The Code Enforcement Board of the Village of Tequesta held a regularly scheduled meeting at the Vill�age Hall, 357 Tequesta Drive, Tequesta, Florida, on Tuesday, August 3, 1993. The meeting was called to order at 7:35 P.M. by Chairman Paul Brienza. A roll call was taken by Fran Bitters, the Recording Secretary. Boardmembers present were: Chairman Paul Brienza, Tim Goldsbury, Mitchell Miller, Jeffrey Vorpagel and Michelle Tumlin. Also in attendance were: Sco�tt Ladd, Clerk of the Board, Steven Kennedy, Code Enforcement Officer, and John C. Randolph, Village Attorney. II. APPROVAL OF AGENDA Boardmember Vorpagel moved that the Agenda be approved as submitted. Boardmember Tumlin seconded the motion. The vote on the motion was: Paul Brienza - for Jeffrey Vorpaqel - for Mitch Miller - for Michelle Tumlin - for Tim Goldsbury - for the motion was therefore passed and adopted and the Agenda was approved as submitted. APPROVAL OF PREVIOIIS MEBTING MINIITES (July 6, 1993) Boardmember Miller moved that the Code Enforcement Board Meeting Minutes of July 6, 1993 be approved as submitted. Boardmember Goldsbury seconded the motion. The vote on the motion was: Paul Brienza - for Jeffrey Vorpaqel - for Mitch Miller - for Michelle Tumlin - for Tim Goldsbury - for the motion was therefore passed and adopted and the Aqenda was approved as submitted. IV. SWEARING IN OF CODL ENFORCEMENT OFFICER Clerk of the Board, Scott Ladd, swore in the Code Enforcement Officer. V. PUBLIC HFARINGS 1. Case No. 93-05: Jo Collins, Vidcom Corporation, for a violation at 222 II.S. One, South, Tequesta. Violation of Appendix A, Zoninq, Bection %(0), Villaqe Code of ordinances. The Code Enforcement Officer (CEO) explained that this case concerns a satellite dish which was erected without a permit. All approval processes have now been met, the permit has been issued, and the CEO recommended that the Board dismiss the case. Boardmember Vorpagel moved that the Board accept the CEO's recommendation that Case No. 93-05 has come into compliance, and therefore be dismissed. Boardmember Goldsbury seconded the motion. The vote on the motion was: Paul Brienza - for Jeffrey Vorpaqel - for Mitch Miller - for Michelle Tumlin - for Tim Goldsbury - for the motion was therefore passed and adopted. Code Enforcement Board Meetinq Minutes Auqust 3, 1993 Paqe 3 ------------------------------- 2. Case No. 93-06: Timothy Plant & Peqqy Sundermeyer, 93 Hickory Hill Road, Tequesta. Violation of Appendiu A, Zoninq, Bection B(E)(5), Villaqe Code of Ordinances. The CEO explained that the violation was a swimming pool which was not properly enclosed. The pool has now come into compliance and the CEO recommended that the case be dismissed. Boardmember Tumlin moved that the Board accept the CEO's recommendation that Case No. 93-06 has come into compliance, and therefore be dismissed. Boardmember Miller seconded the motion. The vote on the motion was: Paul Brienza - for Jeffrey Vorpaqel - for Mitch Miller - for Michelle Twnlin - for Tim Goldsbury - for the motion was therefore passed and adopted. 3. Case No. 93-07: Gerald J. & Greqory J. Maltese, 154 Chapel Lane, Tequesta. Violation of Chapter 10, Article II, Health and Sanitation, Section 10-18(e), villaqe Code of Ordinances. The CEO explained that the owner in the above-referenced case has not yet received Notice of Hearing and therefore recommended that Case No. 93-07 be continued to the Code Enforcement Board Meeting of September 14, 1993 at 7:30 p.m. Boardmember Goldsbury moved that Case No. 93-07 be continued to September 14, 1993 at 7:30 p.m. Boardmember Tumlin seconded the motion. The vote on the motion was: Paul Brienza - for Jeffrey Vorpaqel - for Mitch Miller - for Michelle Tumlin - for Tim Goldsbury - for the motion �as therefore passed and adopted. Violation of Appendix A, Zoninq, section u(E)(5) villaqe Code of ordinances. The CEO explained that this case involves a swimming pool not having an enclosure. A permit has been issued to erect the enclosure and the CEO e�ects compliance will be met within a few days, recommending that the Board continue Case No. 93- 08 to September 14, 1993 at 7:30 p.m. Boardmember Tumlin moved that Case No. 93-07 be continued to September 14, 1993 at 7:30 p.m. Boardmember Miller seconded the motion. The vote on the motion was: Paul Brienza - for Jeffrey Vorpaqel - aqainst Mitch Miller - for Michelle Tumlin - for Tim Goldsbury - for the motion was therefore passed and adopted. Boardmember Vorpagel stated that he voted against because there was no assurance that the owners would comply within a few days. 5. Case No. 93-09: Rita G. Walters, 370 Maple Avenue, Tequesta. violation of Appendix A, Zoninq, Section X (E)(5), Villaqe Code of Ordinances. The CEO explained that the owner in the above-referenced case has not yet received Notice of Hearing and therefore recommended that Case No. 93-09 be continued to the Code Enforcement Board Meeting of September 14, 1993 at 7:30 p.m. Boardmember Tumlin moved that Case No. 93-09 be continued to September 14, 1993 at 7:30 p.m. Boardmember Vorpagel seconded the motion. The vote on the motion was: Paul Brienza - for Jeffrey Vorpaqel - for Mitch Miller - fpr Michelle Tumlin - for Tim Goldsbury - for the motion was therefore passed an8 adopted. Violation of Chapter 6, Article V, Standard Housinq Code, Section 103.2.1, Villaqe Code of Ordinances. The CEO explained that the owner in the above-referenced case has not yet received Notice of Hearing and therefore recommended that Case No. 93-10 be continued to the Code Enforcement Board Meeting of September 14, 1993 at 7:30 p.m. Boardmember Tumlin moved that Case No. 93-10 be continued to September 14, 1993 at 7:30 p.m. Boardmember Vorpagel seconded the motion. The vote on the motion was: Paul Brienza - for Jeffrey Vorpaqel - for Mitch Miller - for Michelle Tumlin - for Tim Goldsbury - for the motion was therefore passed and adopted. 7. Case No. 93-11: Joseph Laduca, 50 Golfview Drive, Tequesta. Repeat Violation of Chapter 10, Article II, Health and Banitation, Section 10-18(a), Villaqe Code of ordinances. The CEO explained that Notice of Hearing was received on July 22, 1993, with a Police Report showing that the Hearing Notice was hand-delivered by a Tequesta police officer. Mr. Laduca was not present at tonight's hearing. This is Mr. Laduca's fourth violation of this Section of the Code (i.e., lawn not being maintained at less than 12 inches in height), for which he was found by the Board to be in violation on three previous occasions. On a previous violation there remains outstanding a$3,500 fine. The CEO explained that Mr. Laduca was cited on July 14 for being in violation, remained in violation until August 2, and recommended that the Board find him in violation for a 15- day period, with a fine imposed of $500/day ($7,500). There is presently a lien against the property. The motion died for lack of a second. Much discussion continued by the Board, with direction from the Village Attorney, as to what alternative measures might be taken with Mr. Laduca. Boardmember vorpaqel moved Mr. Laduaa be found in violation �rom July 14 tbrouqh Julp 31, Nith a fine imposed of $Z5o/day ($3,750), with lo$ ot the tine due ft paid within 3o days, and it not, then the tull $3,750 will be charqed. Boardmember Golclsburp seconded the motion. The vote on the motion was: Paul Brien$a - for Jeffrey vorpaqel - tor Mitch Miller - for Michelle Tumlin - for Tim Goldsbury - for the motion was therefore passed and adopted. VI. PREBENTATION OF NRW CABBS There were no new cases for presentation. VII. ANY OTHER MATTERS The Board discussed Section 10-19 and what they would recommend in the case of repeat violators - whether to take the action the Board is en�itled to take under Section 10-19 or to recommend to the Village Council to determine some alternative methods to be carried out by the Village Council. Attorney Randolph reminded the Board that the Village has the right to abate a nuisance, and further explained abatement procedures as documented under Section 10-19. . Code Enforcement Board Meetinq Minutes Auqust 3, 1993 Paqe 7 ------------------------------- Boarc3member Goldsbury moved that the Board recommend that the villaqe Council qive consideration to other abatement procedures (particularly with lawn problems) which are availahle to them pursuant to villaqe Code, section 10-19, as an alternative to cominq before the Code Enforcement Board, addressinq the Board�s concerns reqardinq repeat violators. Also, the Board requests that the Villaqe Council look into reducinq the timeframe involved with Section 10-19 (currently at 15 days). Boardmember Vorpaqel seconded the motion.
