VILLAGE OF TEQUESTA
The Village Council of the Village of Tequesta will conduct a public hearing on Thursday,
December 11, 2014 at 6:00 p.m., or as soon thereafter as possible, in the Village Council
Chambers located at 345 Tequesta Drive, Tequesta, Florida to hear public comments and make
final decision on the following requests:

2. BACKGROUND
The subject property at 260 S US Hwy 1 along with the adjacent property to the north located at 150 Tequesta Dr
(Bank of America) received site plan approval in 2003. The subject property was originally developed as an Eckerd's
pharmacy. In early 2005, CVS pharmacy acquired the lease, completed interior renovations, and installed
freestanding and wall signage. The building has 97.3 linear of frontage, is 35 ft high and has a total square footage of
+/- 14,857.

In September 2014, CVS pharmacy's "minute clinic" walk-in health service opened at the subject property location.
The Applicant is seeking approval to install "minute clinic" signage on both the east (facing US Hwy 1) and south
(facing Bridge Rd) elevations of the building.
3. ZONING REVIEW
Currently CVS pharmacy has 50.37 square feet of signage on the north fa�ade and 59.93 (60) square feet on both
the east and south elevations. The proposed addition of minute clinic signs are 18.7 square feet each (see graphics
below). Per Code Section 78-741 (b) (1) (a) Technical Requirements. Signs on Buildings, "one sign per establishment
shall be permitted on the building or structure, not to exceed 60 square feet in area". Proposed additional signage
on each elevations increases the maximum allowable wall sign size from 60 square feet to 78.7 square feet per
elevation. The Applicant is seeking a variance for 18.7 square feet on each elevation (east and south elevations).

4. CRITERIA FOR GRANTING A VARIANCE
Section 78-65 (a) (2) of the Village Code authorizes: "upon application in specific cases such variance from
the terms of this chapter as will not be contrary to the public interest, where, owing to special conditions, a
literal enforcement of the provisions of this chapter will result in unnecessary hardship". The power to
grant any such variance shall be limited by and contingent upon a finding by the Village Council that:
a. Special conditions and circumstances exist which are peculiar to the land, structure, or building
involved and which are not applicable to other lands, structures or buildings in the same zoning district.
b. The special conditions and circumstance do not result from the actions of the applicant.
c. Granting the variance requested will not confer on the applicant any special privilege that is denied by
this chapter to other lands, buildings or structures in the same zoning district.
d. Literal interpretation of the provisions of this chapter would deprive the applicant of rights commonly
enjoyed by other properties in the same zoning district under the terms of this chapter and would work
unnecessary and undue hardship on the applicant.
e. The variance granted is the minimum variance that will make possible the reasonable use of the land,
building or structure.
f. The grant of the variance will be in harmony with the general intent and purpose of this chapter and
such variance will not be injurious to the area involved or otherwise detrimental to the public welfare.

5. FINAL REMARKS
This development application met the requirements set in Section 78-334. Notice of Hearing. The notice of
public hearing was advertised on November 30, 2014, and it was also mailed to all property owners located
within a 300 foot radius of the property for which the Variance is being requested.

JUSTIFICATION OF VARIANCE: You must provide a response to each of the following questions
per Zoning Code Sec. 78-65 (2) a-f. If additional space is needed, please attach extra pages to
this application. If your variance request is related to the public waters of the state comprising
the Loxahatchee River and the Intracoastal Waterway and all creeks, canals or waterways or
tributaries connected therewith, located within the geographical boundaries of the Village, you
must also address the ten criteria listed in the Sec. 76-7.
1. Special Conditions and circumstances exist which are peculiar to the land, structure, or
building involved and which are not applicable to other lands, structures or buildings in
the same zoning district.
The proposed placement of the 18.7 SF "minute clinic" sign was selected by CVS
marketing professionals on the vertical wall above the lower mansard roof on both the
south and east elevations and at the same /evel as the CVS sign as it is the onl y location
which provides exposure to the motoring public becouse of the natural landscape
screening of on-site mid story plant materials as well as the trees and signs within the
streefscape. Additionally, reducing the size of the existing 59.93 SF (rounded to 60 SFJ
CVS/pharmacy/24Hoursigns to accommodate the additiona/ area for the minute clinic
sign to be in compliance with the sign code will render the CVS/phormacy branding on
the prominent gable end of the facade too small and out of proportion with design of the
building and will additionally reduce the visibility of the branding to the motoring public
already challenged by the intermittent screening of the plant materials.
2. The special conditions and circumstances do not result from the actions of the applicant.
Pursuant to the chart and wall sign ordinance limitation of 60 square feet discussed in
item 4. below, the severe limitation of wall sign area imposed by the village, not the
applicant, restricts the advertising of the healthy evolution and expansion of services of
this commercial use which are contributory to the general welfare of rhe community.
3. Granting the variance requested will not confer on the applicant any special privilege
that is denied by this chapter to other lands, buildings or structures in the same zoning
district.
Pursuant to item 4. below, the variance, if granted, will contain conditions and
safeguards that will be proportional to any impacts to other lands, buildings or
structures in the same zoning districr.
4. Literal interpretation of the provisions of this chapter would deprive the applicant of
rights commonly enjoyed by other properties in the same zoning district under the
terms of this chapter and would work unnecessary and undue hardship on the
applicant.
The Village of Teguesta sign code is one of the more limiting codes with regard to
allowable wall sign area. The majority of Florido communities provide allowable sign
areas that are proportional to the size of the building wirh a maximum siae. However,
the Village of Tequesta's code, limits a woll sign to 60 SF no matter the size of the
commercial building or the commercial parcel. This hardship is better illustrated by the
fo/lowing matrix which compares allowable wall sign areas of local jurisdictions based on
a single story building with a front elevation width of 98 feet:

