Address: 209 Tequesta Drive Tequesta, Florida Legal Description: 30-40-43, N210 FT OF S 1273 M46 FT OF ELY 100 FT OF WLY 508. 24DKT 33469 DIXIE HWY IN OR1532P170 (LESS S 5 FT TEQUESTA DR R/W) The Special Master appointed by the Village of Tequesta to hear code enforcement cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Enforcement Hearing held on the 29th day of January, 1998, and based on the evidence and testimony presented, the following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER are hereby entered: FINDINGS OF FACT 1. Respondent, Judith M. Fagan, was present at the hearing and testified to events to date. 2. Ms. Fagan has agreed to apply for landscape waiver and special permit for property. 3. The check for this permit was submitted to the Community Development Department and a copy was placed in the Village's files. � � CONCLUSIONS OF LAW Respondent is in violation of Ord. No. 377, Appendix A Zoning, Section X,(H), General Landscaping, of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Special Master, that, if a permit is not issued by the Village, Ms. Fagan must submit the required landscape plan to Community Development within seven (7) days of their denial of said permit. A twenty-five dollar ($25.00) a day fine shall be assessed for each day after the seven (7) day period until there is compliance. If the landscape plan is not approved, Ms. Fagan shall appear for a status hearing on the 26th day of February, 1998, at 10:00 a.m., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida. Should the Village fail to act upon this permit or landscape plan by the February hearing, Ms. Fagan need not attend the February hearing and instead appear on March 26, 1998, at 10:00 a.m. for the status hearing. Upon complying, it is the responsibility of the Respondent to notify the Village of Tequesta Code Enforcement clerk at (561) 575-6213 to request a reinspection of the property. The Respondent, Tequesta Shoppes Ltd., was not present at the hearing, however, there was a finding of proper notice. 2. The Code Officer testified that Respondent was presently working towards compliance. . �, r CONCLUSIONS OF LAW Respondent is in violation of the Code of Ordinances of the Village of Tequesta, Ord. No. 361, Section X(P) (3) (C) , location and screening of dumpsters. ORDER � It is the Order of the Code Enforcement Special Master that Respondent, Tequesta Shoppes Ltd., shall comply with Ord. No. 361, Section X(P)(3)(C), of the Village of Tequesta by the 6th day of February, 1998. If Respondent does not comply within the time specified, a fine of fifty-dollars ($50.00) per day shall be instituted until there is complete compliance. If Respondent does not comply within the time specified, a fine of up to two ($250.00) per day; five- hundred-dollars ($500.00) per day for repeat violators, may be assessed for each day the violation continues to exist. If Respondent does not comply within the time specified, a Fine Assessment Hearing will be held before the Special Master on the 26th day of February, 1998 at 10:00 a.m., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida. Upon complying, it is the responsibility of the Respondent to notify the Village of Tequesta Code Enforcement clerk at (561) 575-6213 to request a reinspection of the property.
