HomeMy WebLinkAboutProperty_Easement_12/02/1978 � , �r . � ��� �� BOARD OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND EASEMENT NO. 25930 (2853) WHEREAS, pursuant to application made by the Village of Tequesta, for a right of way easement over certain lands held by the Board of Trustees of the Internal Improvement Trust Fund, the Board of Trustees of the Internal Improvement Trust Fund on August l, 1978, did agree to the granting of said easement. WITNESS, THIS INDENTURE, between the �oard of Trustees of the Internal Improvement Trust Fund, as grantor, and the Village of Tequesta, as grantee, The Board of Trustees of the Internal Improvement Trust Fund, does hereby grant unto the said Village Tequesta, its successors and assigns, a right of way easement for utilities construction purposes, subject to the conditions hereinafter set forth, in and to the following described land in Martin County, Florida, to-wit: A parcel of sovereignty land in the North Fork of the Loxahatchee River abutting Section 23, Township 40 South, Range 42 East, Martin County, Florida, more particularly described as follows: A parcel of land lying and being in part of Section 23 Township 40 South, Range 42 East, Martin County, Florida, being bound on the East and West py the Mean High Water Line of the Loxahatchee River, the centerline of a 25 foot Utility Easement, all of which is subaqueous, described as follows: Commencing at the Northeast Corner of Section 26, Township 40 South, Range 42 East, Palm Beach County, Florida; thence Southerly along the East Line of said Section 26; a distance of 12.50 feet; thence West(for convenience all bearings shown herein are based on the South Line of said Section 23 bearing East-West and all other bearings are relative thereto) a distance of 50 feet; thence North 38°00'00" West, a distance of 55 feet, more or less, to the Point of Beginning of said centerline; thence continue North 38°00'00" West, a distance of 113.19 feet to the beginning of a curve concave to the southwest having a radius of 130 feet and a central angle of 52°00'00" thence northwesterly and westerly along the arc of said curve, a distance of 117.98 feet; thence West, parallel with and 170 feet North of the South line of said Section 23, along the tangent to said curve, a distance of 520 feet, more or less, to the East Mean High Water Line of the Loxahatchee River and the Point �� of Termination of said centerline of 25 foot utility Easement, containing 0.462 acres, more or less. �"' BUOK ��� P�fiC�pGQ�6, r � 1 This easement is granted subject to the following provisions, viz: l. The rights hereby conferred shall be subject to (a) any and all prior rights of the United States; and (b) any and all prior grants by the Board of Trustees of the Internal Improvement Trust Fund in and to submerged lands situated within the limits of the right of way hereinabove described. 2. That no title to said land is conferred by this instrument. 3. That the above described parcel of land shall be used solely as right of way for the construction, maintenance and use of subaqueous utilities. In the event the land herein described shall cease to be used for said purposes then the easement hereby granted covering said land shall revert to the Board of Trustees of the Internal Improvement Trust Fund. 4. That the grantee herein will not, in the construc- tion and maintenance of said utilities, damage or unduly interfere with public or private rights therein. 5. That the grantee herein shall save and protect the Board of Trustees of the Internal Improvement Trust Fund from all damages and claims arising out of the construction, use and/or maintenance of said utilities. 6. That the grantee by acceptance of this agreement, binds itself, its successors and assigns, to abide by the pro- visions and conditions herein set forth, and said provisions and Page 2 of Easement No. 25930 (2853') aut�x '��� ��Gi�:�� � � . conditions shall be deemed covenants of the grantee, its succes- sors and assigns. TO HAVE AND ��O HOLD said easement unto said grantee, its successors and ass�_gns, for the purposes therein set forth.
