette Torcivia; Police Officer Richard Davis sitting in for
Code Enforcement Officer Polic� Sgt. John Irovando; Recording Secretary
Betty Laur.
The hearing was called to order at 10:00 A.M.
A. Code Enforcement Special Master Torcivia approved the minutes of the July 26,
2001 hearing as submitted.
B. Violation Hearings:

Recreational Vehicles on Private Lots.

The Respondent, Julie Beaumont, was present at the hearing. The Tequesta
Code Enforcement Officer testified to the violations.
Conclusion of law was that Respondents are in violation of Appendix A-Zoning,
Section X, Supplemental Regulations Applying to a Specific, to Several or to all
Districts, (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private
Lots. (1), Page No. 1184 of the Code of Ordinances of the Village of Tequesta.
Special Master Paulette Torcivia ordered that Respondent, Julie Beaumont, shall
immediately comply with Appendix A-Zoning, Section X, Supplemental
Regulations Applying to a Specific, to Several or to all Districts, (L) Commercial
Vehicles and Trucks, Recreational Vehicles on Private Lots. (1), Page No. 1184
of the Code of Ordinances of the Village of Tequesta.
If respondents do not comply within the time specified, a fine of fifty dollars
($50.00) per day shall be assessed for each day the violation continues to exist.

Prohibited, (2) Radios, phonographs,
etc. Page No. 713.
The Respondent, Darrell D. Pastuch, was present and testified at the hearing.
Respondent submitted a Motion to Dismiss. The Special Master denied the
motion. The Tequesta Code Enforcement Officer Davis testified to the repeat
violation.
Conclusion of law was that Respondents are in violation of Chapter 12, Noise,
Sec. 12-1, Prohibited. (2) Radios, phonographs, etc., of the Code of Ordinances
of the Village of Tequesta.
Special Master Paulette Torcivia ordered that a fine of two hundred fifty dollars
($250.00) shall be assessed in accordance with the Code of Ordinances of the
Village of Tequesta This amount is to be paid by September 28, 2001.

A copy of this Order shall be recorded in the Public Records of Palm Beach
County, Florida, and, once recorded, shall constitute a lien against the property
of the original amount upon which the violation existed and upon any other real
or personal property owned by the Respondents, pursuant to Chapter 162,
Florida Statutes for the original amount.

The Respondent, Edward Sturges, was present and testified at the hearing.
Code Enforcement Officer Davis of Tequesta testified to the violation.
Conclusion of law was that Respondent is in violation of Chapter 10, Health and
Sanitation, Article II, Weeds, Undergrowth and Other Plant Life, Sec. 10-18.
Unlawful growth enumerated. (A) pages No. 582, 583.
Special Master Paulette Torcivia ordered that Respondent, Edward Sturges, shall
comply with Chapter 10, Health & Sanitation, Article I I, Weeds, Undergrowth and
Other Plant Life, Sec. 10-18. Unlawful growth enumerated. (A) pages No. 582,
583 by the 1 st day of September, 2001. If Respondent does not comply within
the time specified, a fine of twenty five dollars ($25.00) per day shall be assessed
for each day the violation continues to exist.

hearing. The Tequesta Director of Community Development, Jeffrey Newell,
testified that the property is now in compliance.
Conclusion of law was that Respondents are no longer in violation of Chapter
6, Article V, Section 6-81, Code Adopted, Page No. 367 (302.1 Sanitary
Facilities, 305.161.1 Interior Floors, Walls and Ceilings, Section 304, Minimum
Requirements for Electrical Systems, Section 305.10, Windows to be Openable,
Section 305.11, Exterior poors, Section 305.20, Interior poors, Section 305.2,
Exterior Walls, Section 305.3 Roofs), of the Code of Ordinances of the Village of
Tequesta.

The Respondent, Kelly A. Tharp, was not present at the hearing, however there
was a finding of proper notice. Code Enforcement Officer Davis of Tequesta
testified to the ongoing violation.
Conclusion of law was that Respondent is in violation of Chapter 12, Noise,
Section 12-1, Prohibited, Pages 713, 714, 715, and 716 of the Code of
Ordinances of the Village of Tequesta.
Special Master Paulette Torcivia ordered that Respondent, Kelly A. Tharp, shall
immediately comply with Chapter 12, Noise, Section 12-1. Prohibited, Pages
713, 714, 715, and 716 of the Code of Ordinances of the Village of Tequesta.
A fine of one hundred dollars ($100.00) has been assessed for the violation that
has existed.
A certified copy of this Order shall be recorded in the Public Records of Palm
