Davis; Police Lieutenant Robert Garlo; Recording Secretary Betty Laur. Meeting was called to order at 10:00 A.M. A. Fine Imposition Hearings: None B. Violation Hearing: Case No. 96-11-0?2 Sun Trust Bank South Florida Tr, located at 734 U.S. Highway #1 North, Tequesta, Florida. Legal Description: 30-40-43, N 200 Ft of S 650 of Gov Lt 1 LYG W Of SR5 & ADD R/W The Respondent was not present at the hearing, however, there was a finding of proper notice. Officer Davis testified ta and introduced into evidence a video of the angoing violation. Conclusion of law in this matter was that Respondent is in violation of Ordinance 466, Seco 10-18 of the Code of Ordinances of the Village of Tequesta. SPECIAL MASTER C4DE ENFOR�EMENT HEARING MINUTE S January 23, 1997 Page 2 The drder of the Cade Enforcement SpeCial Master was that ReSpondent, Sun Trust Bank South Florida Tr, shall comply with Ozdinance No. 466, Section 10-18 of the Village of Teques�a by February 12, 1997. �tespondent shall not destroy those species, i.e., palmettos and oak trees, and all others pratected by tk�e Village and County, and shall dispose of any Australian pines by February �2, �997. If Respondent does not comply within the time specified, a fine of $100 per day shall be assessed for each day the violation continues to exist. If Respondent does not comply within �he time specified, an additic�nal Fine Assessment Hearing wi11 be held before the Special Master on �.he 2oth day of F'ebruary, 1997 at 10:00 A.M. at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida. Should � dispute arise concerning compliance, either party may request a hearing before the Special Master can the issue of compliance on1y. Upon complying, it is the responsibility of the Respondent to notify the Tequesta Code Enforcement Officer to request � reinspection of the property. Case Na. 97-01-019 Charles H. and Phyllis J. Knapp 115 Country Club Drive, Tequesta, �'lorida. Legal Description: Tequesta, Lot 497 The Respo�dents were present at the hearing and testified to the difficulty they had with their son, who does not close the gat� to screen his truck. Officer Davis testified to and introduced inta evidence a photograph of the violation. Concl.usion af l.aw in this matter was that Respondents are in viola�ion of Ordinance 454, Sec. 1, (L){3} of th� Code of Ordinances of the Village of Tequesta. Legal Description: Jupiter in the Pines, Sec 3, Lot 4, Blk 15 The Respondents were not present at the hearing, however, there was a finding of proper notice. Offi.cer Davis testified to and introduced evidence bf the c�ngoing violatian. Co�.clusion of law in this matter was that Respondents are in violation of Ordinance 464, Sec. 1, ( 2){3�) of the Code af Ordinances of the Vi17.age of Tequesta. The Order of the Code Enforcement Special Master was that Respondents, Dennis and Monica �unningham, sha1Z camply with Ordinance Na. 464, Section 1, (2)(b) of the Village of Tequesta within 24 haurs by keeping the sign on the truek covered. Should a dispu�e arise concerning campliance, either party may request a hearing before the Special Master on the issue ot compliance only. Upon complying, it is the responsibility of the Respondents to notify the Tequesta Code Enforcement Officer to request a reinspection of the property. Case No. 97-01-021 Robert Jr. III and Marie Cor�.e, 347 Country Club Drive, Tequesta, Florida. Legal Descriptian: TequESta, Lot 130 The Responden�s were not present at th� hearing, however, there was a finding of proper notice. Responden�s' letter was accepted in.to evidence. cJfficer Davis testified to and introduced into evidence a photograph of the ongoing violation. Conclusion of law in this matter was �hat Respondents are in violation of Ordinance 464, Sec. l, (I,)(3) af the Code of Ordinances of the Village of Tequesta. The Order af the Code Enforcement Special. Master was that Respondents, Robert Jr. IIT and Marie Corie, shall comply with Ordinance No. 464, Section 1, (L)(3) of the Vill�ge of Teques�a by February 12, 1997.
