GRANT OI' EASEMENT
THIS INDENTURE, made and entered into this - rj'�`� day of January, 1999, by and between
THE EPISCOPAL CHIIRCH OF THE GOOTJ SHEPHERD OF TEQUESTA, INC., a/k/a Church of the
Good Shepherd ("Grantor") in favor of VILLAGE OF TEQUESTA ("Grantee");
WITNESSETH:
WHEREAS, Grantor is seized in fee simple of that parcel of real property (the "Property")
described as fallows:
The South 275 feet, measured at right angles to the South line thereof, of
that part of the Northeast one-quarter of the Southeast one-quarter, lying
East of the East right-of-way line of Seabrook Road, as conveyed to the
County of Palm Beach by Deed recorded in Official Records Book 524,
Page 211, Public Records of Palm Beach County, in Section 25,
Township 40 South, Range 42 East, Palm Beach Counry, Floridae
VVHEREAS, Grantor has installed a water line over a portion of the Property and desires to grant
to Grantee an easement over, under and across that portion of the Property described as follows and
depicted on attached ��ibit A(the '°Easement Land"):

East, Palm Beach County, Florida, the centerline of said 12 foot strip
being more particularly described as follows:
Commence at the intersection of the South line of the Northeast quarter
of the Southeast quarter of said Section 25 with the East Right-of-Way
line of Seabrook Road as recorded in Official Record Book 524, Page
211, Public Records of Palrr� Beach County, Florida; thence North 00°
16' 38" West, along the said East Right-of-Way line (the said East Right-
of-Wav line is assumed to bear North 00° 16' 38" West and all other
bearings are relative thereto) a distance of 266 feet to the POINT OF
BEGINNING of the centerline of the following described 12 foot side
strip; thence departing said East Right-of-Way line South 86° 31' 14'°
East, a distance of 96.00 feet; thence North 89° 53' 46" East, a distance
of 282.00 feei; thence South 00° 06' 14" East, a distance of 78.00 feet to
the beginninb of a curve, concave to the East, having a radius of 100.00
feet and a central angle of 31 ° 19' S6"; thence Southerly, along the arc
of said curve, a distance of 54.96 feet to the point of tangency; thence
South 31 ° 26 10" East, a distance of 6.00 feet to the POINT OF
T'ERMINtiS:
said strip bound at the POINT OF BEGINNING by the said East Right-
of-Way line of Seabrook Road.
NOW, THEREFORE, in pursuance of this agreement and in consideration of the sum of Ten
($10.00) Dollars and other good and valuable consideration, receipt of which is acknowledged, Grantor
does hereby grant, bargain and sell unto Grantee a perpetual, non-exclusive easement over, under and
across the Easement Land for operation, maintenance and repair of waterlines and related facilities located
within the Easement Land, together with an easement over and across the Property for access thereto For
the m�intez�ance ar.d re�air of sach syst�m.
Grantee by acceptance of this Grant of Easement does hereby covenant and agree as follows: (i)
Grantee shall be responsible for the maintenance and repair of said facilities; (ii) in exercising said rights,
Grantee shall restore all portions of the Easement Land to the condition existing prior to such disturbance,
using materials of like kind and quality; and (iii) Grantor may continue to use the Easetnent Land, grant
additional easements to third parties in the Easement Land and landscape the Easemeni Land; provided,
however, Grantor shall not construct any improvements upon the Easement Land which would
unreasonably impair Grantee's use of the Easement Land.
All of the benefits, covenants and agreements herein shall constitute covenants running with the
land, shall be binding upon, and/or shall accrue to the benefit of any and all persons, firms or
corparations, each of them, their respective successors in interest, assigns, heirs and personal
representatives, having or hereafter acquiring any right, title or interest in and to all or any portion of the
Property.
IN WITNESS WHEREOF, Grantor has signed this Grant of Easement on the day and year first
above written.
