The Special Master appointed by the Village of Tequesta to
hear code enforcement cases for the Village of Tequesta, in
accordance with Chapter 162, Florida Statutes, has heard testimony
at the Code Enforcement Hearing held on the 23rd day of October,
1997, and based on the evidence and testimony presented, the
following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER are
hereby entered:
FINDINGS OF FACT
1. Respondent, Judith M. Fagan, was present at the
hearing and provided testimony.

2. The Village Code Inspector produced photographs and•
testified to the ongoing violation.
CONCLUSIONS OF LAW
Respondent is in violation of the Code of Ordinances of
the Village of Tequesta, Ord. No. 466, Section 10-18, nuisance
growth/over 12 inches.
ORDER
It is the Order of the Code Enforcement Special Master
that Respondent, Judith M. Fagan, shall comply with Ord. No. 466,
Sec 10-18 of the Village of Tequesta by the 30th day of October,
1997.
If Respondent does not comply within the time specified,
a fine of fifty dollars ($50.00) per day shall be assessed for each
day the violation continues to exist.
If the Respondent does not within the time
specified, an additional Fine Assessment Hearing will be held
before the Special Master on-the 25th day of November, 1997, at
10.00 a.m., at the Tequesta Village,Council Chambers, 357 Tequesta
Drive, Tequesta, Florida 33469.
This hearing will be continued next month on November 25,
1997, at 10:00 a.m. at 357 Teque�sta Drive,, 'I'equesta, Florida, to
determine the Respondent's compliance of Ord. No. 377, Appendix A
� Zoning, Section X, (H), general laridscape requirements at which
time the Respondent shall provide evidence of her solution to the
parking problem.
Upon complying, it is the responsibility of the
Respondent to notify the Village of Tequesta Code Enforcement clerk
at (561) 575-6218 to request a reinspection of the property.
DONE AND ORDERED this 23rd day of October, 1997.

The Special Master appointed by the Village of Tequesta
to hear code enforcement cases for the Village of Tequesta, in
accordance with Chapter 162, Florida Statutes, has heard testimony
at the Code Enforcement Hearing held on the 23rd day of October,
1997, and based on the evidence and testimony presented, the
following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER are
hereby entered:
FINDINGS OF FACT
1. The Respondents, W.A. and Hattie I. Siegel, were
present and represented by their attorney, Greg Taylon. Mr. Taylon
produced evidence and testimony.
2. The Code Inspector provided photographs, witnesses
and testified to the ongoing violation.

CONCLUSIONS OF LAW
Respondents are in violation of the Code of Ordinances of the
Village of Tequesta, Ord. No. 196, Sec 10-17.
ORDER
The Special Master finds that this violation does not
constitute a public nuisance, however, there is an excessive
accumulation of plant life.
It is the Order of the Code Enforcement Special Master
that Respondents, W.A. and Hattie I. Siegel, are to trim back and
weed their garden beds and ground cover. The Special Master had
recommended Mounts Botanical Garden and the Public Native Garden in
Palm Beach as resources to aid them in identifying weeds and
assist them in organizing their xeriscape as a manageable garden.
1) W.A. and Hattie I. Siegel shall trim the ground
cover, vegetation and trees that may be invading or
hanging over a neighbor's property.
2) W.A. and Hattie I. Siegel are to keep their yard
weed free and trimmed, particularly when they
leave their home for any time longer than one
month.
3) W.A. and Hattie I. Siegel shall ensure that their
compost bins shall not harbor any rodents. The
. measures that they shall utilize include:
1) removing the bins, or
2) hiring a pest control service on
a monthly basis to check the area, or
3) using compost bins with an enclosed
bottom and sides to ensure that rodents
cannot enter.
It is the Order of the Code Enforcement Special Master
that Respondents, W.A. and Hattie I. Siegel, shall comply with Ord.
No. 196, Section 10-17, of the Village of Tequesta by the 13th day
of November, 1997.
If Respondents do not comply within the time specified,
a fine of up to two-hundred-fifty-dollars ($250.00) per day; five-
hundred-dollars ($500.00) per day for repeat violators, may be
assessed for each day the violation continues to exist.

If Respondent does not comply within the time specified,
a Fine Assessment Hearing will be held before the Special Master on
the 25th day of November, 1997, at 10:00 a.m., at the Tequesta
Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida
33469.

1. Respondent, Steven J. Wille, was not present at the
hearing, however, there was a finding of proper notice.
2. Officer Irovando testified to the ongoing violation
of restricted parking of the pickup truck.
CONCLUSIONS OF LAW
Respondent is in violation of the Code of Ordinances of the
Village of Tequesta, Ord. No. 464, Sec X, (L)(3), parking R1A
restrictions.

ORDER
It is the Order of the Code Enforcement Special Master
that Respondent, Steven J. Wille, shall comply with Ord. No. 464,
Sec x, (1)(3), parking R1A restrictions, of the Village of
Tequesta.
If Respondent does not comply, a fine of up to two-
hundred-fifty-dollars ($250.00) per day; five-hundred-dollars
($500.00) per day for repeat violators, may be assessed for each
day the violation continues to exist.
