The Village of Tequesta received written petitions signed by the owners of Parcel 1, 2 and 3 to be annexed
into the Village (see attached signed petitions). Pursuant to Florida Statutes 171.044(1) "The owner or
owners of real property in an unincorporated area of a county which is contiguous to a municipality and
reasonably compact may petition the governing body of said municipality that said property be annexed
to the municipality".
The subject applications are contiguous to the Village of Tequesta boundaries. It consists of 3 parcels
located on County Line Road totaling 1.5316 acres (see attached map and legal description). The proposed
annexation was processed through the County's Annexation Review Process. County staff has not
identified any inconsistencies with Chapter 171 F. S. (see attached letter from Palm Beach County).
Per enclosed legal description and map, the annexation area also includes the adjacent southerly half of
County Line Road. Even though the Village boundaries will include the subject road area, this portion of
County Line Road will continue to be owned, operated and maintained by Palm Beach County.
The first reading of Ordinance 19-14 was held on October 9, 2014 (Council approval 5-0). Once the subject
parcels are part of the Village of Tequesta, a process for Future Land Use amendment and rezoning will be
initiated.

WHEREAS, the Village Council of the Village of Tequesta, Florida, has received written

hereinafter described, who voluntarily desire that said real property be annexed into the Village of
Tequesta, Florida, pursuant to the provisions of Section 171.044, Florida Statutes and Sec. 4.02 of
the Village of Tequesta. Charter; and
WHEREAS, the above referenced three parcels of real property, along with the adjacent
southerly half of County Line Road, to be annexed into the Village of Tequesta. comprise one area of
contiguous, compact, unincorporated territory adj acent to the Village of Tequesta, all of which have
been developed or are suita.ble for development for urban purposes; and
WHEREAS, the voluntary annexation of said parcels will not result in the creation of an
enclave; and
WHEREAS, the Village of Tequesta has caused a11 required advertisements and notices to be
published and sent to all required recipients pursuant to Sec. 171.044, Florida Statutes; and
WHEREAS, it is the opinion of the Village Council that it is in the best public interests that
the real property referenced above and more fully described below be annexed into the Village of
Tequesta.

NOW, TI�REFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, THAT:
Section 1: The above recitals are true and correct and are hereby incorporated herein.
Section 2: The Village Council of the Village of Tequesta, fmds that the real property
consisting of a tota.l of 1.7934 acres, more or less, as well as the adjacent southerly half of County
Line Road, legally described as set forth on Exhibit A and depicted on the map attached hereto as
Exhibit B and made a part hereof, qualifies for annexation pursuant to Section 171.044, Florida
Statutes, as fully described in the recitals hereinabove, and the same is hereby annexed into the
Village of Tequesta, Florida as permitted by Section 4.02 of the Village of Tequesta. Charter.
Section 3: The Village Manager is hereby directed to do all things necessary to effectuate
this annexation.
Section 4: The Village Clerk is hereby directed to file a copy of this Ordinance with the
Clerk of the Circuit Court, Palm Beach County, and the Chief Administrative Officer of Palm Beach
County and with the Department of State within seven (7) days of the adoption of this ordinance.
Section 5: All Ordinances of parts of Ordinances in conflict herewith are hereby
repealed.
Section 6: Should any Section or provision of this Ordinance or any portion thereof, any
paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a whole or any part thereof other than
the part to be declared invalid.
Section 7: This Ordinance shall take effect immediately upon second reading and final
passage.
