Address: 229 U.S. Highway No. 1 Tequesta, Florida Village 5quare Plaza Legal Description: Waterway Village, Lot A The Special Master appointed by the Village of Tequesta to hear code enforcement cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Enforcement Hearing held on the 20th day of March, 1997, and based on the evidence and testimony presented, the following FINDINGS OF FACT, CONCLU5IONS OF LAW, and ORDER are hereby entered: FINDINGS OF FACT 1. Respondent, Blockbuster Video, was not present at the hearing, however there was a finding of proper notice. 2. Officer Davis testified to and introduced into evidence documents pertaining to the ongoing violation. CONCLUSIONS OF LAW Respondent is in violation of the Code of Ordinances of the Village of Tequesta, ORD 435. Sec. 2.5-15, Alarm Permit. ORDER It is the Order of the Code Enforcement Special Master that Respondent, Blockbuster Video, shall comply with ORD 435, Sec. 2.5-15, Alarm Permit, of the Village of Tequesta by the 24th day of March, 1997. If Respondent does not comply within the time specified, a fine of $50.00 per day will be assessed for each day the violation continues to exist. If Respondent does not comply within the time specified, an additional Fine Assessment Hearing will be held before the Special Master on the 17th day of April, 1997, at 10.00 a.m., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Should a dispute arise concerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. Upon complying, it is your responsibility to notify the Village of Tequesta Code Enforcement clerk at (561) 575-6218 to request a reinspection of the property. Respondent, Thomas J. Little, testified and introduced into evidence numerous documents. He also requested a continuance of 120 days. 2. Officer Davis testified and introduced into evidence a photograph of the ongoing violation. He objected to the requested continuance. . . ORDER The Code Enforcement Special Master denied Mr. Little's request for a 120 day continuance. The hearing proceeded and will be continued at the next hearing scheduled for Thursday, April 17, 1997, at 10:00 a.m. Both parties shall submit to the Special Master any documents, memoranda of law, or other materials that they would like the Special Master to consider by Monday, April 14, 1997. Said submission shall be delivered to the Special Master at: 250 South Australian Avenue, Suite 1504, West Palm Beach, Florida 33401, with a copy of any such submission being provided to the other party. The pool is not being operated or maintained as required by ordinance. Further, from the front yard area, it is clear that the paol area is not protected properly from a child who might wander about and fall in. The area to the east side of the residence is required to have a child resistant barrier until such time that a more permanent structure Gould be built. Although you have moved, you rerr�ain responsible for the maintenance and upkeep of this property if in fact you are the properiy owners as listed in the County Tax Rolls. Therefor�, upon receipt of this notification you have 48 hours to correct the above described violations. Because I have no way to reach you, I will post the property and attempt delivery by certified mail. Failure to comply with this notice will result in charges being brought against you, and will require an appearance at a Special Master Hearing.
