Davis; Police Sgt. John Irovando; Police Lieutenant Robert Garlo; Recording Secretary Betty Laur. Meeting was called to order at 10:10 A.M. Fine Imposition Hearings: None Status Hearing: Case No. 96-05-018 Robert A. Walsh 8� Thomas A. Steen c/o Toyota, Tequesta Motor Cars, located at U.S. Highway #1, No. 746, Tequesta, Florida. Legal Description: 30 N 158 ft of S 800 of Gov Lt 1 W of SR5 � addl R/W (Less TR in OR950P192) Respondents Robert Walsh and Lynwood Spradlin were present at the hearing. Respondent Walsh provided an update of respondents' progress toward compliance. Cade Enforcement Officer Davis testified and introduced a video into evidence depicting non-complying property. Building Official Scott D. Ladd testified to the requirements and procedure for compliance. Special Master Code Enforcement Hearing Village of Tequesta June 26, 1997 Page 2 Conclusion of law was that respondents are in violation of the Code of Ordinances of the Village of Tequesta, Ordinance No. 377. Special Master Torcivia ordered that respondents, Robert A. Walsh and Lynwoad Spradlin, shall comply with the following three provisions: I. {a) Cut weeds. (b) Remove graffiti firom the exterior walls. (c) Remove concrete from the praperty. (If Respondents do not comply by Wednesday, July 2, 1997, a fine of $50.00 will be assessed for each day the violation continues to exist.) II, Respondents shall submit to the Department of Community Development the revised landscape plan by Wednesday, July 2, 1997. If Respondents do not comply a fine of $100.00 will be assessed for each day the violation continues to exist.) III. A permit shall be applied for by August 18, 1997, to begin work on the landscape. A Fine Assessment Hearing for non-compliance of any of the above provisions will be held before the Special Master on the 28th day of August, 1997, at 10:00 A.M. at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Should a dispute arise concerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. Upon complying, it is the responsibility of the Respondents to notify the Tequesta Code Enforcement Officer at (561) 575-6218 to request a reinspection of the property. Violation Hearing: Case No. 86-09-057 Richard A. Jones, President, Tequesta Commerce Center Condominium Association, In+c., 208 - 212 U.S. Highway No. One North, P.O. Box 24, Tequesta, Florida, Violation Tequesta Code of Ordinances, No. 377, Special Master Code Enforcement Hearing Village of Tequesta June 26, 1997 Page 3 Appendix A - Zoning, Landscape Requirements, beginning on page 1174. Legal Description: Tequesta Commerce Center Condominium ORB 4713P - 1025 Decl filed 10-9-85 in OR P1025 Officer Davis requested dismissal of this case since the Respondent had come into compliance. The Code Enforcement Special Master granted dismissal. Violation Hearing: Case No. 96-05-021 Robert J. Shaw, Plaza 222, Shaw Properties, Inc., Tequesta, FL. Legal Description: 30-40-43, S13.5 FT OF N 313 F7 OF ELY 259.f>7 FT & S 155.32 FT OF N 468.82 FT OF ELY 242.38 FT OF TH PT OF ELY 1/4 � GOV LT 4 LGY W OF US HWY 1& S OF BRIDGE ROAD. Violation: Tequesta Code of Ordinances, No. 377 Appendix A- Zoning, Landscape Requirements, beginning page 1174. Respondent Robert J. Shaw was present at the hearing. Code Enforcement Officer Richard F. Davis and Building �fficial Scott D. Ladd testified to the violation. Conclusion of Law was that Respondent is not in violation of the Code of Ordinances of the Village of Tequesta, Ordinance No. 377, Appendix A- Zoning, tandscape Requirements, because the Community Appearance Board and the Department of Community Development waived the Specia! Master Code Enforcement Hearing Village of Tequesta June 26, 1997 Page 4 requirement of Section 13.d., "The landscape plan shall bear the seal of a landscape architect licensed to practice in the State of Florida or be prepared by another licensed prafessional autharized to prepare landscape plans pursuant to Chapter 481, Part II of the Florida Statutes (Landscape Architeeture)." Special Master Torcivia ordered that the Community Appearance Board and the Department of Community Development have waived the requirement set forth in Appendix A- Zoning, Section 13.d., "The landscape plan shall bear the seal of a landscape architect licensed to practice in the State of Florida or be prepared by another licensed professional authorized to prepare landscape plans pursuant to Chapter 481, Part II of the Florida Statutes (Landscape Architecture)" of the Code of Ordinances of the Village of Tequesta. Violation Hearing: Case No. 97-03-005 Robert J. Corie III and Marie Corie, 347 Country Club Drive, Tequesta, Florida, Violation of Tequesta Code of Ordinances, No. 377, Appendix A- Zoning, (E)(1)(5) maintain and screening of pool AND Ordinance N.o. 466, Sec. 10-18, Nuisance Growth/over 12 inches. Legal Description: Tequesta Lot 130 Respondents Robert J. Corie III and Marie Corie were not present at the hearing, however, there was a finding of proper notice. Code Enforcement Officer Davis testified and introduced into evidence a video depicting the ongoing safety violations. Conclusion of law was that Respondents are in violation of the Code of Ordinances of the Village of Tequesta, Ordinance No. 355, Appendix - A Zoning, (E)(1)(5} maintain and screening of pool; and Ordinance No. 466, Section 10-18, Nuisance Growth/over 12 inches. Special Master Code Enforcement Hearing Village of Tequesta June 26, 1997 Page 5 It is the Order of the Code Enforcement Special Master that the fine assessed against Robert and Marie Corie shall continue to run. Additionally, the fine has been increased to $250.00. This amount is to begin June 26, 1997, and continue each day until there is complete compliance. A certified copy of this Order shall be recorded in the Public Records of Palm Beach County, Florida, and once recorded shall constitutE a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes, for the original amount. Upon complying, it is the responsibility of the Ftespondents to notify the Tequesta Code Enforcement Officer at (561) 575-6218 to request a reinspection of the property. Vialation Hearing: Case No. 97-05-019 Dennis G. Sartain and Sherry L. Sartain, 322 Country Club Drive, Tequesta, Florida, Violation of Tequesta Code of Ordinances, No. 464, Sec. (3), page 1185, Parking Restrictions. Legal Description: Tequesta Lot 148 Respondents Dennis G. Sartain and Sherry L. Sartain were not present at the hearing, however, there was a finding of proper notice. Code Enforcement Officer Davis testified and intraduced into evidence a photograph of the violation. Conclusion of law was that Respondents are in violation of the Cade of Ordinances of the Village of Tequesta, Ordinance No. 464, Sec (3), Parking Regulations. It is the Order of the Code Enforcement Special Master that Respondents, Dennis G. Sartain and Sherry L. Sartain, shall comply with Ordinance No. 464, Sec (3), Parking Restrictions, of the Village of Tequesta by the 27th day of June, 1997. If Respondents do not comply within the time specified, a fine of up to Two Hundred Fifty Dollars ($250.00) per day; Five Hundred Dollars ($500.00) Special Master Code Enforcement Hearing � Village of Tequesta June 26, 1997 Page 6 per day for repeat violations, may be assessed for each day the violation continues to exist. If Respondents do not comply within the time specified, an additional Fine Assessment Hearing will be held before the Special Master on the 28th day ofAugust, 1997, at 10:00 A.M., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Should a dispute arise concerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. Upon complying, it is the responsibility of the Respondents to notify the Tequesta Code Enforcement Officer at (551) 575-6218 to request a reinspection of the property.
