The I Village and Respondent hereby agree and stipulate as foliows: 1. On September 22, 2011, Respondent's above referenced property was found to be in violation of the above referenced Viliage c�des (Order Finding Violation). The specific violations are identified with particularity on Exhibit A, attached hereto. On Apri126, 2012, the violations had not been cured and a daily fine of $250.Q0 per day was assessed against the � property, until compliance was achieved (Order Assessing Fine). In addition, Respondent was I ardered to pay the Village's administrative costs of $7�2.36 incurred in prosecuting the code ��� enfarcem�nt case (Order Assessing Fine). Res�ond�nt obj�cts to �ti� �ti�s arid tlie ��rCi�s agree I that this Stipulation resolves all objections resulting in a fair and reasonable resolution of this ' matter. 2. The subject property remains in violation of the above referenced codes; however, Page 1 of 3 i / � i � ' Respondent has applied for, and received, both special exception and site plan modification approvals from the Village Council. The improvements authorized by said approvals will both enhance and upgrade the subject property, and simultaneously cure the code violations in this case. The completion of the improvements will provide value to both Respondent and the Village by enhancing and upgrading the property that will �rovide a�,sitive im�act to all V�Ilage residertts and visitors. This will be further enhanced by additional improvements as set forth below. 3. As of July 24, 2014, the total �nes that have accrued pursuant to the Special Magistrate's above referenced Urders, including administrative costs, amount to Two Hundred and Four Thousand, Five Hundred and Thirty Two Dollars and Thirty Six Cents ($204,532.36), and will continue to accrue until compliance is achieved. 4. Respondents have obtained the necessary permits to complete the improvements authorized by the above referenced development approval, and have commenced construction work on the subject property. It is anticipated that said improvements will be campleted by November 1, 2014. Based on the nature of the violations, as well as the efforts of Respondent to achieve compliance and upgrade and enhance their property, the Village has agreed ta accept, and the Respondent has agreed to pay, the total surn of Sixty Thausand Dollars ($60,000.00), as set forth below, in full settlement of this case as follows: � a. Respondent has prepared the site plan, attached as Exhibit B hereto,,with additional improvennents that will enhance the property and provide benefits to the residents of and visitors to the Village. The value of said additional landscape improvements included in the attached site plan is approximately Fifteen Thousand l�ollars ($15,UOO.bO). �espondent sha11 construct the site in accordance with the atta��hed Exhibit B, including th� additiorial lands�aping, equating tn $15,000 �f the $60,000 payment. b. Respondent shall pay the Vill�ge Thirty Thousand Dollars ($30,000.00) within 30 days of the execution of this stipulation agreement by the parties and by the code enforcement special magistrate. c. Respondent sha11 hold an additional Fifteen Thousand -Dollars ($15,000.00) in escrow. Within thirty (30) days after being notified by Respandent that construction is completed, the Village shall prr�vide a list of additional landscaping the Village desires to be placed an the property, prioritized as to which irnprovements are most important to the Village. Upon receipt of such list, Respondent shall install the landscaping up to the value of the $15,000 held in escrow. In the event that less than Fifteen Thousand Dollars ($15,OOQ.00) worth of further additional landscaping is requested by the Village, then the balance of said Fifteen.Thousand Dollars ($15,000.00) shall be paid to the Village within 30 days of the installation of the further additianal landscaping provided for in this paragraph. Upon completion of the installation of the additional landscaping, Respondent will submit to the Village an"as built" site plan indicating the then current site plan including the additional landscaping which will become the operative, approved site plan for the property. If the Village does not provide such list in the thirty (30) days provided, f'tespondent sha11 pay ttie remaining $15,�1f10 in escrdvv to the Village and the site plan attached hereto as Exhibit B shall be the Page 2 of 3 operative, approved site plan for the p►•ope► d. All improvements and all payments contemplated by this stipulaled settlement a�reement shall be completed no later than February I, 2015. 5. Upon receipt of full payment, and the completion of all improvements contemplated by this stipulated settlement a�reement, the Villa�e shal( immediately record a release of lien for the lien recoded in this case at ORB 25209 P 1663-1117 in the Public Records of Palm Beach County, Florida. 6. In the event that Respondent fails to make full payment, and/or fails to complete all improvements, all as concemplated by this stipulated settlement aareement, then the lien shall revert to its full amount, which shall be calculated to a final amount based upon an amount of Two Hundred and Four Thousand, Five Hundred and Thirty Two Dollars and Thirty Six Cents (5204,532.36) as of July 24, 2014 plus an additional �250 per day through the date that the improvements eontemplated by the attached Exhibit B are completed.
