LICENSE FOR WATER PIPE LINES ALONG PORTION OF COUNTY HIGI�nTAY KNOWltz AS BRIDGE STREET TO THE VILLAGE OF TEQUESTA KNOW ALL MEN BY THESE PRESENTS: That � �f TEQUESTA, INC. has filed its sworn petition for license to constru.ct, maintain, repair, operate, and remove pipe lines for the transmission of potable water for human consumption under, on, over, across, and along a portion of the County High-• way known as Bridge Street to the Village of Tequesta, according to Sheet No. 4 of a plan of a water system which consists of six sheets under File No. TF 1695 prepared by Brockway, �eber & Brock- way, Engineers; and �HEREAS, it is made to appear by said sworn petition: �a) That said TEQUESTA, INC. desires to construct a water distribution system from the water plant of Jupiter �r,Tater Company, Inc. to said Village of Tequesta, and that attached to said petition, and made a part thereof and marked Exhibit l, is a plan of a water distribution system pertaining to said Village of Tequesta; and (b) That the aforesaid road is without the corporate limits of any municipality; and (c) That the granting of such license is authoxized by Section 125.42, Florida Statutes 1955, as amended by Chapter 57-777, General Laws of Florida 1957, and this Boa.rd has ascer- tained and determined that said petition for license should be granted in the interes of the public in accordance with the provisions of the above statutory authority pertaining thereto, subject to the terms, conditions and provisions hereinafter set forth; NOW, THEREFORE, THE COUNTY OF PAI,M BEACH, FLORIDA, a political subdivision of the State of Florida, acting by and through its BOARD OF COUNTY CGMMISSIONERS, does hereby grant unto the said TEQUESTA, INC. and its successors and assigns, a license to construct, maintain, repair, operate, and remove wa,ter pipe lines for the transmission of water under, on, over, across and along the public road shown on the aforementioned plan of a water system -1- � . . r . , � prepared by Brockway, Weber � Brockway, Engineers, subject to the following terms, conditions and pravisions, to-wit: l. Said Licensee shall use and exercise the license hereby granted so as to prevent the creation of any obstructions or conditions which are or may become dangerous to the traveling public. 2. The Licensee is required to repair any damage or injury to the road by reason of the exercise of the privileges hereby granted, and to repair said road promptly, restoring the same to a condition at least equal to that which existed imtnediately prior to the infliction of such damage or injury. 3. The Licensee shall hold the BOARD OF COUNTY COMMISSIONERS and members thereof, harmless from the payment of any compensation or damages resulting from the exercise of - the privileges granted hereby. 4. That nothing herein contained shall be construed to mean that the COUNTY OF PALM BEACH, FLORIDA, shall be responsible for the maintenance or repair of the road of the aforesaid portion of the County Highway known as Bridge Street. 5. That tne Licensee shall, at its own expense, adjust the positions and elevations of the pipes and other facilities as may be required in connection with future improvement to, or reconstruction of the road of the aforesaid portion of the County Highway known as Bridge Street. 6. The license herein granted sha11 be in perpetuity, subject, however, to termination by the BOARD QF COUNTY COM- MISSIONER� in the event the road.in the aforesaid portion of the County Highway known as Bridge Street, shall be closed, abandoned, vacated or discontinued. 7. In the event of widening or repair or reconstruction of the road aforesaid, the licensee sha11 move or remove such water lines and other utility lines installed by the licensee at no cost to the County of Palm Beach. 8. Tha.t the license hereby granted shall become operative when the acceptance hereof in accordance with the conditions and provisions herein contained shall be endorsed hereon by said Licensee. -2- , . . • �� l R - . - ' ' . .
