Davis; Police Chief Stephen Allison; Police Lieutenant Robert Garlo; Recording Secretary Betty Laur. Meeting was called to order at 10:06 A.M. A. Fine Imposition Hearings: None B. Status Hearings Case No. 96-05-018 Robert A. Walsh 8� Thomas A. Steen c/o Toyota Tequesta Motor Cars, located at U.S. Highway #1, No. 746, Tequesta, Florida. Legal Description: 30-40 N 150 ft of S 800 of Gov Lt 1 W of SR5 & addl R/W (Less TR in OR950P192) Respondent Robert Walsh; Mr. Spradlin, the prospective purchaser of the property; Vincent J. Pappalardo, the contractor for proposed improvements; and an attorney were present at the hearing. Respondent Walsh provided an update as to the status of the property towards compliance. Officer Davis SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTE S MARCH 20, 1997 PAGE 2 affirmed respondent's testimony and testified that the Village was amenable to granting an extension of time until the landscaping can be approved and completed. Conclusion of law in this matter was that Respondents are in violation of the Code of Ordinances of the Village of Tequesta, Ordinance No. 377, Landscaping. The Order of the Code Enforcemenf Special Master was that a Status Hearing will be held before the Special Master on the 19th day of June, 1997, at 10:00 A.M., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Case No. 97-01-072 Sun Trust Bank South Florida Tr, located at 734 U.S. Highway #1 North, Tequesta, Florida. Legal Description: 3Q-40-43, PI 200 Ft of S 650 of Gov Lt 1 LYG W of SR5 � ADD R/W The Respondent, Sun Trust South Florida Tr., was not present at the hearing. The Respondent was found to be in compliance with Ordinance No.466, Section 10-18 of the Code of Ordinances of the Village of Tequesta. C. Violation Hearings: Case No. 97-02-067 Blockbuster Video, iocated within Village Square Plaza, Inc., at 229 U.S. Highway Ido. 1, Tequesta, Florida. Legal Description: Waterway Village, Lot A Violation: Ord. No. 435, Sec. 2.5-15, Alarm Permit [Page 184] Respondent, Blockbuster Video, was not present at the hearing; however, there was a finding of proper notice. Officer Davis testified to and introduced SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES MARCH 20, 1997 PAGE 3 into evidence documents pertaining to the ongoing violation. Conclusion of law in this matter was that Respondent is in violation of the Code of Ordinances of the Village of Tequesta, Ordinance No. 435, Sec. 2.5-15, Alarm Permit. The Order of the Code Enforcement Special Master was that Respondent, Bloc4cbuster Video, shall comply with ORD 435, Sec. 2.5-15, Alarm Permit, of the Village of Tequesta by the 24th day of March, 1997. If Respondent does not comply by the time specified, a fine of $50.�0 per day wili be assessed for each day th� violation continues to exist. If R�spondent does not comply within the time specified, an additional Fine Assessment Hearing will be held before the Special Master on the 1�th day of Rprit, 1997, at 10:00 A.M., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Should a dispute arise concerning comp{iance, either party may request a hearing before the Special Master on the issue of compliance onty. Upon complying, it is the responsibility of the Respondent to notify the Village of Tequesta Code Enforcement Offi�er at (561) 575-6218 to request a reinspection of the property. Case No. 97-03-005 Robert Corie Jr. III Ika 347 Country Club Drive, Tequesta, Florida Legal Description: Tequesta, Lot 130 Violation: Ord. No. 355, Appendix A- Zoning, Sec (E)(1)(5) Restrictions, Pools. [Page 1173] Respondent, Robert Corie Jr. Ilt, was not present at the hearing; hawever, there was a finding of proper notice. Conclusion af I�w in this matter was that Respondent is in violation of the Code of Ordinances of the Village of Tequesta, Ordinance No. 355, Appendix A-Zoning, Sec. (E)(1), restrictions, pools. The Order of the Code Er�forcement Special Master was that Respondent, Robert Corie Jr. IN, shall comply with ORD 355, Appendix A-Zoning, Sec (E)(1), restri�tions, pools, of the Village of Tequesta by the 31 st day of March, 1997. If Respondent does not comply by the time specified, a fine SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES MARCH 20, 1997 PAGE 4 of $100.00 per day will be assessed for each day the violation continues to exist. A certified copy of this Order shall be recorded in the Public Records of Palm Beach County, Florida, and once recorded, shall constitute a lien against the real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the ariginal amount. If Respondent does not comply within the time specified, an additional Fine Assessment Hearing will be held before the Special Master on the 17th day of April, 1997, at 10:00 A.M., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Should a dispute arise concerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. Upon complying, it is the responsibility of the Respondent to notify the Viflage of Tequesta Code Enforcement Officer at (561) 575-6218 to request a reinspection of the property. Case No. 90-08-214 Thomas J. Little, 486 Dover Road, Tequesta, Florida. Legal Description: Jupiter in the Pines, Sec. B, Lot 9, Blk 15. Violation: Ord. No. 355, Appendix A- Zoning, Sec. (X), (L)(2). Restricted Parking [Page 1184.1] Respondent, Thomas J. Little, was present at the hearing. Respondent Little testified and introduced into evidence numerous documents. He also requested a continuance of 120 days. Officer Davis testified to and introduced into evidence a photograph of the ongoing violation. He objected to the requested continuance. The Order of the Code ErYforcement Special Master was that the request for a 120 day continuance was denied. The hearing proceeded and will be continued at the next hearing scheduled for Thursday, April 17, 1997, at 10:00 A.M. Both parties shall submit to the Special Master any documents, memoranda of law, or other materials that they would like the Special Master to consider by Monday, April 14, 1997. A hearing is hereby set for the 17t� day of April, 1997, at 10:00 A.M., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469.
