John Irovando; Recording Secretary Betty Laur. The hearing was called to order at 10:00 A.M. A. Code Enforcement Special Master Torcivia approved the minutes of the August 30, 2001 hearing as submitted. B. Violation Hearings: Case No. 0141072 Carlos & Gladys Anteo 45 Willow Road Tequesta, Florida 33469 Legal: RIDGEWOOD HOMES SEC 4 LT 109 60-43-40-30-09-000-1090 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Florida, Chapter 4, ANIMALS AND FOWL ARTICLE II Dogs and Cats, Sec, 4-, 13, Running at Large, Prohibited, Page No. 259. The Respondent, Carlos Anteo, and his daughter, Carolina Anteo, were present at the hearing. The Tequesta Code Enforcement Officer testified to the violations. Conclusion of law was that Respondents are in violation of Ordinances of the Village of Tequesta, Florida, Chapter 4, Animals and Fowl Article II, Dogs and Cats, Sec, 4-, 13, Running at Large, Prohibited, Page No. 259 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Carlos and Gladys Anteo, shall comply with Chapter 4, Animals and Fowl Article I I, Dogs and Cats, Sec, 4-, 13, Running at Large, Prohibited, Page No. 259 of the Code of Ordinances of the Village of Tequesta. If respondents do not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Case No. 0127024 David L. Rhoten Karen E. Oteri (Owner) 327 Country Club Drive Tequesta, Florida 33469 Legal: TEQUESTA LOT 125 60-42-40-26-01-000-1250 Nature of Violation: Repeat Violation of Code of Ordinances of the Village of Tequesta, Florida, Appendix A-Zoning, Section X, Supplemental RegulationsApplying to a Specific, to Several or to all Districts, (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots. (3), Page No. 1185. The Respondents, David L. Rhoten and Karen E. Oteri, were present at the hearing. The Tequesta Code Enforcement Officer Davis testified to the repeat violation. Conclusion of law was that Respondents are in repeat violation of Appendix A- Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several �r to all Districts, (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots. (3), Page No. 1185. Special Master Paulette Torcivia ordered that respondents David L. Rhoten and Karen E. Oteri shall continue to comply with Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several or to all Districts, (L) 2 Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots. (3), Page No. 1185. A fine of one hundred fifty dollars ($150.00) shall be assessed for this repeat violation. This fine shall be paid by October 12, 2001. A copy of this Order shall be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes for the original amount. Case No. 0135820 Natalie Digioia 305 Country Club Drive Tequesta, Florida 33469 Legal: TEQUESTA LT 213 60-42-40-26-01-000-2130 Nature of Violation: Repeat Violation of Code of Ordinances of the Village of Tequesta, Florida, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several or to all Districts, (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots. (3), Page No. 1185. The Respondent, Natalie Digioia, was present and testified at the hearing. The Code Enforcement Officer of Tequesta testified to the violation and provided photographs of the violations.. - Conclusion of law was that Respondent is in violation of Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several or to all Districts, (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots. (3), Page No. 1185, of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Natalie Digioia, shall comply with Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several or to all Districts, (L) Commercial Vehicles and Trucks, 3 Recreational Vehicles on Private Lots. (3), Page No. 1185 by the 28th day of September, 2001. If Respondent does not comply within the time specified, a fine of one hundred dollars ($100.00) per day shall be assessed for each day the violations continue to exist. Case No. 0011186 James C. Greer Paul H. and Edith I. Roora (Owner) 4 Ridgewood Circle Tequesta, Florida 33469 Legal: RIDGEWOOD HOMES LOT 1 60-42-40-25-09-000-0010 Nature of Violation: Violation of Code of Ordinances of the Village of Tequesta, Florida, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several or to all Districts, (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots. (3), Page No. 1184. The Respondents, James C. Greer and Paul H. and Edith I. Roorda, were not present at the hearing, however, there was a finding of proper notice. Tequesta Code Enforcement Officer Sgt. Irovando testified to the violation. Conclusion of law was that Respondents are in violation of Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several or to all Districts, (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots. (3), Page No. 1184 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that respondents James C. Greer and Paul H. and Edith I. Roorda shall comply with Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several or to all Districts, (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots. (3), Page No. 1184 of the Code of Ordinances of the Village of Tequesta by the 28th day of September, 2001. If respondents do not comply within the time specified, A fine of one hundred dollars ($100.00) shall be assessed for each day the violations continue to exist. 4 C. Fine Imposition Hearing: Case No. 0136110 Darrell D. & Heide A. Pastuch 391 Riverside Drive Tequesta, Florida 33469 Legal: JUPITER IN THE PINES SEC B N1/20FLT5&LT7BLK19 60-42-40-25-06-016-0051 Nature of Violation: Repeat Violation of Code of Ordinances of the Village of Tequesta, Florida, Chapter 12, noise, SEC 12-1. Prohibited, (2) Radios, phonographs, etc. Page No. 713. The Respondents, Darrell D. Pastuch and Heide A. Pastuch, were not present at the hearing; however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the ongoing violations. Conclusion of law was that Respondents remain in violation of Chapter 12, Noise, Sec. 12-1, Prohibited. (2) Radios, phonographs, etc., of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Darrell D. Pastuch and Heide A. Pastuch shall immediately comply with Chapter 12, Noise, Sec.12- 1, Prohibited (2) Radios, phonographs, etc., of the Code of Ordinances of the Village of Tequesta. A fine of two hundred fifty dollars ($250.00) was assessed for the violations that have existed. A certified copy of this Order shall be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes for the original amount. \ 5 D.