Because the Tequesta code is so limiting, it is natural that businesses wiN, more than
likely, install the maximum size sign initially. If the use or services change or expand
over time and the sign needs modification, more than likely it will already be at the
maximum and therefore a hardship is imposed because of the extreme size limitation.
Such is the case with this CVS application. The addition of this type of clinic is a �
significant expansion of affordable and accessible healthcare services and certainly
should be identified and advertised within respectable regulating ordinances.
Additionally, the severe size limitation imposed by the sign code is not accompanied by a
review process which maximizes the restricted allowable sign areas by exchanging
signage from less important or less visible walls to high visibility walls thus allowing an
increase of signage on one facade with the corresponding decrease on the other. This
alternative review process is provided for in most sign codes in Florido and better
responds to the individual sign needs of rhe business cornmunity while giving the
jurisdiction much more discretion in determining the type, quality, size, design and
oppearance of the signage. Because Tequesta has no discretionary sign review process
allowing the exchanging of sign area, a hardship is established and consideration can
only be provided by the Board of Adjustment or Village Council during the variance
review process.
Pursuant to Sec. 78.65 (a)(2) Powers and duties of the board of adiustment and the
villaqe council the applicant requests that the approving agency exercise its discretionary
authority and impose appropriate conditions with regard to this variance application
that will be proportional to safeguarding any anticipated impacts of exchanging the sign
area from one wall to the two requested walls. For consideration of this addition of an
18.7 square foot "minute clinic" sign making a total sign area of 78.7 SF on both the east
and south erevations, fhe applicant will remove all of the existing signage on the north
elevation which is 50.37SF, resulting in a net overall reduction of 12.97syuare feet from
the existing sign area on the building.

5. The variance granted is the minimum variance that will make possible the reasonable
use of the land, building or structure.
The size and design impact of the additional sign to the south and east elevations of the
building and surrounding neighborhood is minimal. Each sign is only 18.7square feet
and will only be obvious to those specifically looking for it. With reference to the scaled
building elevations attached to this application, the individual "minute clinic" sign is
indeed minimal yet provides reasonable identification of the use and services provided
therein.
6. The grant(ing) of this variance will be in harmony with the general intent and purpose of
this chapter and such variance will not be injurious to the area involved or otherwise
detrimental to the public welfare.
The granting of this variance request will promote Sec. 78-731 Intent and Purpose of the
Tequesta sign code. The stated intent and purpose of protecting and preserving the
aesthetics of the village, protecting property values and especially creating a more
attractive economic and business climate will indeed be achieved. The size and design
impact of the additional "minute clinic" signs to the building is minimal, but what the
additional signs represent and the services which are identified to the public makes
critica/ healthcare opportunities more readily available and therefore certoinly more
affordable. Because Tequesta has such a strong tourist oriented market, it is critical that
nationally recognized minute clinic services are readily identified to the public who are
visiting from all over the nation as well as locol residents. lf a discretionary exchange of
allowable signage from one wall to these respective walls is approved then any and all
detrimental results will be negated. Additionally, the only code compliant alternative
allowed would be the placing of the "minute clinic" signs on the windows which could be
ochieved without permits, but such identification would be too smal! and would 6e
hidden to the motoring public by the tree-scape abutting US Hwy 1, which is becoming
denser by the year.
