AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF
ORDINANCES AT CHAPTER 2. ADMINISTRATION. ARTICLE M.
OFFICERS, EMPLOYEES AND DEPARTMENTS. BY CREATING AN
ENTIRELY NEW DIVISION 4. BUILDING DEPARTMENT. TO
PROVIDE FOR A DISTINCT BUILDING DEPARTMENT, SEPARATE
FROM THE DEPARTMENT OF COMMUNITY DEVELOPMENT;
PROVIDING FOR FUNCTIONS AND FOR SUPERVISION; RE-
NUMBERING ALL SUCCESSIVE DIVISIONS IN THIS ARTICLE;
PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUB-
SECTION OF CHAPTER 2. ADMINISTRATION. SHALL REMAIN IN
FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING
A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND
AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND
FOR OTHER PURPOSES.
WHEREAS, the village's building department is currently located within the department
of community development; and
WHEREAS, pursuant to Sec. 3.05 of the Village Charter, it is the desire of the Village
Council to create an entirely new, separate and distinct Building Department, to handle all
matters encompassed by the Florida Building Code, including floodplain management activities
within the village, said department to be supervised by a duly licensed building official; and
WHEREAS, the Village Council believes the code amendments contained in this
ordinance will be in the best interests of the Village of Tequesta.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1 : Chapter 2. Administration. of the Code of Ordinances of the Village of
Tequesta is hereby amended at Article M. Officers, Employees and Departments. by creating an
entirely new Division 4. Building Department. to provide for a distinct building department,
separate from the department of community development; providing for functions and for
supervision; re- numbering all successive divisions in this article; providing that Chapter 2,
Article III. shall hereafter read as follows:

Officers, Employees and Departments.
DIVISION GENERALLY
[This division shall remain in full force and effect as previously adopted.]
DIVISION 2. VILLAGE MANAGER AND VILLAGE CLERK
[This division shall remain in full force and effect as previously adopted.]
DIVISION 3. DEPARTMENT OF COMMUNITY DEVELOPMENT

(a) There is hereby created a department of community development.
(b) The department of community development shall be responsible for all planning activities in
the Village, including annexations, the comprehensive plan and land development
regulations.
Sec. 2 -102. Supervision.
(a) The department of community development shall be managed and operated by a community
development director who shall be an appointive administrative official appointed by the
village manager.
(b) The department of community development, including the community development director,
shall be subject to general supervision and control by the village manager.

Section 2: Each and every other section and subsection of Chapter 2. Administration.
shall remain in full force and effect as previously adopted.
Section 3: All Ordinances or parts of Ordinances in conflict herewith be and the same
are hereby repealed.
Section 4 : Should any Section or provision of this Ordinance or any portion thereof,
any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the remainder of this Ordinance.
Section 5: Specific authority is hereby granted to codify this Ordinance.
Section 6 : This Ordinance shall become effective immediately upon passage.
Upon Second Reading this day 11 of September, the foregoing Ordinance was offered by
Council Member Okun who moved its adoption. The motion was seconded by Council Member
Paterno and upon being put to a vote, the vote was as follows:

The Mayor thereupon declared the Ordinance duly passed and adopted this 11 day of September,
