ORDER

that Respondent, James Carey Dix, shall continue to comply with
Ord. No. 464, Appendix A-Zoning, Section X(L)(3), R1A, parking
restrictions, of the Village of Tequesta.

Ordinances of the Village of Tequesta.

accordance with Chapter 162, Florida Statutes, has heard testimony
at the Code Enforcement Hearing held on the 25th day of September,
1997, and based on the evidence and testimony presented, the
following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER are

FINDINGS OF FACT
1. Respondent, Franklin Credit Management Corporation,
was not present at the hearing, however, there was a finding of
proper notice.
2. Code Enforcement Officer testified to and produced
photographs of the violation. The officer explained the
Respondent's partial compliance, however, the pool needs to
complete its cleaning cycle.

CONCLUSIONS OF LAW
Respondent is in violation of the Code of Ordinances of the
Village of Tequesta, Ord. No. 355, Appendix A-Zoning, Section
X(E)(1)(5) swimming pool regulations, page 1173.
ORDER
It is the Order of the Code Enforcement Special Master
that Respondent, Franklin Credit Management Corporation, shall
comply with Ord. No. 355, Appendix A-Zoning, Section X(E) (1) (5),
R1A, swimming pool regulations, of the Village of Tequesta by the
9th day of October, 1997. Addtionally, this pool and enclosure are
to be maintained at all times.
If Respondent does not comply within the time specified,
a fine of up to two-hundred-fifty-dollars ($250.00) per day; five-
hundred-dollars ($500.00) per day for repeat violators, may be
assessed for each day the violation continues to exist.
If Respondent does not comply within the time specified,
a Fine Assessment Hearing will be held before the Special Master on
the 23rd day of October, 1997, at 10:00 a.m., at the Tequesta
Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida.
Should a dispute arise concerning compliance, either
party may request a hearing before the Special master on the issue
of compliance only.
Upon complying, it is the responsibility of the
Respondent to notify the Village of Tequesta Code Enforcement clerk
at (561) 575-6218 to request a reinspection of the property.

present at the hearing, hawever, there was a finding of proper
notice.
2. Code Enforcement Officer testified to non-compliance
and requested authorization for foreclosure.

CONCLUSIONS OF LAW
Respondent is in violation of the Code of Ordinances of the
Village of Tequesta, Ord. No. 355, Appendix A-Zoning, (E)(1)(5),
maintain and screening of pool, and Ord. No. 466, Section 10-18,
nuisance growth/over 12 inches.
ORDER
It is the Order of the Code Enforcement Special Master
that the Village of Tequesta's attorney may foreclose on the lien
for 347 Country Club Drive, Tequesta, Florida, Tequesta Lot 130.
