HomeMy WebLinkAboutHandouts_Workshop_Tab 02_08/11/2014 RESOLUTION NQ. 11-14 A RESOLUTION OF THE VII,LAGE COUNCII, 4F THE VII.LAGE OF TEQUESTA, FLORIDA, RECOGrTIZING THE VAL�ANT AND HONORABLE SERVICE OF UNITED STATES MII.ITARY PERSONNEL; ACKNOWLEDGING THAT THE PROVIDING OF EMPLOYMENT TRAINING AND ASSISTANCE FOR SUCH HONORABLY DISCHARGED PERSONNEL SERVES AN IlVIPORTANT PUBLIC PURPOSE, NOW MORESO THAN EYER DUE TO RECENTLY ANNOUNCED ACTIVE MII.ITARY PERSONNEL CUTBACKS; FURTHER ACKNOWLEDGING TAE LOCAL, STATE-WIDE AND NATIONAL NEED FOR OUTSTANDING SWORN LAW ENFORCEMENT OFFICERS; AND BASED ON 1'HE FOREGOING, AUTIiORIZING CREATION OF THE VILLAGE OF TEQUESTA "MII.ITARY-TQ-MAIN-STREET" PROGRAM FOR THE RECRUITMENT, T'�tAINING AriD EMPLOYMENT OF HONORABLY DISCHARGED MILITARY PERSONNEL INTO LAW ENFORCEMENT CAREERS; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES WHEREAS, Members and farmer members of the Armed Services of the United State.s from the State of Florida. and from across the nation, who have served so valiantty an.d honorably to protect and preserve the freedoms we all enjoy in the United States of America, deserve special recognition, thanks, and acknowledgement; and WHEREAS, it is an important public purpose, in addition to pmviding the aforesaid recognition, thanks and acknowledgement, to assist honorably dischazged military peisonnei in their re-e�ry into civiiian life; and WHEREAS, lustorically, and across all demograpluc lines, unemployment rates among honorably dischazged military personnel consistently exceed unemployment rates among their civilian counteiparts; and R7HEREAS, the importance of providing assistance to honorably dischazged military personnel in their re-entry into civiliaa life will reach new levels with #he February 24, 2014 announcement by the Department of Defense to reduce the personnel size of the United States Military to a size which has nat �isted since 1940, prior to its World War II build-up, wiuch will in all likelihood increase the disparity between unemployed honorably discharged mili#aty personnel and their unemployed civilian counterparts; and I H/� l�� �U T �i��Zf..I�N� ��-- WHEREAS, over the past several years, law► enfom,emeirt agencies in Florida and across the nation have suffered significant cuts to their sta�ng needs, re9uiring swch agencies to do their best to provide required levels of law enforcement service with reduced sworn personnel, resulting in increased overtime paY, or worse, gaps in service coveiage; and WHEREAS, the Village Council of the Village of Tequesta, desires to simultaneously address all of these issues by authorizing the cregtion of the Village of Tequesta "Miiitazy-to- Main-Street" Prog�ram, whose purPase will be to assist honorably discharged military personnel with their return to civilian Iife by recnuting qualified men and women interested in a career in local law enfor+cement, paying for their police academy training as well as certain living and other incidental expenses during such training, and providing them with the opporiunity of employment as a sworn law enforcement officer; and WHEREAS, funding for the "Military to-Main-Street" Program would 'uutially be derived through law enforcement fimds and. when available certain forfeiture funds received through law enforcement activities in wluch the Village's palice department participates; and WAEREAS, the "Military-to-Main-St�reet" Program would require a minimrnn four yeaz employment commitment from each participant in order for the Village of Tequesta to fiilly realize the value of its investment; and WHEREAS, the Village Council contemplates that the success of the "Militacy-to-Main- Street" Program will allow and encourage the program model to be expanded for use in neighboring jurisdiction,s, and ultimately throughout the state and the nation NOW, THEREFORE BE TI' RESQLVED by the Village Council of the Village of Tequesta, Florida. that: Section 1: The above recitals ate hereby adopted and incorporated into this Resolution. Se�an Z: The Village Council of the Village of Tequesta hereby recognizes the dedication and sen�ice of all United States Military peisonnel, both past and cun+ent, for their unwavering dedication to the protection and. defense of the freedom enjayed by all United States citizens. Section 3: Th.e Village Council, in an effort to assist these brave men and women with their re-entry into civilian life after receiving an honorable discharge, hereby authorizes the creation of the Village of Tequesta "Military-to-Main-Street" Program. This program will z�ecruit