John Irovando; Village Attorney John C. Randolph, Recording Secretary Betty Laur. Meeting was called to order at 10:00 A.M. A. Code Enforcement Special Master Torcivia approved the minutes of the October 29 , 1998 hearing as submitted. B. Fine Imposition Hearings: None C. Violation Hearings: Case No. 984000018198 W. A. (101.6 Maintenan�ce; 307.4 Care of Premises). Respondents W. A. and Hattie I. Siegel were present at the hearing and were represented by Attorney Adam D. Falcon. The Respandents had submitted a Mc�#ion to Recuse the Special Master and the Village had not been provided with this document. Code Enforcement Special Master Torcivia ordered that the hearing on this matter be continued until January 28, 1999. The Respondents, W.A. and Hattie I. Siegel, and the Village of Tequesta may provide a Memorandum of Law regarding the standard to be applied in recusing a Special Master. This Memorandum shall be received at the Special Master's office no later than January 22, 1999. A hearing before the Special Master shall be held on the 28th day of January, 1999, at 10:p0 a.m., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Wayne was present at the hearing and testified that he had been having difficulty with compliance due to ill heatth. Tequesta Code Enforcement Officer Irovando testified and produced photographs of the violations. Conclusion of I�w was that Respondent Brian G. Wayne is in violation of Chapter 6, Buildings and Building Regulations, Article V, Housing, Sec. 6-81. Code- Adopted., Sec. 6-82. Special Master Paulette 7orcivia ordered that Respondent, Brian G. Wayne, shall comply with Chapter 6, Buildings and Building Regulations, Article V, Housing, Sec. 6-81. Code-Adopted., Sec. 6-82. Same-Amendments, Pages 365, 366. (101.6 Maintenance; 305.2 Exterior Walls; 305.3 Roofs; 305.14 Protective Treatment; 305.15 Accassory Structures), of the Code of Ordinances of the Village of Tequesta, by the 22nd day of January, 1999. If Respondent does not comply within the time specified, a fine of up to two hundred fifty dollars ($250.00) per day, five hundred dollars ($500.00) per day CODE ENFORCEMENT SPECIAL MASTER HEARING November 19, 1998 Page 4 ------------------------------------------------------------------------ for repeat violations, may be assessed #or each day the violation continues to exist. If Respondent does not comply within the time speci#ied, a Fine Assessment Hearing will be held before the Special Master on the 28th day of January, 1999, at 10 A.M. at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Should a dispute arise concerning compliance, either party may request a Mearing before the Special Master on the issue of compliance only. Case No. 980000025193 Noe and Carolee C. Dogs and Cats., Sec. 4-13, Running at Large prohibited, Page No. 259. Respondents Noe and Carolee C. Santamarina, w�ere not present at the hearing, however, there was a finding of praper notice. Tequesta Code Enforcement Officer Irovando testified to the violations. Conclusion of law was that Respondents are in violation of Chapter 4, Animals and Fowl, Article II, Dogs and Cats, Sec. 4-13, Running �t Large Prohibited, Page No. 259 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Noe and Carolee C. Santamarina, shall comply with Chapter 4, Animafs and Fowl, Article II, Dogs and Cats, Sec. 4-13, Running at Large Prohibited, Page No. 259 of the Code of Ordinances of the Village of Tequesta, by the 21 st day of November, 1998. If Respondents do not comply within the time spec�ed, a fine of up to fifty dollars per day ($50.00) will be assessed for each day the violation continues to exist. Respondent Robert Walsh was present at the hearing and was represented by Attorney John Mariani. Code Enforcemen# Officer Police Sgt. John Irovando requested an authorization for foreclosure. Respondent testified and produced photographs of the landscaping that was currently under way. Conclusion of law was that Respondents are in violation of Appendix A-Zaning, Section X, Supplemental Regutations Applying To A Specific, To Several Or To CODE ENFORCEMENT SPECIAL MASTER HEARING November 19, 1998 Page 7 ------------------------------------------------------------------------ All Districts, (H), Landscaping; General Requirements, Pages No. 1174 - 1178.8.1 of the Code of Ordinances of the Village of Tequesta. Code Enforcement Special Mas#er Torcivia ordered that Respondents, Robert A. Walsh and Thomas Steen, shall comply with all landscaping requirements of the Code of Ordinances of the Village of Tequesta by the 22nd day of January, 1999. If Respondents do not comply within the time specified, the Village is authorized to begin foreclosure proceedings. The meeting was adjourned at 11:20 A.M.
