Davis; Recording Secretary Betty Laur. Meeting was called to order at 9:58 A.M. A. Fine Imposition Hearings: None B. Violation Hearing: Case No. 97-02-051 James C. & Angela D. Tursi, 104 Yacht Club Place, Tequesta, Florida. Legal Description: Tequesta, Lot 499 The Respondent was present at the hearing. Officer Davis testified to and introduced into evidence a video of the property and described the Respondent's ongoing attempts to screen his boat. Conclusion of law in this matter was that Respondents are not in violation of the Cade of Ordinances of the Village of Tequesta, Ordinance No. 464 Zoning (X)(L)(3?, Ordinance 466, Sec. 10-18 of the Code of Ordinances of the village of Tequesta. SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES FEBRUARY 20, 1997 PAGE 2 ----------------------------------------------- The Order of the Code Enforcement Special Master was that Respondents, James C. and Angela D. Tursi, are not in violation of Ordinance No. 464, Zoning {X)(L)(3} of the Code of Ordinances of the Village of Tequesta. C. Status Hearings Case No. 96 Robert A. Walsh & Thomas A. Steen c/o Toyota Tequesta Motor Cars, located at U.S. Highway #l, No. 746, Tequesta, Florida. Legal Description: 30-40-43, N 150 ft of S 800 of Gov Lt i w of SR5 & addl R/W {Less TR in (JR950P192) Respondent Robert Walsh and the prospective purchaser of the property, Mr. Spradlin, were present at the hearing. Officer Davis testified to the good faith efforts of Respondents towards compliance, i.e., cleaning out debris and dead trees. Mr. Walsh testified that the sale af the property should close in one week, and Mr. Spradlin would be the new owner. Mr. Spradlin was advised that compliance would apply to the new owner as well. Conclusion of law in this matter was that Respondents are in violation of Ordinance 377 of the Code of Ordinances of the village of Tequesta. The Order of the Code Enforcement Special Master was that if Mr. Spradlin closes on the property he will secure the necessary landscaping approval from the Building Department by Ma.rch 19, 1997. A status conference will be set for the 20th day of March, 1997, at lO:OQ A.M., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Should a dispute arise concerning compliance, either party may request a hearing before the Special Ma.ster on the issue of compliance only; Upon complying, it is the responsibility of the Respandent to notify the Tequesta Code Enforcement Officer at 561-575-6218 to request a reinspection of the praperty. Case No. 96-11-072 Sun Trust Bank South Flarida Tr, lacated at 734 U.S. xighway #1 North, Tequesta, Florida. Legal Description: 30-40-43, N 2Q0 Ft of S 650 of Gov Lt 1 LYG W Of SR5 & ADD R/W The Respon.dent, Sun Trust South Florida Tr., was not present at the hearing, however, there was a finding of proper service. Officer Davis testified that the Respondent was in substantial compliance and submitted a letter from Respondent into evidence which detailed a work order. Conclusion of law in this matter was that Respondent is in violation of 4rdinance 466, Sec. 10-18 of the Code of Ordinances of the Village of Tequesta. The Order of the Code Enforcement Special Master was that Respondent, Sun Trust South Florida Tr., shall comply with Ordinance No. 466, Section 10-18 of the Code of Ordinances of the Village of Tequesta by the 19th day of March, 1997. If Respondent does not comply within the time specified, a fine of up to twa hundred fifty dollars ($250.00) per day; five hundred ($500) per day for repeat violators may be assessed for each day the violation continues to exist. Should a dispute arise cancerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. Upon complying, it is the responsibility of the Respondents to notify the Tequesta Code Enforcement Officer at 56]. to request a reinspection of the property. C. Fine Reduction Hearings: None. D.