qualified men and women interested in a career in local law enforcement, will pay for 2 their police acad.emy training as well as certain living and other incidental expenses during such training, and will provide them with employment as a sworn law enforcement offi.cers. The program will seek a four yeaz employment commitment from each participant in order for the Village of Tequesta to fully realize the value of it� investment. It is the hope and desire of the Village Council that this program will grow beyond the Village of Tequesta aud will be utilized by neighboring jurisdictions, jurisdictions state-wide and ultimately across the entire nation. S�ion 4: The Village Manager is hereby directed to aIl things necessary and appropriate to effectuate the intent of the Village Council in this regard. Section 5: The Council directs the Village Clerk to €orward a copy of the Resolution to the Florida Police Chief s Association, International Association of Cluefs of Police, and the Department of Veterans Affairs. Section 6: This Resolution shall be effective immediately upon adoption. 3 The foregoing Resolution was offered by Council Member Okun who moved its adoption. Village Clerk =��� �'L� CS�� ��'�:�, ; �y:� o . �: :C'.� P � q �F :�y� ,�.eti - � r O ' �� .. t��,, O�1DP �`,.,`. .� , ��� l �1![t+:t1 1 \ 61, � 4 RF.SOLUTION NO. 13-14 A RESOLUTION OF THE VII.LAGE COUNCIL OF TSE VILLAGE OF TEQUESTA, FLOR•IDA, DECLARING THE RECRUITMENT, TRA.INING AND EMPLOYMENT OF HONORABLY DISCHARGED NIILITARY PERSONNEL INTO LAW ENFORCEMENT CAREERS THROUGH THE "MII,ITARY TO MAIN STREET" PROGRAM, TO BE A PUBLIC PURPOSE; AUTHORIZIlITG TI� VILLAGE MANAGER TO ACTIVELY SOLICIT AND ACCEPT, ON BEHALF OV T�E VII.LAGE OF TEQUESTA, DONATIONS TO ASSIST WITH THE FUNDING OF SA.ID PROGRAM; AND ENCOURAGING VII.LAGE OFFICIALS TO DO THE SAME; PROVIDING AN EFFECTIVE DATE; AND FOR UTHER PURPOSES WHEREAS, the Village Council, through Resolution 13-14, authorized the creation of the "Military-to-Mainstreet" Program, to provide for the recruitment, training and employm.ent of honorably discharged military personnel into law enforcement careers; and WI�REAS, pursuant to its home-rule authority as granted by the Fiorida Constitution and Florida Statutes, the Village Council desires to formally declaze that the Militaay-to- Maiastreet Program serves a public purpose; and WHEREAS, pursuant to Florida Law and the Palm Beach County Code of Ethics, as well as numerous Commission on Ethics advisory opinions, it is permissible far Village officials and employees, in the course of their service and duties far the Village, to accept and solicit donations on behalf of the Village from outside entities, including vendors who do business with the Village, when such donations are used directly by the Village for a public purpose, when there is no cantemplated quid-pro-quo as a result of such donation, and whea the official or employee who receives the donation on behalf of the Village derives no personal benefit the�efrom; and WHEREAS, it is the desue af the Village Council that the Village Manager, directly or through his employees, actively seek such donations for the Military-to-Mainstreet Pragcam an behalf of the Village for the sole use of fiuthering the Military to-Mainstreet Program; and WHEREAS, the Village Council further encourages its members to do the same. NOW, THE1tEFORE BE IT RESOLVED by the V�il.lage Cauncil of the Village of Tequesta, Florida that: Section 1: The above recitals are hereby adopted and incarporated into this Resolution. Section 2: The Village Council of the Village of Tequesta, pursuant to its home-rule authority as granted by the Florida Constitution and Florida Statutes, hereby declazes that the Military-to-Mainstreet Progratn, providing for the recruitment, training and employment af honozably discharged militaty personnel into law enforcement careers, serves a public purpose. Section 3: The Village Council hereby authorizes the Village Manager, both directly and through his employees, to solicit donations fram outside entities for the fimding af the Military-to-Mainstreet Program. All such donations shall be dedicated completely to furthering the Milits�uy to-Mainstreet Program. lfiere shall be no expectation of a quid-pro-quo as a result of any such donation. No Village employee who receives such a donation may derive any personal benefit therefrom as contemplated by both state law and the county Code of Etlucs. Section 4: Likewise, the Village Councii encoYUSges its membership to do the same, uader the same terms and conditions.
