ORDER ' It is the Order of the Code Enforcement Special Master that Respondents, Dennis J. and Peggy A. Campbell, shall comply with Chapter 13, Offenses and Miscellaneous Provisions, Section 13-31, Abandoned, wrecked, etc., vehicles, machines, etc., - Prohibited, declared nuisance, Appendix A-Zoning, Section VIII, off street and on street parking and loading regulations, (C) drainage and maintenance, of the Code of Ordinances of the Village of Tequesta by the 30th day of April, 2001. If Respondents do not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violations continue to exist. Upon complying, it is the responsibility of the Respondents to notify the Village of Tequesta Code Enforcement Clerk at (561) 575-6213 to request a reinspection of the property. Address: 522 No. Dover Road Tequesta, Florida 33469 Legal Description: JUPITER IN THE PINES SEC B LT 10 BLK 16 60-42-40-25-06-016-0100 The Special Master appointed by the Village of Tequesta to hear code enforcement cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Enforcement Hearing held on the 26th day of April, 2001, and based on the evidence and testimonypresented, the following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER are hereby entered: FINDINGS OF FACT 1. The Respondents, Jon R. and Barbara A. Carpenter, were not present at the hearing, however, they were represented by Attorney Geoffrey L. Jones. 2. Sgt. Irovando of Tequesta testified to the violations and presented two witnesses, Larry Doddridge, building inspector, and Mrs. Reynolds, tenant. , W 3. The Special Master has incorporated the February 23, 2001, inspection letter written by Larry Doddridge outlining eight (8) violations into this Order as Exhibit 1 and finds that these accurately reflect the violations. CONCLUSIONS OF LAW Respondents are in violation of Chapter 6, Building Regulations, Article V, In Housing, Section 6-81, Code Adopted, (302.1 Sanitary Facilities, 305.161.1 Interior Floors, Walls and Ceilings, Section 304, Minimum Requirements for Electrical Systems, Section 305.10, Windows to be Openable, Section 305.11, Exterior poors, Section 305.20, Interior poors, Section 305.2, Exterior Walls, Section 305.3, Roofs), of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Code Enforcement Special Master that Respondents, Jon R. and Barbara A. Carpenter, shall comply with Chapter 6, Building Regulations, Article V, In Housing, Section 6-81, Code Adopted, (302.1 Sanitary Facilities, 305.161.1 Interior Floors, Walls and Ceilings, Section 304, Minimum Requirements for Electrical Systems, Section 305.10, Windows to be Openable, Section 305.11, Exterior poors, Section 305.20, Interior poors, Section 305.2, Exterior Walls, Section 305.3, Roofs), of the Code of Ordinances of the Village of Tequesta in the following manner: 1. Respondents shall apply for the appropriate permits to correct each of the eight (8) areas (see Exhibit 1) that need to be complied with by May 9, 2001. If Respondents do not comply within the time specified, a fine of two hundred fifty dollars ($250.00) per day shall be assessed for each day that any of the violations continue to exist. 2. All work on the enumerated eight (8) areas in Exhibit 1 is to be fully completed and all violations complied with by June 1, 2001, or a fine of two hundred fifty dollars ($250.00) per day shall be assessed for each day that any of the violations continue to exist. A copy of this Order shall be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes for the original amount. If Respondents do not comply within the time specified, a Fine Assessment Hearing will be held before the Special Master on the 28th day of June, 2001, at 10:00 a.m., at the Wachovia Bank Building, 250 Tequesta Drive, Suite 300, Tequesta, Florida. ., Upon complying, it is the responsibility of the Respondents to notify the Village of Tequesta Code Enforcement Clerk at (561) 575-6213 to request a reinspection of the property. Larry Doddridge, the Village building inspector, testified and produced photographs of the violations. 3. Sgt. CONCLUSIONS OF LAW Respondent is in violation of Chapter 6, Buildings and Building Regulations, Article II, Buildings, Sec. 6-21, Standard Building Code Adopted, (Section 103.5, Unsafe Buildings or Systems, Section 103.6, Debris in Yard, Section 104.6.1, Job Site Has Been Abandoned), of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Code Enforcement Special Master that Respondent shall comply with Chapter 6, Buildings and Building Regulations, Article II, Buildings, Sec. 6-21, Standard Building Code Adopted, (Section 103.5), Unsafe Buildings or Systems, Section 103.6, Debris in Yard, Section 104.6.1, Job Site Has Been Abandoned), of the Code of Ordinances of the Village of Tequesta in the following manner: 1. Respondent or her engineer shall meet with the Tequesta Building Department to determine her options as to resolving the violations by May 18, 2001. If Respondent fails to comply within this time, a fine of one hundred fifty dollars ($150.00) per day shall be assessed for each day the violations continue to exist. 2. Respondent shall appear at a status hearing on the 31 day of May, 2001, at the Wachovia Bank Building, 250 Tequesta Drive, Suite 300, Tequesta, Florida. 3. Respondent shall bring to the status hearing the following: a. A contractor's agreement to renovate/rebuild the building and his time plan for making the structure safe, or in the alternative, b. A realtor's agreement to sell the property and a contractor's agreement to ensure that the building, including the deli, is safe as per the Tequesta Building Department's requirements. Upon complying, it is the responsibility of the Respondents to notify the Village of Tequesta Code Enforcement Clerk at (561) 575-6213 to request a reinspection of the property.
