Hillcrest Drive Jupiter, Florida 33469 Legal Description: Jupiter Acres E1/ (24404200200000) The Special Master appointed by the Village of Tequesta to hear code enforcement cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Enforcement Hearing held on the 26th day of March, 1998, and based on the evidence and testimony presented, the following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER are hereby entered: FINDINGS OF FACT 1. Respondent, Deborah Uhland, was present at the hearing, and testified to the problem regarding Dusty, her dog. Special Master accepted into evidence proof of Dusty's up-to-date rabies vaccinations, in addition to the electronic yard system designed to contain dogs that was being installed on Ms. Uhland's property this day. 2. The Village proffered evidence of the violation. ,< CONCLUSIONS OF LAW Respondents are in violation of the Code of Ordinances of the Village of Tequesta, Ord. No. 511, Sec 4-13, Running-at-Large Prohibited. ORDER It is the Order of the Code Enforcement Special Master that Respondent, Deborah Uhland, shall comply with Ord. No. 511, Section 4-13, of the Village of Tequesta by the 28th day of March, 1998. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each time that this dog is apprehended by the Police Department or responsible authority, or otherwise violates this cordinace. Upon complying, it is the responsibility of the Respondent to notify the Village of Tequesta Code Enforcement clerk at (561) 575-6213 to request a reinspection of the property. Respondent, Frank O'Sullivan, was present at the hearing represented by his attorney, Richard Ellington, and requested an extension of time to comply. 2. Mr. Ladd, Tequesta's Building Official, testified to meeting with Respondent at property and reviewing the Village's requirements. CONCLUSIONS OF LAW Respondents, Leonhardt and Sullivan Associates, Inc., are in violation of Ord. No. 377, Appendix A-Zoning, Sec(X) (H) , General Landscaping Requirements. ORDER It is the Order of the Code Enforcement Special master that the Respondent, Mr. O'Sullivan, shall have submitted the required landscape p�lans to the Village of Tequesta's Building Department by May 15 1998. If these plans have not been submitted by the date specified, a hearing will be held before the Special Master on the 29th day of May, 1998, at 10.00 a.m., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Upon complying, it is the responsibility of the Respondent to notify the Village of Tequesta Code Enforcement clerk at (561) 575-6213 to request a reinspection of the property. Respondent, Judith M. Fagan, was present at the hearing and testified to activities completed towards compliance. 2. Mr. Ladd, Tequesta's Building Official, testified to Respondent's submission of required documents. � � ,: CONCLUSIONS OF LAW Respondent, Judith M. Fagan, is in violation of Ordinance No. 377, Appendix A-Zoning, Section X(H), General Landscaping Requirements of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Special Master that this case shall be continued until such time that the landscape plan has been approved. Upon complying, it is the responsibility of the Respondent to notify the Tequesta Code Enforcement Clerk at (561) 575-6213 to request a reinspection of the property.
