HomeMy WebLinkAboutProperty_Easement_06/01/1982 BOARD OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND ������ E A S E M E N T NO. 26234(3211-43 WHEREAS, pursuant to application made by the Village of Tequesta for a right of way easement over and through sovereignty lands held by the Board of Trustees of the Internal Improvement Trust Fund and said Board did on March 16, 1982, agree to the granting of same, THEREFORE, WITNESS, THIS INDENTURE, made and entered into by and between the Board of Trustees of the Internal Improvement Trust Fund, as grantor, and the Village of Tequesta as grantee, does hereby grant unto said grantee its successors and assigns, subject to the conditions hereinafter set forth, a right of way easement for a water main crossing on, under and across the following described land in Martin County, Florida to-wit: A parcel of land lying in part of Fractional Section 19, Township 40 South, Range 43 East, Martin County, Florida, being bound on the west by the approximate High 6�later Line of Jupiter Sound and on the east by a line bear- ing North 35Q 04' 23" West and being more particularly described as follows : g pK �J 47PacE10 18 Commencing at the Southwest Corner of said Section 19; thence South 87 56' 59" East (for convenience all bearings shown herein are relative to the South Line of said Section 19 bearing South 87� 56' 59" East) along the South Line of said Section 19, a distance of 1917.74 feet to a Standard Disc marked P.B.C.; thence North 15� 21' 46" West, being the approximate centerline of S.R. No. 5(US No. 1), a distance of 1925.40 feet to a 2" x 2" Stake; thence South 88° Ol' 33" East, a distance of 697.52 feet to a 2" x 2" Stake on the West 5hore of the Jupiter Sound and the POINT OF BEGINNING of the centerline of a 30 foot Subaqueous Water Main Easement; thence North 86° 07' 35" East across said / Jupiter Sound to a 2" x 2" Stake on the East 1��� Shore of said Jupiter Sound and the POINT OF TERMINATION of said centerline of a 30 foot Subaqueous Water Main Easement. : , • s ' „ The conditions under which this easement is granted are as follows: l. That a11 construction will be conducted only during the months of April through October. 2. That the rights hereby conferred shall be subject to (a) any and ail prior right of the United States; and (b) any and all prior grants by the Board of Trustees of the Internal Improvement Trust Fund in and to submerged lands situated within the limits of the right of way herein- above described. 3. That no title to said land is conferred by this instrument. 4. That the above described parcel of land shall be used solely as right-of-way for the installation, maintenance and use of a water main crossing. And in the event the land herein described shall cease to be used for �� said purposes; and if any work on this project occurs during the time period of November 15 through March 3, the easement hereby granted covering said land shall terminate without notice from the Board of Trustees of the Internal Improvement Trust Fund. 5. That the grantee herein will not, in the construction/installation and maintenance of said water main, damage said lands or unduly interfere with public or private rights therein B ooK s�'IPAGE 6. That the grantee herein shall save, protect and hold harmless the State of Florida and the Board of Trustees of the Internal Improvement Trust Fund from all damages and claims arising out of the use of said easement by the grantee or any of its agents, servants, employees or contractors. That the grantee by acceptance of this agreement binds itself its successors and assigns, to abide by the provisions and conditions herein set forth, and said provisions and conditions shall be deemed covenants of the grantee, its successors and assigns, running with the land. TO HAVE AND TO HOLD said easement unto said grantee, its successors and a5signs, for the purposes herein set forth. IN TESTIMONY WHEREOF, the members of the Board of Trustees of the Internal Improvement Trust Fund have hereunto subscribed their names and have caused the official seal of said Board of Trustees of the Internal Improvement Trust Fund to be hereunto affixed, in the City of Tallahassee, Florida on the ����^ day of `• A.
