Meeting was called to order at 10:10 A.M.
A. Approval of Minutes: Code Enforcement Officer Sgt. John Irovando requested
the following changes to the minutes of the October 23, 1997 Special Master
Hearing:
Case 97-08-172: The first sentence of the second paragraph on page 3 shall be
changed to read, 1t is the Order of the Code Enforcement Special Master that
Respondents W. A. And Hattie 1. Siege/ shall comply with Ordinance No. 196,
Section 90 - 97, of the V`llage of Tequesta within 21 days. The rest of the second
paragraph shall be deleted.
Case 97-08-090: On page 4, the dates of the next hearing shall t�e changed from
Novernber 25 to November 18 in two places.
Code Enforcement Special Master Torcivia approved the minutes of the October
23, 1997 hearing as amended.

Respondent Tequesta Shoppes Ltd., was not present at the hearing, however,
there was a finding of proper notice. Code Enforcement Officer Sgt. Irovando
testified that Respondent was presently working towards compliance.
Conclusion of law was that Respondent is in violation of the Code of Ordinances
of the Village of Tequesta, Ordinance No. 361, Section X(P)(3)(C), location and
screening of dumpsters.
Code Enforcement Special Master Torcivia ordered that Respondent, Tequesta
Shoppes Ltd., shall comply with Ord. No. 361, Section X(P)(3)(C�, of the Village
of Tequesta by the 6th day of February, 1998. If Respondent does not comply
within the time specified, a fine of fifty dollars ($50.00) per day shall be instituted
until there is complete compliance. If Respondent does not comply within the
time specified, a fine of up to two hundred fifty dollars ($250.00) per day; five
hundred dollars ($500.00) per day for repeat violators, may be assessed for each
day the violation continues to exist. If Respondent does not comply within the
time specified, a Fine Assessment Hearing will be held before the Special Master

Respondent John S. Anderson was not present at the hearing. Code
Enforcement Officer Sgt. Irovando testified to the violation.
Conclusion ofi law was that Respondent is in violation of the Code of Ordinances
of the Village of Tequesta, Ordinance No. 464, Section X(L)(3), Restricted
Parking, R-1 A Zoning District.
Code Enforcement Special Master Torcivia ordered that Respondent, John S.
Anderson, shall comply with Ord. No. 464, Section X(L)(3), Restricted Parking,
of the Village of Tequesta. If Respondent does not comply, a fine of up to two
hundred fifty dollars ($250.00) per day; five hundred dollars ($500.00) per day
for repeat violations, may be assessed for each day the vio{ation continues to
exist.

Respondent Edward L. Yanchitis was not present at the hearing. Code
Enforcement Officer Sgt. Irovando testified to the violation.
Conclusion of law was that Respondent is in violation of the Code of Ordinances
of the Village of Tequesta, Ordinance No. 355, Section X(L)(2), Parking
Restrictions.
Code Enforcement Special Master Torcivia ordered that Respondent, Edward L.
Yanchitis shall comply with Ord. IVo. 355, Section X(L)(2}, Parking Restrictions,
of the Village of Tequesta. If Respondent does not comply, a fine of up to two
hundred fifty dollars ($250.00) per day; five hundred dollars ($500.00) per day
for repeat violations, may be assessed for each day the violation continues to
exist.

General Landscaping Requirements.
Respondent Judith M. Fagan was present at the hearing and provided testimony
of events to date. Respondent Fagan has agreed to apply for a variance and
special permit for the property. The check for this variance was submitted to the
Community Development Department and a copy was placed in the Village files.
Conclusion of law was that Respondent is in violation of Ordinance No. 377,
Appendix A Zoning, Section X, (H), General Landscaping, of the Code of
Ordinances of the Village of Tequesta.
Special Master Torcivia ordered that if a variance is not issued by the Village,
Ms. Fagan must submit the required landscape plan to the Community
Development Department within seven (7) days of their denial of said variance.
A twenty-five dollar ($25.00) a day fine shall be assessed for each day after the
seven (7) day period until there is compliance. If the variance is not approved,
Ms. Fagan shall appear for a status hearing on the 26th day of February, 1998,
at 10:00 A.M. at the Tequesta Village Council Chambers, 357 Tequesta Drive,
Tequesta, Florida. Should the Village fiail to act upon this variance by the
February hearing, Ms. Fagan need not attend the February hearing and instead
appear on March 26, 1998, at 10:00 A.M. for the status hearing.
